A Bill for an Act to amend the National Broadband Network Companies Act 2011, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act may be cited as the National Broadband Network Companies Amendment (Tasmania) Act 2014.

2  Commencement

                   This Act commences on the day after this Act receives the Royal Assent.

3  Schedule(s)

                   Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1National Broadband Network Companies Act 2011

  

1  Before Subdivision A of Division 2 of Part 2

Insert:

Subdivision AATasmania

8A  Tasmania—fibre to the premises

             (1)  An NBN corporation must not be involved (including by entering into a contract) in the creation, development or building of the national broadband network in a way that involves:

                     (a)  fewer than 200,000 premises of end users in Tasmania being connected to the network by optical fibre to the premises; or

                     (b)  premises of any end users in Tasmania being connected to the network by wire, cable or optical fibre, other than by optical fibre to the premises.

Note:       Paragraph (1)(b) does not apply in relation to satellite or wireless connections.

             (2)  To avoid doubt, connections consisting of optical fibre to connecting nodes supplemented by some other sort of wire or cable connections from the nodes to the premises do not satisfy subsection (1).

2  Application of amendments—existing connections

Paragraph 8A(1)(b) of the National Broadband Network Companies Act 2011, as amended by this Schedule, does not apply in relation to a premises that, just before the commencement of this item, was connected to the national broadband network.
