A Bill for an Act to amend the law relating to telecommunications, and for other purposes

The Parliament of Australia enacts:

1  Short title

                   This Act may be cited as the Telecommunications Legislation Amendment (Communications Fund) Act 2008.

2  Commencement

                   This Act commences on the day after it receives the Royal Assent.

3  Schedule(s)

                   Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.


 

Schedule 1Amendments

  

Telecommunications (Consumer Protection and Service Standards) Act 1999

1  Section 158ZE

After:

•      Money in the Fund will be used to finance the implementation of the Commonwealth Government’s response to the recommendations of the Regional Telecommunications Independent Review Committee.

Insert:

•      Money in the Fund is also available for purposes relating to the creation or development of a broadband telecommunications network.

2  Section 158ZF

Insert:

acquire includes acquire by way of issue.

3  Section 158ZF

Insert:

broadband network debenture has the meaning given by section 158ZNA.

4  Section 158ZF

Insert:

broadband network share has the meaning given by section 158ZNA.

5  Section 158ZF

Insert:

broadband network trust unit has the meaning given by section 158ZNA.

6  Section 158ZF

Insert:

broadband telecommunications network means a telecommunications network that is capable of carrying communications on a broadband basis.

7  Section 158ZF (definition of unit)

Repeal the definition, substitute:

unit:

                     (a)  when used in relation to a share, debenture or other interest—has the same meaning as in the Corporations Act 2001; or

                     (b)  when used in relation to a unit trust—means a unit in the unit trust.

8  Paragraph 158ZI(1)(b)

Omit “above purpose”, substitute “purpose set out in paragraph (a)”.

9  Paragraph 158ZI(1)(c)

Omit “either of the above purposes.”, substitute “a purpose set out in paragraph (a) or (b);”.

10  At the end of subsection 158ZI(1)

Add:

                     (d)  the acquisition of shares in a company that is, or will be, involved in the creation or development of a broadband telecommunications network;

                     (e)  the acquisition of debentures of a company that is, or will be, involved in the creation or development of a broadband telecommunications network;

                      (f)  the acquisition of units in a unit trust that is, or will be, involved in the creation or development of a broadband telecommunications network;

                     (g)  the making of grants of financial assistance in relation to the creation or development of a broadband telecommunications network;

                     (h)  the making of grants of financial assistance in relation to the supply of a broadband carriage service over a broadband telecommunications network;

                      (i)  the acquisition of assets for use in connection with a broadband telecommunications network;

                      (j)  a purpose incidental or ancillary to a purpose set out in paragraph (d), (e), (f), (g), (h) or (i).

11  Section 158ZJ

Repeal the section.

12  Section 158ZJA

Repeal the section.

13  Paragraph 158ZL(1)(b)

Omit “158ZI(c)”, substitute “158ZI(1)(c), (g) or (h)”.

14  Paragraph 158ZM(1)(b)

Omit “158ZI(c)”, substitute “158ZI(1)(c), (g) or (h)”.

15  At the end of Division 2 of Part 9C

Add:

158ZNA  Broadband network shares, debentures and trust units

             (1)  For the purposes of this Part, a broadband network share is a share that:

                     (a)  is held by the Commonwealth; and

                     (b)  was acquired using money debited from the Fund Account for the purpose mentioned in paragraph 158ZI(1)(d).

             (2)  For the purposes of this Part, a broadband network debenture is a debenture that:

                     (a)  is held by the Commonwealth; and

                     (b)  was acquired using money debited from the Fund Account for the purpose mentioned in paragraph 158ZI(1)(e).

             (3)  For the purposes of this Part, a broadband network trust unit is a unit in a unit trust, where the unit:

                     (a)  is held by the Commonwealth; and

                     (b)  was acquired using money debited from the Fund Account for the purpose mentioned in paragraph 158ZI(1)(f).

             (4)  Division 3 does not apply in relation to:

                     (a)  a broadband network share; or

                     (b)  a broadband network debenture; or

                     (c)  a broadband network trust unit.

             (5)  Section 39 of the Financial Management and Accountability Act 1997 does not apply in relation to:

                     (a)  a broadband network share; or

                     (b)  a broadband network debenture; or

                     (c)  a broadband network trust unit.

16  Transitional—section 158ZJ of the Telecommunications (Consumer Protection and Service Standards) Act 1999

The repeal of section 158ZJ of the Telecommunications (Consumer Protection and Service Standards) Act 1999 effected by this Schedule does not affect a credit made before the commencement of this item.
