A Bill for an Act to amend the Infrastructure Australia Act 2008, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act is the Infrastructure Australia Amendment (Social Sustainability) Act 2017.

2  Commencement

             (1)  Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this Act

The day this Act receives the Royal Assent.

 

Note:          This table relates only to the provisions of this Act as originally enacted. It will not be amended to deal with any later amendments of this Act.

3  Schedules

                   Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Amendments

  

Infrastructure Australia Act 2008

1  After subparagraph 5(a)(i)

Insert:

                            (ia)  whether the infrastructure meets the social, as well as economic, needs of rural and regional Australian communities; and

2  After subsection 5A(3)

Insert:

          (3A)  In evaluating each proposal, Infrastructure Australia must consider whether the proposal meets the social, as well as economic, needs of affected rural and regional communities.

3  After subparagraph 5B(1)(b)(ii)

Insert:

                           (iia)  the social benefits that may be anticipated from each proposal;

                           (iib)  any complementary infrastructure required to maximise the social benefits from the proposals;

4  After paragraph 5C(1)(d)

Insert:

                   (da)  the social issues relating to infrastructure;

5  Paragraph 5C(1)(e)

Omit “the needs”, substitute “the current and future needs”.

6  Paragraph 6B(a)

After “consumer,”, insert “community,”.

7  Subparagraph 39B(b)(i)

After “consumer”, insert “, community”.

8  Application of amendments

The amendments made by this Schedule apply in relation to:

                     (a)  audits begun; and

                     (b)  lists prepared; and

                     (c)  the evaluation of proposals for investment begun; and

                     (d)  Infrastructure Plans developed; and

                     (e)  advice given; and

                      (f)  consultations begun; and

                     (g)  corporate plans prepared or varied;

on or after the commencement of the Schedule.
