Short title.

1. This Act may be cited as the Honey Levy Act ( No. 1) 1962-1973.*

Commencement.

SECT

2. This Act shall come into operation on the day on which it receives the Royal Assent.*

Collection Act to be read as one with this Act.

3. The Honey Levy Collection Act 1962 shall be read as one with this Act.

Definitions.

3A. In this Act-

''month'' means a month of the year;

''the Board'' means the Australian Honey Board established by the Honey Industry Act 1962.

Imposition of levy.

4. (1) Subject to the next succeeding sub-section, a levy is imposed on honey that is sold on or after a date to be fixed by the Minister by notice in the Gazette, being honey-

(a) produced in Australia on or after that date; or

(b) produced in Australia before that date and remaining in the ownership of the producer immediately before that date.

(2) Levy is not imposed under the last preceding sub-section by reason of a sale of honey if-

(a) levy has been imposed by this Act on the honey by reason of a previous sale of the honey;

(b) the honey is, under the contract of sale-

(i) to be delivered to a place outside Australia; or

(ii) to be placed on board a ship or aircraft for export from Australia;

(c) the vendor is the producer of the honey and the purchaser is a listed honey dealer; or

(d) the purchaser gives to the vendor a certificate in accordance with the prescribed form of the purchaser's intention to export the honey, and neither the vendor nor any other person has, with respect to a previous sale of the honey, given a certificate for the purposes of this paragraph.

Rate of levy.

5. (1) Subject to the next succeeding sub-section, the rate of the levy imposed by this Act is Nine-tenths of a cent per kilogram of honey.

(2) The regulations may, from time to time, prescribe a rate, not exceeding Two and two-tenths cents per kilogram, in lieu of the rate specified in the last preceding sub-section.

(3) Before making or repealing regulations prescribing a rate of the levy imposed by this Act, the Governor-General shall take into consideration any recommendation with respect to the rate made to the Minister by the Board.

Levy payable by vendor.

6. Where, by reason of a sale of honey, levy is imposed on the honey by this Act, the levy is payable by the vendor.

Exemptions.

6A. (1) Levy imposed by this Act is not payable in respect of honey sold by a person in a month if the honey sold by the person in that month, together with the honey, if any, used by the person in that month in the production of other goods, weighs not more than fifty kilograms.

(2) Levy is not payable by a person included in a prescribed class of persons.

(3) Before making regulations prescribing a class of persons for the purposes of the last preceding sub-section, the Governor-General shall take into consideration any recommendation with respect to the proposed regulations made to the Minister by the Board.

Regulations.

SECT

7. The Governor-General may make regulations, not inconsistent with this Act, prescribing all matters required or permitted by this Act to be prescribed or necessary or convenient to be prescribed for carrying out or giving effect to this Act.
