A Bill for an Act to amend the Migration Act 1958, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act is the Migration Amendment (Streamlining Visa Processing) Act 2019.

2  Commencement

             (1)  Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

The day this Act receives the Royal Assent.

 

2.  Schedule 1

A single day to be fixed by Proclamation.

However, if the provisions do not commence within the period of 6 months beginning on the day this Act receives the Royal Assent, they commence on the day after the end of that period.

 

Note:          This table relates only to the provisions of this Act as originally enacted. It will not be amended to deal with any later amendments of this Act.

             (2)  Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.

3  Schedules

                   Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Amendments

  

Migration Act 1958

1  Subsection 46(2A)

Repeal the subsection, substitute:

Provision of personal identifiers

          (2A)  An application for a visa is invalid if:

                     (a)  the applicant for the visa is included in a class of visa applicants that is specified by a determination under subsection (2B); and

                     (b)  the determination requires visa applicants of that class to provide a specified type of personal identifier in a specified way; and

                     (c)  at the time that the application is made the applicant has not complied with the requirement.

Note:          See sections 258B to 258G for requirements relating to the provision of personal identifiers.

          (2B)  The Minister may, by legislative instrument, determine that visa applicants in a specified class must provide one or more specified types of personal identifiers in one or more specified ways.

          (2C)  Without limiting subsection (2B), a determination under that subsection may do any one or more of the following:

                     (a)  specify a class of visa applicants in any way, including (but not limited to) by reference to specified circumstances;

                     (b)  specify different types of personal identifiers that are required to be provided by different classes of visa applicants;

                     (c)  specify that a type of personal identifier must be provided by either or both of the following ways:

                              (i)  by way of one or more identification tests carried out by an authorised officer or an authorised system;

                             (ii)  in another way specified in the determination.

Note:          This subsection does not limit subsection 33(3A) of the Acts Interpretation Act 1901.

          (2D)  An applicant for a visa is taken to have complied with the requirement under subsection (2A) to provide a specified type of personal identifier in a specified way if the applicant:

                     (a)  is in immigration detention (other than questioning detention); and

                     (b)  the applicant has, during that detention, provided a personal identifier of that type under Division 13AA of this Part.

2  Subsection 258B(1)

After “purposes of”, insert “subsection 46(2B) or”.

3  Subsection 258D(1)

Omit “under”, substitute “for the purposes of subsection 46(2B) or”.

4  Subsection 258D(2)

Omit “under section 257A by the person”, substitute “by the person for the purposes of subsection 46(2B) or section 257A”.

5  Section 258E

Omit “under”, substitute “for the purposes of subsection 46(2B) or”.

6  Section 258F

Omit “under”, substitute “for the purposes of subsection 46(2B) or”.

7  Section 258F

Omit “authorises the Minister or an officer to require a person to provide a personal identifier under section 257A”, substitute “authorises a requirement to be made for the purposes of subsection 46(2B) or section 257A that would require a person to provide a personal identifier”.

8  Application of amendments

The amendments made by this Schedule apply in relation to an application for a visa made on or after the commencement of this Schedule.
