A Bill for an Act to amend legislation relating to transport security, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act is the Transport Security Legislation Amendment Act 2016.

2  Commencement

             (1)  Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this Act

The day this Act receives the Royal Assent.

3  Schedules

                   Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Amendments

  

Aviation Transport Security Act 2004

1  Paragraphs 35(2)(f), 36(2)(f) and 36A(2)(f)

After “for entry to”, insert “, or that are in,”.

2  Subsection 41(1)

Omit all the words after “made under”, substitute:

                   section 44:

                     (a)  in preparation for boarding an aircraft; or

                     (b)  in order to enter or remain in an area or zone within a security controlled airport.

3  Subparagraph 41A(1)(b)(ii)

After “enter”, insert “or remain in”.

4  Subsection 42(1)

Omit all the words after “made under”, substitute:

                   section 44:

                     (a)  in preparation for being taken on board an aircraft; or

                     (b)  in order to be taken into or remain in an area or zone within a security controlled airport.

5  Subsection 43(1)

Omit all the words after “made under”, substitute:

                   section 44:

                     (a)  in preparation for being taken on board an aircraft; or

                     (b)  in order to enter or remain in an area or zone within a security controlled airport.

6  Subsection 44(3)

After “(2)(aa)”, insert “, (2)(i)”.

7  Subsection 127(2)

Omit “who holds, or is acting in, an Executive Level 2, or equivalent, position”.

Omit “who holds, or is acting in, an Executive Level 2, or equivalent, position”.
