Land Administration Fees Regulations 1997

Short title

      Short title

      1.         These regulations may be cited as the Land Administration Fees Regulations 1997.

Interpretation

      2.         In these regulations —

“Act” means the Land Administration Fees Act 1996;

land titles act” means the Land Titles Act 1996;

“Register” means the Register kept under section 27 of the Land Titles Act.

Fee for registration of a subdivision proposal

      3.         For the purposes of subsection 4(7) of the Act, the prescribed fee for the registration of a subdivision proposal under section 49 of the Land Titles Act is 5 fee units.

Prescribed transactions

      3A.      The following transactions are prescribed transactions for the purposes of paragraph 6(f) of the Act.

                  (a)        a transfer of an estate in fee simple in, or a Crown lease of, real property to or by a person in the capacity of the personal representative of the deceased person, or the trustee of the deceased person’s estate —

                              (i)         in accordance with  the provisions of the deceased                                                   person’s will; or

                              (ii)        in accordance with the laws of intestacy; or

                              (iii)       in specie, as an alternative to a requirement under the provisions of the will of the deceased person, or the laws of intestacy, to convert the property into money and pay the proceeds to the beneficiary,

                              not being a transfer in pursuance of a sale; or

                  (b)        a transfer for the purposes of, or consequential on —

                              (i)         a maintenance agreement registered under Part VIII of the Family Law Act 1975 of the Commonwealth; or

                              (ii)        an order under Part VIII of the Family Law Act 1975 of the Commonwealth; or

                  (c)        a transfer of property for the purpose of effecting the retirement of a trustee, or the appointment of a new trustee, if the Registrar of Titles is satisfied that the transfer is not part of a scheme for conferring a benefit, in relation to the trust property, on the new trustee or any other person whether as a beneficiary or otherwise, to the detriment of the beneficial interest, or potential beneficial interest, of any person.

Fee to search Register

      4.         (1)        For the purposes of section 30 of the Land Titles Act, the prescribed fee for searching the Register is 0.5 fee units.

                  (2)        For the purposes of section 30 of the Land Titles Act, the prescribed fee for obtaining a copy of a document referred to in that section is $1.00 per page.

                  (3)        For the purposes of section 30 of the Land Titles Act, the prescribed fee for obtaining a copy of the registered title of a parcel of land, or a registered instrument, certified by the Registrar to be an accurate copy is 1 fee unit.

Fee for inspection of documents

      5.         (1)        For the purposes of section 148 of the Land Titles Act, the prescribed fee for inspecting a document referred to in that section is 0.5 fee units.

                        (2)        For the purposes of section 148 of the Land Titles Act, the prescribed fee for obtaining a copy of a document referred to in that section is $1.00 per page.
