A Bill for an Act to amend the Environment Protection and Biodiversity Conservation Act 1999 in relation to alpine grazing, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act may be cited as the Environment Protection and Biodiversity Conservation (Abolition of Alpine Grazing) Act 2011.

2  Commencement

                   This Act commences on the day after it receives the Royal Assent.

 

3  Schedule(s)

                   Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.


 

Schedule 1—Amendments relating to alpine grazing

 

Environment Protection and Biodiversity Conservation Act 1999

1  After section 74D

 Insert:

74E  Alpine grazing in Victoria

                   For section 74C (Informing person proposing to take action that action is clearly unacceptable), the Minister:

                     (a)  is taken to have received, from the Government of Victoria, a referral of its proposal to allow grazing by cattle in the Alpine National Park for the purposes of a trial as to whether such grazing can assist fire prevention and control; and

                     (b)  is taken to have decided under section 74B, on the commencement of this provision, that this Division should apply to the referral for the following reasons:

                              (i)  the proposed grazing for the purposes of the trial would have a significant impact on the following listed threatened species and listed threatened ecological communities:

                                        (A)  Alpine Sphagnum Bogs and Associated Fens;

                                        (B)  Spotted Tree Frog Litoria spenceri;

                                        (C)  Dwarf Sedge Carex paupera;

                                        (D)  Alpine Tree Frog Litoria verreauxii alpina;

                             (ii)  the proposed grazing for the purposes of the trial could have a significant impact on the following listed threatened species and listed threatened ecological communities that are known to exist near the grazing sites:

                                        (A)  Spot-tailed Quoll Dasyurus maculatus maculatus;

                                        (B)  Long-footed Potoroo Potorous longipes;

                                        (C)  Smoky Mouse Pseudomys fumeus;

                                        (D)  Clover Glycine Glycine latrobeana;

                            (iii)  there is no ground for approving the proposed trial because grazing on the scale that would be necessary to achieve any fire control objectives would have an impact on the species and ecological communities mentioned, together with many others, that would outweigh any possible benefits.
