Principal regulations

1. In these Regulations, "Principal Regulations" means the Dairy Produce Export Control (Licences) Regulations.

Products prescribed as dairy products

2. Regulation 4A of the Principal Regulations is amended by inserting in paragraph (1) (a) "whole milk powder" after "sodium caseinate".

Conditions and restrictions - general

3. Regulation 8 of the Principal Regulations is amended by adding at the end thereof the following sub-regulations:

"(2) A licensee shall not, otherwise than in circumstances permitted by the Arrangement, export dairy produce of a kind specified in Column 2 of an item in the following table unless the dairy produce is sold before export, or consigned for sale, at a price per tonne that is not less than the price, free on board, per tonne, expressed in United States dollars, specified in Column 3 of that item adjusted in accordance with the Arrangement:

"(3) In this regulation -
(a) "Arrangement" means the International Dairy Arrangement done at
Geneva on 12 April 1979, as in force at the commencement of this
regulation; and
(b) "cheese" means cheese the fat content in dry matter, by weight, of
which is equal to or more than 45 per cent and the dry matter content,
by weight, of which is equal to or more than 50 per cent.

"(4) For the purpose of ascertaining the value in United States dollars of dairy produce for the purposes of this regulation, the price at which the dairy produce is sold or consigned for sale shall be converted into United States dollars at the rate of exchange determined by the Reserve Bank on the day on which the produce is sold or consigned for sale.".
