3. (1) In these Regulations, unless the contrary intention appears-

"the Act" means the Weights and Measures (National Standards) Act 1960;

"time interval" means time interval not related to the calendar;

"verifying authority ", in relation to the verification or reverification of a standard of measurement, means a person who is a verifying authority in relation to the verification and reverification of such a standard of measurement by virtue of an appointment under regulation 77.

37. The pascal second is the viscosity of a fluid for which there is a tangential force of 1 newton on 1 square metre of either of 2 infinite parallel planes 1 metre apart when-

(a) the space between those planes is filled with the fluid;

(b) one of the planes moves with a velocity of 1 metre per second in its own plane relative to the other; and

(c) the movement of the fluid is laminar.

77. (1) The Commission may, by instrument in writing, appoint a person (including a body corporate) to be a verifying authority in relation to the verification and reverification of standards of measurement as subsidiary standards of measurement.


(2) An appointment under this regulation may be an appointment of the person for the time being holding, or performing the duties of, a specified office of-

(a) the Commonwealth or a State or Territory of the Commonwealth; or

(b) a body corporate.


(3) An appointment under this regulation may be in relation to the verification and reverification of standards of measurement generally or the verification and reverification of the standards of measurement included in a particular class or particular classes of standards of measurement.


WEIGHTS AND MEASURES (NATIONAL STANDARDS) REGULATIONS - SECT. 78.
Marks to be stamped on or affixed to standards of measurement

78. (1) Subject to this regulation, a standard of measurement shall not be verified or reverified under these Regulations unless-

(a) a distinguishing mark has been stamped or otherwise legibly and permanently affixed on or to it before it is verified or reverified; or (b) there is stamped or otherwise legibly marked on or affixed to it, immediately after it has been verified or reverified, a mark indicating the date on which it was verified or reverified and, if such is the case, that it is to be deemed to be of a value equal to its denomination in accordance with regulation 82 of these Regulations.


(2) The last preceding sub-regulation does not apply in relation to a standard of measurement if it is impracticable, by reason of its size or nature, so to stamp or affix a mark referred to in paragraph (a) or (b) of the last preceding sub-regulation on or to it.


WEIGHTS AND MEASURES (NATIONAL STANDARDS) REGULATIONS - SECT. 78A.
Verification, &c., of standards of measurement referred to in section 8 of
the
Act

78A. (1) Where a standard of measurement referred to in section 8 of the Act is verified or reverified-

(a) in the case of a verification or reverification carried out by the Organization-an officer or employee of the Organization authorized by the Organization in writing to sign and issue certificates under this regulation; or (b) in any other case-any person authorized by the Organization in writing to sign and issue certificates under this regulation,

may sign and issue such a certificate with respect to the verification or reverification of the standard of measurement.


(2) There shall be stated in every such certificate-

(a) the date on which the standard of measurement was verified or reverified;

(b) the accuracy with which the standard was verified or reverified;

(c) a description of the mark (if any) appearing on the standard as referred to in the last preceding regulation;

(d) the value, in terms of a Commonwealth legal unit of measurement or Commonwealth legal units of measurement, of the standard as ascertained on the date referred to in paragraph (a) of this sub-regulation; and

(e) that the standard is a Commonwealth standard of measurement or a working standard of measurement, as the case may be.

(3) For the purposes of paragraph (b) of the last preceding sub-regulation, the accuracy of the standard of measurement shall be ascertained and expressed in a manner authorized by a determination of the Organization for the purposes of this regulation or, if more than one manner is authorized in such a determination, in one of the manners so authorized.


(4) This regulation does not apply to a special standard of measurement referred to in sub-section (2A) of section 8 of the Act.


WEIGHTS AND MEASURES (NATIONAL STANDARDS) REGULATIONS - SECT. 79.

80. (1) The verification and reverification of a standard of measurement as a subsidiary standard of measurement for the purposes of the Act shall be carried out-

(a) by the Organization; (b) by a verifying authority being a body corporate; or

(c) by, or under the supervision of, a verifying authority not being a body corporate,

in accordance with this regulation.

(2) The verification or reverification shall be carried out in a manner that, having regard to the nature of the standard to be verified or reverified, is appropriate for the purpose.

(3) Where a standard of measurement is verified or reverified as a subsidiary standard of measurement by the Organization, the Organization or an officer or employee of the Organization authorized by the Organization in writing for the purposes of this sub-regulation shall specify the period within which the standard is to be reverified or reverified again, as the case requires, and the standard shall be reverified within that period.

(4) Where a standard of measurement is verified or reverified as a subsidiary standard of measurement by, or under the supervision of, a verifying authority, the standard shall be reverified, or reverified again, as the case requires, within such period as the Commission or a person authorized by the Commission in writing for the purposes of this sub-regulation directs.

(5) A direction by the Commission or a person authorized by the Commission, under the last preceding sub-regulation may relate to a particular standard of measurement or to all the standards of measurement included in a particular class of standards of measurement.

(6) Where a standard of measurement is verified or reverified in accordance with this regulation-

(b) if the verification or reverification is carried out by, or under the supervision of, a verifying authority not being a body corporate-

(i) the verifying authority; or

(ii) if the Commission empowers the verifying authority to authorize in writing a person or persons to sign and issue certificates under this regulation, a person so authorized,

may sign and issue a certificate under this regulation.

Certificates as evidence

80A. (1) A certificate issued under this Part is evidence of the matters stated in it.


(2) A document purporting to be such a certificate may be received in evidence in any court (whether exercising federal jurisdiction or not) or in proceedings before a person authorized by a law of a State or Territory of the Commonwealth, or by consent of parties, to hear, receive and examine evidence.

(3) A certificate purporting to be a certificate under this Part or a document purporting to be a document cancelling a certificate under this Part shall, unless the contrary is proved, be deemed to have been signed and issued by the person by whom it purports to have been signed and issued and, unless the contrary is proved, the person by whom it purports to have been signed and issued shall be deemed to be a person authorized by, or in pursuance of, this Part to sign and issue the certificate or document.

Cancelling of certificates

81. (1) A certificate issued under regulation 78A or regulation 79 of these Regulations may be cancelled at any time by the Organization or by a person authorized in writing to do so by the Organization.


(2) A certificate issued under regulation 80 of these Regulations may be cancelled at any time-

(a) in the case of a certificate issued by an officer or employee of the Organization-by the Organization or by a person authorized in writing to do so by the Organization; or

(b) in the case of a certificate issued by a verifying authority, an officer or employee of a verifying authority or a person empowered by a verifying authority under paragraph (b) of sub-regulation (6) of regulation 80 of these Regulations to sign and issue certificates-

(i) by the Commission;

(ii) by the verifying authority; or

(iii) by a person authorized in writing by the Commission to cancel a certificate of such a kind.


(3) Where a certificate is cancelled in pursuance of this regulation, the body or person cancelling the certificate shall sign and issue a document stating that the certificate has been cancelled or, if the certificate is in the possession of the body or person, endorse on it the word "Cancelled" and the date of cancellation.

Permissible variations in certain subsidiary standards of

(1) A subsidiary standard of measurement of a denomination referred to in the first column of Schedule 31 that on verification or reverification is found not to be greater or less than its denomination by an amount exceeding the amount of permissible variation specified in the second column of that Schedule opposite to the reference to its denomination in the first column shall be deemed to be of a value equal to its denomination unless the certificate issued under regulation 80 of these Regulations in respect of that verification or reverification states otherwise.


(2) A subsidiary standard of measurement referred to in the last preceding sub-regulation shall not be deemed, in pursuance of that sub-regulation, to be of a value equal to its denomination unless the variation of the subsidiary standard of measurement from its denomination is determined to an accuracy that is equal to, or better than, one-third of the permissible variation relevant to that standard of measurement.

(2) A subsidiary standard of measurement referred to in the last preceding sub-regulation shall not be deemed, in pursuance of that sub-regulation, to be of a value equal to its denomination unless the variation of the subsidiary standard of measurement from its denomination is determined to an accuracy that is equal to, or better than, one-third of the permissible variation relevant to that standard of measurement provided that the variation is so determined to an accuracy that is not better than that set out in the third column of Schedule 32 opposite to the reference to the denomination of that standard of measurement in the first column of that Schedule.

*2* The Schedules-As originally made, these Regulations contained 23 Schedules. The Twenty-fourth to the Thirtieth Schedules were added from 1965 to 1967. By Statutory Rules 1979 No. 60, the First to the Twenty-third Schedules (inclusive) were substituted by Schedules 1 to 23, and Schedules 24 to 30 were added (regulation 5). The Twenty-fourth and Twenty-fifth Schedules were amended and re-numbered Schedules 31 and 32 respectively (regulations 6 and 7), and the Twenty-sixth to the Thirtieth Schedules (inclusive) were repealed (regulation 8).
