A Bill for an Act to amend the A New Tax System (Family Assistance) Act 1999 to give all adopting parents access to baby bonus payments, and for related purposes
The Parliament of Australia enacts:
1 Short title
This Act may be cited as the A New Tax System (Family Assistance) (Improved Access to Baby Bonus) Amendment Act 2008.
2 Commencement
This Act commences on the day on which it receives the Royal Assent.
3 Schedule(s)
Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.
4 Object
The object of this Act is to permit all adoptive parents to become eligible for baby bonus payment.
5 Appropriation of funds
Any money payable under paragraph 36(5)(b) of the A New Tax System (Family Assistance) (Improved Access to Baby Bonus) Act 2008 is to be paid from moneys appropriated by the Parliament for that purpose.
Schedule 1—Amendment of the A New Tax System (Family Assistance) Act 1999
1 Paragraph 36(5)(b)
Repeal the paragraph, substitute:
(b) the child is a person under the age of consent, where age of consent has the same meaning as in the Social Security Act 1991, at the time the child is entrusted to the care of the individual; and
Note: The Social Security Act 1991 refers to the age of consent as being the age of consent applicable in the State or Territory in which the person lives at the time.
2 Paragraph 36(5)(ba)
Repeal the paragraph.
