1  At the end of Division 1A of Part 7

Add:

74E  Alpine grazing in Victoria

             (1)  The Minister:

                     (a)  is taken to have received, from the Government of Victoria, a referral of its proposal to allow grazing by cattle in the Alpine National Park for the purposes of a trial as to whether such grazing can assist fire prevention and control; and

                     (b)  is taken to have decided under section 74B, on the commencement of this section, that this Division should apply to the referral.

             (2)  The Minister is taken to have made the decision for the following reasons:

                     (a)  the proposed grazing for the purposes of the trial would have a significant impact on the following listed threatened species and listed threatened ecological communities:

                              (i)  Alpine Sphagnum Bogs and Associated Fens;

                             (ii)  Spotted Tree Frog Litoria spenceri;

                            (iii)  Dwarf Sedge Carex paupera;

                            (iv)  Alpine Tree Frog Litoria verreauxii alpina;

                     (b)  the proposed grazing for the purposes of the trial could have a significant impact on the following listed threatened species and listed threatened ecological communities that are known to exist near the grazing sites:

                              (i)  Spot‑tailed Quoll Dasyurus maculatus maculatus;

                             (ii)  Long‑footed Potoroo Potorous longipes;

                            (iii)  Smoky Mouse Pseudomys fumeus;

                            (iv)  Clover Glycine Glycine latrobeana;

                     (c)  grazing on the scale that would be necessary to achieve any fire control objectives would have an impact on the species and ecological communities mentioned in paragraphs (a) and (b), together with many others, that would outweigh any possible benefits.
