A Bill for an Act amend the Commonwealth Electoral Act 1918 in relation to representation of the Northern Territory, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act is the Commonwealth Electoral Amendment (Ensuring Fair Representation of the Northern Territory) Act 2020.

2  Commencement

             (1)  Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this Act

The day after this Act receives the Royal Assent.

3  Schedules

                   Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Commonwealth Electoral Act 1918

1  Paragraph 48(1)(b)

After “(2B),”, insert “(2BAA),”.

2  Subsection 48(2A)

After “(2B),”, insert “(2BAA),”.

3  Subsection 48(2B)

Omit “and in the Northern Territory”.

4  After subsection 48(2B)

Insert:

     (2BAA)  At least two members of the House of Representatives must be chosen in the Northern Territory at a general election.

     (2BAB)  If, on the commencement of subsection (2BAA), the last determination made under subsection (1) is inconsistent with subsection (2BAA), then:

                     (a)  that determination is set aside to the extent to which the determination relates to the Northern Territory; and

                     (b)  for the purposes of section 50, the number of members of the House of Representatives to be chosen in the Northern Territory at a general election that is held:

                              (i)  on or after the commencement of subsection (2BAA) of this section; and

                             (ii)  before the first determination that is made by the Electoral Commissioner under subsection (1) of this section after that commencement;

                            is to be in accordance with the determination made by the Electoral Commissioner under subsection (1) of this section on 31 August 2017; and

                     (c)  for the purposes of section 86, 2 new Divisions are taken to be created for the Northern Territory on that commencement.
