A Bill for an Act to amend the Marine Safety (Domestic Commercial Vessel) National Law Act 2012, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act is the Marine Safety (Domestic Commercial Vessel) National Law Amendment (Improving Safety) Act 2019.

2  Commencement

             (1)  Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Schedules

                   Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Amendments

  

Marine Safety (Domestic Commercial Vessel) National Law Act 2012

1  After subsection 163(1) of Schedule 1

Insert:

          (1A)  The National Regulator must, by legislative instrument, make a Marine Order which:

                     (a)  requires that if a voyage is less than 12 hours long, the master of the vessel must ensure that a head count is conducted of passengers on embarkation and disembarkation; and

                     (b)  applies to all vessels other than the following:

                              (i)  a Class 4 vessel;

                             (ii)  a vessel used for the purpose of public transport;

                            (iii)  a vessel that is more than 24 metres long.
