A Bill for an Act to amend the Food Standards Australia New Zealand Act 1991, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act may be cited as the Food Standards Australia New Zealand Amendment Act 2015.

2  Commencement

                   This Act commences on the day after this Act receives the Royal Assent.

3  Schedules

                   Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Amendments

  

Food Standards Australia New Zealand Act 1991

1  Subsection 4(1) (definition of Council)

Repeal the definition.

2  Subsection 4(1)

Insert:

Forum on Food Regulation (short for Australia and New Zealand Ministerial Forum on Food Regulation) means the body continued in existence by section 11A.

3  Subsection 4(1) (definition of New Zealand lead Minister on the Council)

Repeal the definition.

4  Subsection 4(1)

Insert:

New Zealand lead Minister on the Forum on Food Regulation means the Minister of the government of New Zealand who is:

                     (a)  a member of the Forum on Food Regulation; and

                     (b)  nominated by the government of New Zealand to be the New Zealand lead Minister on the Forum on Food Regulation.

5  Subsection 4(1) (definition of policy guideline)

Omit “Council”, substitute “Forum on Food Regulation”.

6  After section 7

Insert:

7A  Requirements relating to giving written notice

                   If a provision of this Act requires the Authority to give a written notice to an appropriate government agency, the Authority is taken to have satisfied the relevant provision if the Authority gives written notice to an appropriate government agency that the Authority considers has an interest in the matter to which the notice relates.

11A  Establishment

                   The Australia and New Zealand Food Regulation Ministerial Council that was established by the Food Regulation Agreement continues in existence by force of this section under the name Australia and New Zealand Ministerial Forum on Food Regulation (the Forum on Food Regulation).

(3)       The amendment made by item 125 of this Schedule applies to an appointment made on or after the day this item commences, even if the period of 2 years mentioned in subsection 128(3) of the Food Standards Australia New Zealand Act 1991 began before that day.
