A Bill for an Act to amend the Migration Act 1958, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act may be cited as the Migration Amendment (Protecting Babies Born in Australia) Act 2014.

2  Commencement

                   This Act commences on the day after this Act receives the Royal Assent.

3  Schedule(s)

                   Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Migration Act 1958

  

1  Paragraph 5AA(2)(a)

Repeal the paragraph, substitute:

                     (a)  the person entered the migration zone except:

                              (i)  on an aircraft that landed in the migration zone; or

                             (ii)  by being born in the migration zone; or

Note:       Non‑citizens born in the migration zone are taken to have entered Australia when they are born: see section 10.

2  Application of amendments

The amendment made by this Schedule applies to children born on or after the commencement of this item.
