A Bill for an Act to amend the Social Security (Administration) Act 1999, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act may be cited as the Social Security (Administration) Amendment (Consumer Lease Exclusion) Act 2015.

2  Commencement

             (1)  Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Social Security (Administration) Act 1999

1  Section 123TC

Insert:

consumer lease means a contract for the hire of goods by a natural person or strata corporation under which that person or corporation does not have a right or obligation to purchase the goods.

2  After paragraph 123TI(1)(c)

Insert:

                    (ca)  goods hired under a consumer lease where:

                              (i)  the goods are hired wholly or predominantly for personal, domestic or household purposes; and

                             (ii)  a charge is or may be made for hiring the goods and the charge together with any other amount payable under the consumer lease exceeds the cash price of the goods; and

                            (iii)  the lessor hires the goods in the course of a business of hiring goods carried on in this jurisdiction or as part of or incidentally to any other business of the lessor carried on in this jurisdiction.
