A Bill for an Act to provide for the accurate labelling of the country of origin for fish, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act may be cited as the Food Standards Amendment (Fish Labelling) Act 2015.

2  Commencement

                   This Act commences on the day this Act receives the Royal Assent.

3  Schedules

                   Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

4  Purpose of Act

                   The purpose of this Act is to ensure that consumers have clear, accurate information about the country of origin of fish that is offered for immediate consumption.

1  Subsection 4(1)

Insert:

food services sector includes the following:

                     (a)  restaurants;

                     (b)  bars;

                     (c)  takeaway shops;

                     (d)  if another entity or institution is specified under subsection (5)—that entity or institution.

2  At the end of section 4

Add:

             (5)  A standard developed under section 16A may specify an entity or institution for the purposes of paragraph (d) of the definition of food services sector.

3  After section 16

Insert:

16A  Matters for which standards must be developed and approved—country of origin labelling for fish

             (1)  The Authority must, within 12 months after the commencement of this section, develop and approve labelling standards that prescribe how the food services sector must identify the country of origin for fish that is offered for immediate consumption in Australia.

             (2)  Without limiting subsection (1), a standard developed and approved under that subsection must:

                     (a)  use the definition of fish given by Standard 2.2.3; and

                     (b)  include how country of origin labels for fish are to be displayed, including requirements for display in menus and on signs; and

                     (c)  be consistent with the labelling requirements in Standard 1.2.11 (which deals with country of origin labelling for Australia).

             (3)  A standard developed and approved under subsection (1) is not subject to:

                     (a)  section 18 (objectives of the Authority in developing or reviewing food regulatory measures and variations of food regulatory measures); or

                     (b)  Part 3 (food regulatory measures).

             (4)  Subsection (3) does not prevent the Authority from:

                     (a)  developing and approving a new standard under subsection (1) to replace an existing standard under subsection (1), and revoking the existing standard; or

                     (b)  developing and approving a variation of a standard developed and approved under subsection (1), including a standard developed and approved in accordance with paragraph (a) of this subsection.

             (5)  Despite subsection (3), Part 3 (food regulatory measures) applies to:

                     (a)  a standard developed and approved in accordance with paragraph (4)(a); and

                     (b)  a variation of a standard developed and approved in accordance with paragraph (4)(b).

             (6)  A standard developed and approved in accordance with this section must be in force at all times after the first such standard comes into force.
