A Bill for an Act to remove recognition of the US Military Commissions, intended to try Australian citizen David Hicks, from the Proceeds of Crime Act 2002
The Parliament of Australia enacts:
Part 1—Preliminary
1 Short title
This Act may be cited as the Removal of Recognition of US Military Commissions (David Hicks) Act 2006.
2 Commencement
This Act commences on the day on which it receives the Royal Assent.
3 Schedule(s)
Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.
Schedule 1—Amendment of the Proceeds of Crime Act 2002 to remove recognition of US Military Commissions
1 Subsection 337A(3)
Repeal the subsection, substitute:
(3) In this section:
offence against a law of a foreign country does not include an offence triable by a military commission of the United States of America established by The United States Military Commissions Act 2006 or established under a Military Order of 13 November 2001 made by the President of the United States of America and entitled “Detention, Treatment, and Trial of Certain Non‑Citizens in the War Against Terrorism”.
