A Bill for an Act to amend the Therapeutic Goods (Charges) Act 1989, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act may be cited as the Therapeutic Goods (Charges) Amendment Act 2009.

2  Commencement

             (1)  Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

The day this Act receives the Royal Assent.

 

2.  Schedule 1

At the same time as Schedule 1 to the Therapeutic Goods Amendment (2009 Measures No. 3) Act 2009 commences.

 

Note:          This table relates only to the provisions of this Act as originally passed by both Houses of the Parliament and assented to. It will not be expanded to deal with provisions inserted in this Act after assent.

             (2)  Column 3 of the table contains additional information that is not part of this Act. Information in this column may be added to or edited in any published version of this Act.

3  Schedule(s)

                   Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.


 

Schedule 1Amendments

  

Therapeutic Goods (Charges) Act 1989

1  After subsection 3(1)

Insert:

          (1A)  For the purposes of this Act, if a suspension of the registration or listing of therapeutic goods has effect under Part 3‑2 of the Therapeutic Goods Act 1989, the goods are taken to be included in the Register under that Part.

          (1B)  For the purposes of this Act, if a suspension of a biological from the Register has effect under Part 3‑2A of the Therapeutic Goods Act 1989, the biological is taken to be included in the Register under that Part.

2  Subsection 3(2)

Omit “However, for”, substitute “For”.

3  After subsection 4(1A)

Insert:

       (1AA)  An annual charge of such amount as is prescribed is payable in respect of the inclusion of a biological in the Register under Part 3‑2A of the Therapeutic Goods Act that has effect at any time during a financial year.

4  After subsection 4(4)

Insert:

          (4A)  If, because of the operation of section 6AAE of the Therapeutic Goods Act, a biological is included in the part of the Register for biologicals included under Part 3‑2A, this section has effect as if the biological had been included in the Register under Part 3‑2A of that Act.
