DISTILLATION REGULATIONS - REG 1
Citation

1. These Regulations may be cited as the Distillation Regulations.*1* SEE NOTES TO FIRST ARTICLE OF THIS CHAPTER .

DISTILLATION REGULATIONS - REG 1A
Interpretation

1A. (1) In these Regulations, "the Act" means the Distillation Act 1901-1968.

<
(2) In these Regulations:
(a) references to the bottling of spirits shall be read as references to the putting-up of spirits into a bottle, flask or can; and
(b) references to a bottle of spirits shall, unless the contrary intention appears, be read as references to a bottle, flask or can of spirits.

DISTILLATION REGULATIONS - REG 2
Application for spirit maker's licence

2. An application for a spirit maker's licence shall be in accordance with Form 1, and shall comply with all the requirements indicated therein.

DISTILLATION REGULATIONS - REG 3
Fee for spirit maker's licence application

3. (1) A spirit maker's licence shall be in accordance with Form 3 or Form 5.

<
(2) The annual fee for a spirit maker's licence is Ten dollars.

DISTILLATION REGULATIONS - REG 4
Security - application for spirit maker's licence

4. (1) The security required to be given by section 18 of the Act in respect of an application for a spirit maker's licence shall be in accordance with Form 4 or Form 6.

<
(2) The amount of the security referred to in subregulation (1) shall be such amount, being not less than One thousand dollars and not more than Ten thousand dollars, as the Collector determines.

DISTILLATION REGULATIONS - REG 5
Requirements in relation to distilleries licensed under spirit maker's
licence

5. The following requirements must be complied with to the satisfaction of the Collector in relation to every distillery licensed under a Spirit Maker's licence:
(a) The premises must admit of the proper supervision of operations by officers.
(b) When required by the Collector the premises must be securely walled or fenced, and furnished with substantial gates, which shall be provided with locks approved by the Collector.
(c) There must be on the premises:
(i) A material store or material tank for the reception of material;
(ii) A spirit store for the storing of spirits pending warehousing
or for storing of spirits in vats during the process of maturing;
(iii) A warehouse for the warehousing of spirits, provided that this
requirement may be waived subject to the approval of the Comptroller.
(d) The name of every store-house or room must be painted in oil colours in conspicuous letters on the outside of its door.
(e) Except by permission the premises must not be within 90 metres in a direct line from any brewery or from the premises of a cordial manufacturer or from the premises of a seller of spirits.
(f) There must be erected in the still-house:
(i) A still capable of exhausting in the case of a general
distiller's licence at least 675 litres of wash in an hour, and in the case of a wine distiller's licence at least 225 litres in an hour, or a wash still capable of containing at least 2,700 litres, and also capable of containing double the quantity which the low wines or spirit still is capable of containing.
In lieu of one still of the required capacity two or more stills aggregating the required capacity shall suffice.
(ii) Also if the still is of such a kind that the produce of the
wash on the first distillation is spirits and feints:
One wash charger,
One feints receiver,
One spirit receiver;
(iii) Also if the still is of such a kind that the produce of the
wash on the first distillation is low wines, then in addition to the above:
One low wines receiver,
One low wines and feints charger.
(g) In every fermenting back:
(i) There must be a discharge cock or plug and plughole, through
which all wash in the back may be conveyed by a pipe or open trough into the wash charger, or by authority through a close metal pipe direct to the still;
(ii) Except as provided in paragraph (i) and except the pipe
admitting the wort and a sewer cock or plug and plughole for carrying off the water with which the back is cleansed, there must be no other pipe or outlet;
Provided that:
(iii) When the conversion of the starch contents and fermentation
take place simultaneously, the fermenting vessel may be provided with other necessary apparatus and outlet pipes capable of being securely fastened.
(h) Every wash charger:
(i) Must be of a capacity of not less than half that of the largest
fermenting back or as approved by the Collector in cases where the capacity of the fermenting backs exceeds 45,500 litres;
(ii) Must be connected:
(1) With the fermenting backs by one close metal pipe with one end fixed into a pump placed in a pipe or trough communicating with the fermenting back and the other end fixed into the wash charger;
(2) with the wash stills by one close metal pipe with a branch to each still or to the intermediate still charger;
(3) with the feints receiver by a close pump or metal pipe; and so that:
(iii) There must be a cock on each of the connecting pipes.
(i) Every low wines receiver:
(i) Must be connected with the safe at the end of the worm of the
wash still by one close metal pipe attached to and leading directly from the safe, so that all low wines running from the safe into the pipe shall immediately be discharged into the receiver;
(ii) Must have fixed in it a pump, or discharge cock, for the
conveyance of low wines into the low wines and feints charger.
(j) Every feints receiver:
(i) Must be connected with the safe at the end of the worm of the
still by one close metal pipe attached to and leading directly from the safe, so that all feints running from the safe into the pipe shall immediately be discharged into the feints receiver;
(ii) Must have fixed in it a pump, or discharge cock, for the
conveyance of feints into the low wines and feints charger or wash charger.
(k) Every low wines and feints charger:
(i) Must be connected with the still by a close metal pipe with a
cock thereon, one end of the pipe being fixed into the bottom of the charger and the other attached to the pump or to the still;
(ii) Must be connected with the low wines receiver and feints
receiver by close metal pipes, whereof one end must be fixed into the charger and the other end attached to the pump or discharge cock fixed in each receiver.
(l) Every spirit receiver:
(i) Must be connected with the safe at the end of the worm of the
still by one close metal pipe secured with a locked union joint at its junction with the safe, and leading directly from the safe, so that all spirits running from the safe into the pipe shall immediately be discharged into the receiver;
(ii) Must have fixed therein a proper discharge cock or other
applicance for drawing off the spirits.
(m) Every low wines receiver, feints receiver, low wines and feints charger and spirit receiver:
(i) Must be a closely-covered vessel; and
(ii) Except as already specified, must have no outlet.
(n) Unless the Collector by writing under his hand otherwise permits, every vat in which spirits are to be stored must be close-covered and secured with fastenings.
(o) The still and the furnace door thereof, and every cock, valve, or pipe conveying steam into or about the still must be provided with fastenings so that they can be securely locked.
There must be an air-valve on the still.
An enclosed and secure safe must be connected with the end of the worm.
(p) A discharge cock must be fixed to every still not more than 1 metre distant from the body of the still, and firmly attached to the still by a close metal pipe, and must be so placed as to be easily accessible to an officer.
(q) Every pipe must be so fixed and placed as to be capable of being examined for the whole of its length.
(r) The pipes must be painted and kept painted in oil colours as follows:
If for the conveyance of:
Wort or wash Red Low wines or feints Blue Spirits Black Water White.
(s) Every cock and pump must be fitted with fastenings for securing it by a lock being a lock supplied by the Collector at the expense of the distiller or a lock approved by the Collector and provided by the distiller.
(t) On the top of every charger and receiver, and of every vat for keeping spirits, there must be a dipping hole at which an officer can conveniently take his dip or gauge of the contents.
A metal plate must be fixed at the dipping hole to secure it from being worn or altered.
The dipping hole must have a cover and be fitted with a fastening to secure it by lock.
(u) The name of every fixed vessel must be painted thereon in oil colours and in conspicuous letters, and where more than one vessel is used for the same purpose, distinctive numbers in arithmetical progression commencing with 1, must also be painted thereon.

DISTILLATION REGULATIONS - REG 12
Production of spirits liable to duty

12. No distiller shall, except by authority, begin to use any material for the production of spirits liable to one rate of duty until all spirits produced liable to any other rate of duty have been conveyed into the spirit or feints receiver.

DISTILLATION REGULATIONS - REG 25
Conveyance of wash

25. All wash must be conveyed directly into the wash charger and thence into the still for distillation or directly from the back into the still.

DISTILLATION REGULATIONS - REG 26
Direction of flow

26. All low wines, feints, and spirits running from the worm of the still must run thence directly through the safe at the end of the worm.

DISTILLATION REGULATIONS - REG 27
Conveyance of low wines

27. All low wines shall be conveyed directly from the safe into the low wines receiver and thence directly into the low wines and feints charger and thence directly into the still for re-distillation.

DISTILLATION REGULATIONS - REG 28
Conveyance of spirits

28. All spirits must be conveyed directly from the safe into the feints receiver or spirit receiver.

DISTILLATION REGULATIONS - REG 29
Re-distillation of spirits

29. All spirits conveyed into the feints receiver must be conveyed thence into the low wines and feints charger or wash charger or intermediate still charger and thence into the still for re-distillation unless permission be granted by the Collector for the discharge of the feints direct from the feints receiver into the still.

DISTILLATION REGULATIONS - REG 30
Recording of quantity of spirits produced

30. Except by authority no access shall be had to the end of the worm of any still or to any low wines feints or spirits from the time of the extraction or distillation thereof in the still unless the distiller has recorded the quantity of spirits produced.

DISTILLATION REGULATIONS - REG 31
Recording of quantity of beer, wine or wash conveyed to still

31. (1) Where the Collector has directed a distiller to keep any records in respect of beer, wine or wash that is conveyed to a still, the distiller shall not convey any beer, wine or wash to a still:
(a) unless he has recorded those particulars; or
(b) unless the distiller, or any employee of the distiller, authorized by the distiller for the purpose, has signed his name opposite to or immediately under the entry of those particulars in the records of the distiller.

(2) An officer may direct a distiller not to convey beer, wine or wash to a still until the officer has assessed the quantity to be so conveyed.

<
(3) A distiller shall comply with a direction given to him by an officer under the last preceding subregulation.

DISTILLATION REGULATIONS - REG 38
Products to be kept separate

38. All wash and produce from wine or beer shall, throughout the whole course of its distillation and until the removal of the spirits to the spirit store, be kept unmixed and separate from all else.

DISTILLATION REGULATIONS - REG 39
Feints from previous distillation

39. All feints produced by and remaining from a previous distillation may be mixed with the low wines or feints produced by a subsequent distillation, and the process of re-distilling feints may be repeated as often as the distiller thinks fit, provided that the mixed feints must be the produce of the same kind of material.

Removal of low wines, feints or spirits from receiver

40. (1) A Collector may, by instrument under his hand, grant a distiller permission to remove low wines, feints or spirits from a receiver.

<
(2) The power conferred by the last preceding subregulation may be exercised by granting permission to remove low wines, feints or spirits from a receiver:
(a) at any time;
(b) on a specified occasion; or
(c) in circumstances included in a specified class of circumstances.

<
(3) Without limiting the generality of the last preceding subregulation, a permission may authorize the removal of low wines, feints or spirits only if the distiller complies with specified conditions or restrictions.

<
(4) A distiller shall not remove any low wines, feints or spirits from a receiver except in accordance with permission granted under this regulation that authorizes the removal.

DISTILLATION REGULATIONS - REG 44
Permit to re-distil spirits

44. (1) The Collector may, upon application in writing by a distiller, permit the distiller to re-distil spirits which are in his distillery.

DISTILLATION REGULATIONS - REG 45
Storage of distillery material

45. All material in a distillery which is capable of use for distillation or in connexion therewith, shall unless when being so used be kept in the material store.

DISTILLATION REGULATIONS - REG 47A
Interpretation of cask in regulations 48 to 77

47A. For the purposes of regulations 48 to 77 (inclusive) of these Regulations, "cask" includes drum and any other vessel approved by the Collector.

DISTILLATION REGULATIONS - REG 48
Spirit store

48. The spirit store is for the purpose of carrying on therein the flavouring, colouring, blending, and bottling of spirits, and the putting of spirits into casks. Spirits may also be stored in the spirit store during the process of maturing.

DISTILLATION REGULATIONS - REG 49
Construction of the spirit store

49. The spirit store must be:
(a) Constructed of stone, brick, concrete, or other approved fireproof material.
(b) Have all its windows secured with solid iron bars not less than 25 millimetres in diameter so fixed therein that the spacers between the bars and between the bars and the wall do not exceed 155 millimetres in width.
(c) Have all its windows covered with close wire netting.
(d) Have all its doors strongly constructed and sheeted on the inside with iron.

DISTILLATION REGULATIONS - REG 50
Spirits kept in spirit store

50. Only spirits in vats and in vessels approved by the Collector shall be kept in the spirit store. When vat is referred to the reference shall include any approved vessel.

DISTILLATION REGULATIONS - REG 51
Vats

51. Each vat must be:
(a) Of the capacity in the case of a general distillery of not less than 900 litres, and in the case of a wine distillery of not less than 350 litres:
Provided that the Collector may permit vessels of smaller capacity to be used for storing vat ullages until such time as the ullages may be conveniently removed to the spirit warehouse or blended with other spirit in the spirit store, but in no case for a longer period than the period (if any) specified by the Collector when granting permission.
(b) Unless otherwise permitted by the Collector, erected at least 1 metre from the ground or floor.
(c) So placed that the whole exterior surface can without inconvenience be thoroughly inspected.

DISTILLATION REGULATIONS - REG 52
Hours of opening spirit store

52. The spirit store shall be opened during such hours only as the Collector may direct.

DISTILLATION REGULATIONS - REG 53
Filling of casks

53. No empty cask shall be taken into the spirit store except for the purpose of being immediately filled with spirit from a vat, and when these casks are filled they must not remain in the spirit store more than twenty-four hours except by authority.

DISTILLATION REGULATIONS - REG 55
Distillery identification

55. The Collector shall advise each distiller of the letter allotted to his distillery, to be called the distillery letter, and the number representing the State in which the distillery is situated, to be called the State number.

DISTILLATION REGULATIONS - REG 56
Identification of casks

56. Every cask brought into the spirit store must be in sound condition and have legibly cut or branded or painted in oil colours the following particulars:
On the outside of one end of the cask the name of the distiller or of the distillery, the place where the distillery is situated, and the distillery letter placed directly above the State number, thus,

On the other end of the cask its consecutive number and its weight, and when filled with spirits, the number of litres it contains, and when rates of duty differ according to the material from which the spirits are made a letter denoting the material from which the spirits are made.
The Collector may, on the application of a purchaser of the spirits, permit the erasure from the casks of the name of the distiller or of the distillery, and of the place where the distillery is situated, and the substitution of the trade name and mark of the purchaser, provided that the distillery letter, State number, and the bond marks are preserved undefaced, and that the words "Made in Australia" are legibly cut, or branded or painted in oil colours on the casks.

DISTILLATION REGULATIONS - REG 61
Duty on blended spirits

61. If imported spirits are to be mixed with Australian spirits for exportation only, then no duty shall be charged on the imported spirits, but if imported flavouring spirits are to be mixed with spirits for home consumption, then, if the rate of duty on the imported spirits is greater than the rate of duty payable on the spirits distilled in Australia, the difference between such rates of duty shall be paid on the flavouring spirits before removal from the warehouse licensed under the Customs Act 1901-1968 to the spirit store of the distiller.

DISTILLATION REGULATIONS - REG 61A
Fortified Australian wine used as flavouring

61A. (1) The Collector may, on the application of a distiller, grant permission for the removal of fortified Australian wine from a place declared to be an approved place under section 5A of the Excise Act 1901-1968 to the distiller's spirit store for the purpose of flavouring whisky, brandy or rum.

(2) The distiller shall, at the time of the application, submit for the Collector's approval a sample of the wine intended to be used as flavouring.

(4) Fortified Australian wine removed under this regulation shall remain subject to the control of the Customs.

DISTILLATION REGULATIONS - REG 62
Deficiency of spirits

62. The dip of any vats containing spirits may at any time be taken by an officer, and if any deficiency of spirits has taken place which cannot be attributed to natural loss, the distiller shall pay duty on the quantity of spirits so found deficient.

DISTILLATION REGULATIONS - REG 63
Spirit blending

63. The spirits in the spirit store may be blended.

DISTILLATION REGULATIONS - REG 64
Clarification of cloudy spirits

64. The clarification of cloudy spirits may be allowed by the addition thereto of a solution of alum in the proportion of not more than 4 litres of such solution to every 1,000 litres of spirits, or by means of any other treatment approved by the Comptroller.

DISTILLATION REGULATIONS - REG 65
Reduction of spirits

65. A distiller may, by adding water thereto, reduce any spirits in the vat in the spirit store.

DISTILLATION REGULATIONS - REG 66
Notice to bottle spirits

66. A distiller shall not, except with the approval of the Collector, bottle spirits in his distillery unless he has given not less than twenty-four hours' notice of his intention so to do.

DISTILLATION REGULATIONS - REG 67
Packaging of spirits

67. Where spirits that have been bottled in a distillery are not removed from the distillery immediately after they have been bottled, the distiller shall cause the bottles of spirits to be packed into outer containers each of which contains only bottles of a like capacity.

DISTILLATION REGULATIONS - REG 68
Labelling of spirits

68. (1) A distiller shall label every bottle of spirits with the words "Produce of Australia", "Made in Australia" or other words approved by the Collector indicating that the spirits have been distilled in Australia and with:
(a) the name of the place where the spirits were bottled and the name of:
(i) the distiller who bottled the spirits; or
(ii) the distillery where they were bottled; or
(b) the distillery letter and State number of the distillery where the spirits were bottled.

(2) A distiller shall paint or brand on each case in which spirits have been packed:
(a) the name of the place where the spirits were bottled and the name of:
(i) the distiller who bottled the spirits; or
(ii) the distillery where they were bottled; or
(b) the distillery letter and State number of the distillery where the spirits were bottled.

DISTILLATION REGULATIONS - REG 69
Fixing labels

69. A distiller shall not cause or permit a label to be affixed to a bottle of spirits unless a label of a like kind has been furnished to the Collector.

DISTILLATION REGULATIONS - REG 70
Calculation of quantity of spirits

70. The quantity of spirits in any cask or bottle may be calculated by weight, measure, or gauge, as the Collector may direct.

DISTILLATION REGULATIONS - REG 73
Filled casks and other vessels

73. All casks and other vessels when filled with spirits, shall be conveyed to the spirit warehouse of the distiller unless they are to be removed from the distillery forthwith.

DISTILLATION REGULATIONS - REG 74
Re-vatting stored spirits

74. A distiller may, by authority, re-vat in his spirit store, any spirits stored in his spirit warehouse.

DISTILLATION REGULATIONS - REG 75
Gauging of vats

75. Vats may be gauged by an officer whenever he deems it necessary.

79. A cask shall not be taken into the spirit warehouse unless it is marked as required by regulation 56.

DISTILLATION REGULATIONS - REG 80
Casks to remain unaltered

80. None of the particulars on a cask shall be altered in any way whilst in the spirit warehouse, except by permission of the Collector under regulation 56.

DISTILLATION REGULATIONS - REG 81
Arrangement of casks

81. Casks must be arranged, stacked, or stowed so that an officer may pass easily between every tier.

DISTILLATION REGULATIONS - REG 82
Leakage of spirits

82. Where spirits leak from a cask in a distillery, the distiller shall, as soon as possible after the discovery of the leakage:
(a) cause the cask to be repaired so as to prevent further leakage;
(b) ascertain the quantity of spirits that has leaked from the cask; and
(c) inform the Collector of the occurrence of the leakage and of the quantity of spirits lost.

DISTILLATION REGULATIONS - REG 87
Additives not permitted

87. Nothing shall be added to spirits in the spirit warehouse.

DISTILLATION REGULATIONS - REG 90
Duty paid on spirits

90. All spirits in the spirit warehouse upon which the duty has been paid must be removed forthwith from the distillery.

DISTILLATION REGULATIONS - REG 93
Methylated spirits

93. Spirits may be methylated and entered for home consumption in a distillery as in the case of spirits warehoused under the Customs Act 1901-1925.

DISTILLATION REGULATIONS - REG 94
Application for vigneron's licence

94. The application for a vigneron's licence shall be in accordance with Form 1, and shall comply with all the requirements indicated therein.

DISTILLATION REGULATIONS - REG 95
Fee for vigneron's licence application

95. (1) A vigneron's licence shall be in accordance with Form 13.

(2) The annual fee for a vigneron's licence is Ten dollars.

DISTILLATION REGULATIONS - REG 96
Security - application for vigneron's licence

96. (1) The security required to be given by section 18 of the Act in respect of an application for a vigneron's licence shall be in accordance with Form 14.

(2) The amount of the security referred to in subregulation (1) shall be such amount, being not less than One thousand dollars and not more than Ten thousand dollars, as the Collector determines.

DISTILLATION REGULATIONS - REG 97
Granting or renewal of vigneron's licence

97. A vigneron's licence shall only be granted or renewed in respect of:
(a) a pot still capable of containing more than 1,100 litres but less than 2,750 litres; or
(b) a continuous still capable of exhausting more than 200 litres but less than 700 litres of wine in an hour.

DISTILLATION REGULATIONS - REG 98
Construction of vigneron's spirit store

98. Before a vigneron's licence shall be granted or renewed there must be erected upon the premises a spirit store which must:
(a) Be a building of stone, brick, concrete, or other approved material.
(b) Have its windows secured with iron bars, and covered with close wire netting.
(c) Have its door strongly constructed, sheeted on the inside with iron, and provided by the vigneron with an approved lock, the key of which shall be kept by him.

DISTILLATION REGULATIONS - REG 99
Approval of construction

99. The building, the securing of the windows, and of the door must be to the satisfaction of the Collector.

DISTILLATION REGULATIONS - REG 100
Capacity of receivers

100. A feints receiver of not less than 150 litres capacity and a spirit receiver of not less than 270 litres capacity must be kept in the spirit store.

DISTILLATION REGULATIONS - REG 101
Connection of receivers

101. The still, the feints receiver, and the spirit receiver must be connected in such manner and be provided with such cocks, pipes, and fittings, as the Collector may direct.

DISTILLATION REGULATIONS - REG 102
Maintenance of equipment

102. Every vigneron shall keep his still and the receivers and fittings connected therewith in good repair and in a clean condition.

DISTILLATION REGULATIONS - REG 103
Notice of distilling time

103. Every vigneron shall give to the Collector at least three days' notice of the day and hour when he intends to commence distilling.

DISTILLATION REGULATIONS - REG 106
Sampling

106. Any officer may take samples of the wine or lees of wine about to be distilled, and may by distillation ascertain the percentage of spirit contained in the wine or lees of wine.

DISTILLATION REGULATIONS - REG 107
Deficiencies to be accounted for

107. If the quantity of spirits produced is less than the quantity of spirits which should have been produced, the vigneron shall pay duty on the deficiency, unless such deficiency is explained to the satisfaction of the Collector, and no distilling operations or mixing of spirits with wine shall be allowed until the duty demanded on any deficiency has been paid, or until such deficiency is accounted for to the satisfaction of the Collector.

DISTILLATION REGULATIONS - REG 108
Approved storage vats or vessels

108. All spirits distilled under a vigneron's licence shall be kept in the spirit store in vats or vessels approved by the Collector, and so placed as to be easily examined, and no spirits shall be kept elsewhere on the premises specified in the licence.

DISTILLATION REGULATIONS - REG 114
Sale or removal from spirit store

114. Any vigneron may, by permission, sell any surplus spirits, or remove the same to a place declared to be an approved place under section 5A of the Excise Act 1901-1968.

DISTILLATION REGULATIONS - REG 115
Portable still

115. Two or more vignerons having each a vigneron's licence may, by permission, use a portable still, to be removed from time to time to the licensed premises where its use is required, or a still situated on the premises of one of them.

DISTILLATION REGULATIONS - REG 116
Application for experimenter's licence

116. An application for an experimenter's licence shall be in accordance with Form 1.

DISTILLATION REGULATIONS - REG 117
Security-application for experimenter's licence

117. The security required to be given by section 18 of the Act in respect of an application for an experimenter's licence shall be in accordance with the following scale, namely, not less than $10 and not more than $1000 as the Collector determines.

119. The number of experimenters' licences that may be in force at any one time is 50.

DISTILLATION REGULATIONS - REG 127
Dealing with samples

127. (1) A sample taken or obtained by an officer under the provisions of section 63 or section 71 of the Distillation Act 1901-1925 shall be dealt with in the following manner:
(a) The officer taking or obtaining the sample shall, in the presence of the person or the agent or servant of the person from whom the sample is taken or obtained, divide the sample into three equal parts and label or mark and securely seal each part; and
(b) the officer shall hand one part to the owner or his agent or servant, deliver for report another part to an analyst approved by the Collector, and retain the third part for further examination, if necessary.

<
(2) Delivery of the part to the analyst may be effected personally or by sending the part by registered post addressed to the analyst at his usual address, or in such other manner as the Collector approves.

<
(3) In the event of any dispute as to the identity of the part received by the analyst the burden of proof shall lie upon the person complaining.

<
(4) The production of a certificate of analysis of the part purporting to be signed by the analyst shall be sufficient evidence of the identity of the part and of the result of the analysis, without proof of the signature of the person purporting to have signed the certificate.

DISTILLATION REGULATIONS - REG 128
Declarations

128. (1) Forms containing declarations may be signed by a duly authorized agent in cases where the principal is legally incapable of making a declaration.

<
(2) Any officer may require from any agent the production of his written authority from the principal for whom he claims to act, and in default of the production of such authority may refuse to recognize the agency.

<
(3) Any declaration made by an agent in pursuance of this Regulation shall be held to have been made with the knowledge and consent of the principal, so that in any prosecution in respect of any declaration made by any such agent the principal shall be liable to the pecuniary punishment provided by the Act or these Regulations, as if such declaration had been made by the principal.

<
(4) An authority under this Regulation may be according to Form 21.

DISTILLATION REGULATIONS - REG 129
Forms and tables

129. The forms and tables prescribed by or referred to in these Regulations are those in the accompanying Schedule.

DISTILLATION REGULATIONS - REG 130
Working days and hours

130. (1) Subject to regulation 131 of these Regulations, all work at Distilleries and Vigneron's premises shall be performed only on the prescribed working days and during the prescribed working hours.

<
(2) Subject to subregulation (3) of this regulation:
(a) the working days shall be all days except Sundays and public holidays; and
(b) the working hours shall be from 8 a.m. to 5 p.m. on each day from Monday to Friday, and 8 a.m. to 12 noon on Saturdays.

<
(3) The Collector may approve that the working days shall be Monday to Friday (but not including any public holiday) and that the working hours shall be such hours worked from Monday to Friday in equal daily periods, as the Collector specifies:
Provided that the working hours shall not commence before 7 a.m. on any day.

<
(4) For the purpose of this regulation "public holiday" means, in relation to a Distillery or Vigneron's premises, a day observed in the place at which the Distillery or Vigneron's premises are situated as a holiday under section 76 of the Public Service Act 1922-1960.

DISTILLATION REGULATIONS - REG 131
Variation of days and hours

131. The Collector may permit work to be performed on a prescribed working day outside the prescribed working hours or otherwise than on a prescribed working day for such time and, subject to regulation 133 of these Regulations, upon such conditions as he thinks fit.

DISTILLATION REGULATIONS - REG 133
Payment for services of officers

133. (1) Where the Collector permits work to be performed otherwise than on a prescribed working day or during the prescribed working hours (except where shift work is performed by direction of the Collector and such work does not involve the payment of overtime) a charge at the rate of $16.75 per hour or part thereof shall be made against the distiller or vigneron for the services of each officer required to be in attendance.

<
(2) The charge shall be calculated from the hour from which the attendance of the officer is necessary and, when the service is not continuous with prescribed working hours, shall include a charge in respect of the time reasonably occupied by the officer in proceeding to and from the place where the attendance is required.


Repeal
The Distillation Regulations 1913 (Statutory Rules 1913, No. 343, as amended by Statutory Rules 1920, Nos. 41, 184, 214; 1921, No. 38; 1925, Nos. 9, 27, 111, 145) are repealed.
