A Bill for an Act to amend legislation relating to telecommunications, and for related purposes

The Parliament of Australia enacts:

1  Short title

                   This Act may be cited as the Telecommunications Legislation Amendment (National Broadband Network Measures No. 1) Act 2009.

2  Commencement

             (1)  Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Schedule 1Amendments

  

Telecommunications Act 1997

1  Section 7

Insert:

broadband telecommunications network means a telecommunications network that is capable of carrying communications on a broadband basis.

2  Section 7 (after paragraph (h) of the definition of civil penalty provision)

Insert:

                  (haa)  subsection 531F(2); or

                  (hab)  subsection 531F(3); or

3  Section 7

Insert:

designated broadband company has the meaning given by section 531BA.

4  Section 7 (definition of designated request for proposal notice)

Repeal the definition.

5  Section 7

Insert:

NBN Company means A.C.N. 136 533 741 Limited, as the company exists from time to time (even if its name is later changed).

6  Section 7 (definition of protected carrier information)

Repeal the definition.

Insert:

protected network information has the meaning given by section 531B.

utility has the meaning given by section 531B.

9  Section 531A

Repeal the section, substitute:

531A  Simplified outline

                   The following is a simplified outline of this Part:

•      A carrier or utility must give information (protected network information) to an authorised information officer.

•      Protected network information must not be disclosed or used except as permitted by this Part.

•      Protected network information may be disclosed to a Minister or other public official for the purposes of the Implementation Study for the National Broadband Network.

•      Protected network information may be disclosed to an officer of:

               (a)     the NBN Company; or

               (b)     a designated broadband company.

10  Section 531B (subparagraph (c)(ii) of the definition of authorised information officer)

Omit “National Broadband Network Task Force”, substitute “Implementation Study for the National Broadband Network”.

11  Subsection 531B (paragraph (v) of the definition of entrusted company officer)

Omit “the company.”, substitute “the company; or”.

12  Section 531B (after paragraph (v) of the definition of entrusted company officer)

Insert:

                    (w)  if the company is:

                              (i)  the NBN company; or

                             (ii)  a designated broadband company;

                            an employee or director of a body corporate that:

                            (iii)  has entered into a contract with the company; and

                            (iv)  under the contract, has sold, or is to sell, to the company anything that will, after the sale, become, or become part of, a facility in relation to a broadband telecommunications network of the company.

13  Section 531B (definition of matter preparatory to the publication of a designated request for proposal notice)

Repeal the definition.

14  Section 531B (definition of protected carrier information)

Repeal the definition.

15  Section 531B

Insert:

protected network information means:

                     (a)  any information that was given by a carrier or utility to an authorised information officer during the period:

                              (i)  beginning on 7 April 2009; and

                             (ii)  ending immediately before the commencement of this definition;

                            where, after the information was given, an authorised information officer gave the carrier or utility a written undertaking, on behalf of the Commonwealth, that:

                            (iii)  after the commencement of this definition, the information would be treated as protected network information for the purposes of this definition; and

                            (iv)  the information would not be disclosed by an authorised information officer before the commencement of this definition; or

                     (b)  any information that was given by a carrier or utility to an authorised information officer during the period:

                              (i)  beginning at the commencement of this definition; and

                             (ii)  ending 10 years after the commencement of this definition;

                            where, after the information was given, an authorised information officer gave the carrier or utility a written undertaking, on behalf of the Commonwealth, that the information would be treated as protected network information for the purposes of this definition; or

                     (c)  any information that was given to an authorised information officer under section 531F after the commencement of this definition; or

                     (d)  any information that was disclosed after the commencement of this definition under paragraph 531G(2)(a), (b), (f) or (g), subsection 531H(1) or paragraph 531K(2)(a); or

                     (e)  any information that, immediately before the commencement of this definition, was protected carrier information within the meaning of this Part as in force immediately before that commencement.

16  Section 531B

Insert:

utility means:

                     (a)  a person who provides to the public:

                              (i)  reticulated products or services, such as electricity, gas, water, sewerage or drainage; or

                             (ii)  carriage services (other than carriage services supplied by a carriage service provider); or

                            (iii)  transport services; or

                            (iv)  a product or service of a kind that is similar to a product or service covered by subparagraph (i), (ii) or (iii); or

                     (b)  a person who owns any structure or thing used, or for use, in or in connection with the provision to the public of a product or service covered by subparagraph (a)(i), (ii), (iii) or (iv).

17  After section 531B

Insert:

531BA  Designated broadband company

             (1)  The Minister may, by legislative instrument, determine that a specified company is a designated broadband company for the purposes of this Act.

             (2)  A company must not be specified in an instrument made under subsection (1) unless, at the time the instrument is made, any or all of the shares in the company are beneficially owned by:

                     (a)  the Commonwealth; or

                     (b)  the NBN Company; or

                     (c)  a company any or all of the shares in which are beneficially owned by:

                              (i)  the Commonwealth; or

                             (ii)  the NBN Company.

             (3)  For the purposes of this section, if a share in a company is held by the Future Fund Board of Guardians, the share is taken not to be beneficially owned by the Commonwealth.

18  Paragraphs 531C(1)(a), (b), (c) and (d)

After “carrier”, insert “or utility”.

19  After subsection 531C(1)

Insert:

          (1A)  Information specified under paragraph (1)(a) must be information about one or more existing or proposed things that could be used for, or in connection with:

                     (a)  the creation or development of a broadband telecommunications network; or

                     (b)  the supply of a carriage service using a broadband telecommunications network; or

                     (c)  a matter incidental or ancillary to a matter set out in paragraph (a) or (b).

          (1B)  For the purposes of subsection (1A), an existing or proposed facility is taken to be an existing or proposed thing, as the case requires, that could be used for, or in connection with, a matter set out in paragraph (a), (b) or (c) of that subsection.

20  Subsection 531C(3)

Repeal the subsection.

21  Subsection 531C(4)

After “carrier” (wherever occurring), insert “or utility”.

22  Subparagraph 531C(4)(a)(ii)

Omit “3”, substitute “5”.

23  Paragraph 531C(4)(b)

Omit “3”, substitute “5”.

24  Sections 531D and 531E

Repeal the sections.

25  Division 2 of Part 27A

Repeal the Division, substitute:

Division 2Carriers and utilities must give information to an authorised information officer

531F  Carriers and utilities must give information to an authorised information officer

Scope

             (1)  This section applies to a carrier or utility if:

                     (a)  an instrument under subsection 531C(1) comes into force after the commencement of this subsection; and

                     (b)  the effect, or any of the effects, of the instrument is that particular information is designated information for the purposes of the application of this Act to the carrier or utility.

Note:          For utility, see section 531B.

Requirement

             (2)  The carrier or utility must give the information to an authorised information officer, in the approved manner and the approved form, within the approved period after the instrument came into force.

Note 1:       For approved manner, approved form and approved period, see subsection 531C(1).

Note 2:       Information given to an authorised information officer under this section is protected network information—see the definition of protected network information in section 531B.

             (3)  A person must not:

                     (a)  aid, abet, counsel or procure a contravention of subsection (2); or

                     (b)  induce, whether by threats or promises or otherwise, a contravention of subsection (2); or

                     (c)  be in any way, directly or indirectly, knowingly concerned in, or party to, a contravention of subsection (2); or

                     (d)  conspire with others to effect a contravention of subsection (2).

             (4)  Subsections (2) and (3) are civil penalty provisions.

Note:          Part 31 provides for pecuniary penalties for breaches of civil penalty provisions.

Sunset

             (5)  Subsections (1) to (4) cease to have effect at the end of the period of 10 years beginning on the day on which this subsection commenced.

26  Subsection 531G(1)

Omit “protected carrier information”, substitute “protected network information”.

27  Paragraphs 531G(2)(a), (b), (c), (d) and (e)

Repeal the paragraphs, substitute:

                     (a)  both:

                              (i)  the information is disclosed to another entrusted public official for the purposes of the Implementation Study for the National Broadband Network; and

                             (ii)  if a determination is in force under subsection (2A)—the conditions set out in the determination are met;

                     (b)  the information is disclosed to another entrusted public official for a purpose specified in the regulations, so long as the purpose relates to:

                              (i)  the creation or development of a broadband telecommunications network; or

                             (ii)  the supply of a carriage service using a broadband telecommunications network; or

                            (iii)  a matter incidental or ancillary to a matter set out in subparagraph (i) or (ii);

28  Paragraph 531G(2)(i)

After “carrier”, insert “or utility”.

29  Paragraph 531G(2)(j)

After “carrier” (wherever occurring), insert “or utility”.

30  After subsection 531G(2)

Insert:

          (2A)  The Minister may, by legislative instrument, make a determination setting out conditions for the purposes of subparagraph (2)(a)(ii).

          (2B)  Paragraph (2)(a) ceases to have effect at the end of:

                     (a)  30 June 2010; or

                     (b)  if:

                              (i)  a later day is specified in a legislative instrument made by the Minister; and

                             (ii)  the legislative instrument is made before 30 June 2010;

                            that later day.

          (2C)  Paragraph (2)(b) ceases to have effect at the end of the period of 10 years beginning on the day on which this subsection commenced.

31  Subsection 531G(3)

Repeal the subsection.

32  Paragraphs 531G(3A)(a), (b), (c), (d) and (e)

Repeal the paragraphs, substitute:

                     (a)  both:

                              (i)  the information is used for the purposes of the Implementation Study for the National Broadband Network; and

                             (ii)  if a determination is in force under subsection (3AA)—the conditions set out in the determination are met;

                     (b)  the information is used for a purpose specified in the regulations, so long as the purpose relates to:

                              (i)  the creation or development of a broadband telecommunications network; or

                             (ii)  the supply of a carriage service using a broadband telecommunications network; or

                            (iii)  a matter incidental or ancillary to a matter set out in subparagraph (i) or (ii);

33  Paragraph 531G(3A)(h)

After “carrier”, insert “or utility”.

34  Paragraph 531G(3A)(i)

After “carrier” (wherever occurring), insert “or utility”.

Insert:

       (3AA)  The Minister may, by legislative instrument, make a determination setting out conditions for the purposes of subparagraph (3A)(a)(ii).

        (3AB)  Paragraph (3A)(a) ceases to have effect at the end of:

                     (a)  30 June 2010; or

                     (b)  if:

                              (i)  a later day is specified in a legislative instrument made by the Minister; and

                             (ii)  the legislative instrument is made before 30 June 2010;

                            that later day.

        (3AC)  Paragraph (3A)(b) ceases to have effect at the end of the period of 10 years beginning on the day on which this subsection commenced.

36  Subsection 531G(3B)

Repeal the subsection.

37  Subsections 531G(4) and (4A)

After “carrier”, insert “or utility”.

38  Subsection 531G(5)

Omit “protected carrier information”, substitute “protected network information”.

39  Section 531H

Repeal the section, substitute:

531H  Disclosure of protected network information to the NBN Company or a designated broadband company

             (1)  An authorised information officer may disclose protected network information to an entrusted company officer of:

                     (a)  the NBN Company; or

                     (b)  a designated broadband company;

for the purposes of:

                     (c)  the creation or development of a broadband telecommunications network of:

                              (i)  if paragraph (a) applies—the NBN Company; or

                             (ii)  if paragraph (b) applies—the designated broadband company; or

                     (d)  the supply of a carriage service using a broadband telecommunications network of:

                              (i)  if paragraph (a) applies—the NBN Company; or

                             (ii)  if paragraph (b) applies—the designated broadband company; or

                     (e)  a matter incidental or ancillary to a matter set out in paragraph (c) or (d);

so long as:

                      (f)  the disclosure complies with any applicable restricted recipients rules; and

                     (g)  if a determination is in force under subsection (3)—the conditions satisfied in the determination are met.

             (2)  An authorised information officer is not required to give a carrier or utility an opportunity to be heard in relation to a decision to disclose information under subsection (1).

             (3)  The Minister may, by legislative instrument, make a determination setting out conditions for the purposes of paragraph (1)(g).

Sunset

             (4)  Subsections (1), (2) and (3) cease to have effect at the end of the period of 10 years beginning on the day on which this subsection commenced.

40  Subsection 531K(1)

Omit “protected carrier information”, substitute “protected network information”.

41  Paragraphs 531K(2)(a) and (b)

Repeal the paragraphs, substitute:

                     (a)  the disclosure is to another entrusted company officer of the company for the purposes of:

                              (i)  the creation or development of a broadband telecommunications network of the company; or

                             (ii)  the supply of a carriage service using a broadband telecommunications network of the company; or

                            (iii)  a matter incidental or ancillary to a matter set out in subparagraph (i) or (ii);

                            so long as:

                            (iv)  the disclosure complies with any applicable restricted recipients rules; and

                             (v)  if a determination is in force under subsection (2AA)—the conditions set out in the determination are met;

42  Paragraph 531K(2)(c)
