A Bill for an Act to amend the Marriage Act 1961 to recognise same‑sex marriages solemnised in a foreign country, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act may be cited as the Marriage Act Amendment (Recognition of Foreign Marriages for Same‑Sex Couples) Act 2013.

2  Commencement

                   This Act commences on the day on which it receives the Royal Assent.

3  Objects

                   The object of this Act is to recognise same‑sex marriages solemnised in a foreign country.

4  Schedule

                   The Marriage Act 1961 is amended as set out in the applicable item in Schedule 1.


 

Schedule 1Same‑sex marriages solemnised in a foreign country

Marriage Act 1961

 

Section 88EA

Repeal the section, substitute:

88EA  Certain unions recognised as marriages

             (1)  Notwithstanding the definition of marriage in section 5, a union solemnised in a foreign country between:

                     (a)  a man and another man; or

                     (b)  a woman and another woman;

is recognised as a marriage in Australia.

             (2)  The parties to a union referred to in subsection (1) have the same rights and obligations under this Act, or under any law of the Commonwealth, as the parties to a marriage between a man and a woman.
