An Act to amend the law relating to export control, and for related purposes

[Assented to 22 June 2020]

The Parliament of Australia enacts:

1  Short title

                   This Act is the Export Control Legislation Amendment (Certification of Narcotic Exports) Act 2020.

2  Commencement

             (1)  Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this Act

The day after this Act receives the Royal Assent.

3  Schedules

                   Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Amendments

  

Export Control Act 1982

1  Section 3 (definition of goods)

Repeal the definition, substitute:

goods means:

                     (a)  an animal or a plant, or part of an animal or a plant; or

                     (b)  an article or a substance (including reproductive material) derived from an animal or a plant, whether or not in combination with any other article or substance; or

                     (c)  food.

Export Control Act 2020

2  Section 12 (paragraph (d) of the definition of goods)

Omit “;”, substitute “.”.

3  Section 12 (definition of goods)

Omit “but does not include narcotic goods within the meaning of the Customs Act 1901.”.
