Queensland Class 1 Heavy Vehicle Christmas and Easter Derestriction Exemption Notice 2016 (No. 1)

Class 1 Heavy Vehicle Exemption Notice – Dimension Exemption
1. Purpose
The purpose of this Notice is to vary the Christmas, New Year and Easter travel restrictions imposed by the Queensland Form 4 Guideline and the National Special Purpose Vehicle Notice.
This Notice lifts those restrictions for vehicles that are operating under specific conditions around the Port of Brisbane, are conducting un-programmed repairs to public utilities, or are supporting resource industry activity in the Cooper Basin.
Note: this Notice takes the place of the series of annual Christmas and Easter derestriction notices previously issued at the start of each specific public holiday period.
2. Authorising Provision
This notice is made under section 117, and Section 23 of Schedule 1, of the Heavy Vehicle National Law as in force in Queensland.
3. Title
This Notice may be cited as the Queensland Class 1 Heavy Vehicle Christmas and Easter Derestriction Exemption Notice 2016.
4. Commencement
This Notice commences on 5 December 2016.
5. Expiry
This Notice expires on 4 December 2021.
6. Definitions
1) Unless otherwise stated, words and expressions used in this Notice have the same meanings as in the Heavy Vehicle National Law.
2) In this Notice –
Christmas/New Year travel restrictions mean the Christmas and New Year restrictions on travel placed on heavy vehicles by:
a) Section 10 of Schedule 3 of the SPV Notice; and
b) Part 10.4 of the Form 4 Guideline.
Easter travel restrictions mean the Easter restrictions on travel placed on heavy vehicles by:
a) Section 10 of Schedule 3 of the SPV Notice; and
b) Part 10.5 of the Form 4 Guideline.
Eligible vehicle means a vehicle that falls under one of the categories set out in section 8(1) of this notice and:
a) is operating under the SPV Notice; or
b) is operating under the Form 4 Guideline.
Form 4 Guideline means the Guideline for Excess Dimension Vehicles Carrying Indivisible Articles Special Purpose Vehicles, Vehicles that require a Pilot or Escort in Queensland, Form Number 4 (Version 8 February 2013).
SPV Notice means the National Class 1 Special Purpose Vehicle Notice 2016.
7. Application
This Notice applies to an eligible vehicle operating in Queensland.
8. Variation of Christmas/ New Year and Easter Travel Restrictions
1) Christmas/ New Year Travel Restrictions and Easter Travel Restrictions do not apply to an eligible vehicle that falls into any of the following categories:
a) Where the eligible vehicle is a crane, or is a heavy vehicle or heavy vehicle combination not wider than 4.5m or longer than 30.0m transporting a large indivisible item, and is using a route set out in Schedule 1 to travel:
i. to or from the Port of Brisbane; and
ii. to or from the bond store/holding yard for the vehicle or load; and
iii. is operating during the hours of travel specified for weekdays and weekends;
a. for eligible vehicles operating under the Form 4 Guideline, in parts 10.2 to 10.4 of the Guideline; or
b. for eligible vehicles operating under the SPV Notice, in section 3(6) and sections 7(4) to 7(6) of Schedule 3.
b) Where the eligible vehicle is a conditionally registered vehicle with unrestricted access, travelling to or from un-programmed operations, provided that the vehicle is involved in immediate repairs to public utilities.
c) Where the eligible vehicle is a special purpose vehicle or a heavy vehicle or heavy vehicle combination transporting a large indivisible item; and
i. is operating under a current dimension exemption (notice or permit); and
ii. is directly involved with, or in support of, Liquefied Natural Gas or mining activities; and
iii. is operating solely within the Cooper Basin as mapped in Schedule 2 of this notice.
