Short title.

CANNED FRUITS EXPORT CHARGES ACT 1926-1966

An Act to impose Charges upon the Export of Canned Fruits.
Short title amended; No. 32, 1918, s. 2.
1. This Act may be cited as the Canned Fruits Export Charges Act 1926-1966.*

CANNED FRUITS EXPORT CHARGES ACT 1926-1966 - SECT. 2.
Interpretation.

2. (1) In this Act, ''canned fruits'' means fruits or fruit juices preserved by sterilization and enclosed (with or without syrup, water or other liquid) in an air-tight container, not being goods known as ''fruit pulp'', ''solid pack'' or ''pie pack''.

(2) A reference in the Schedule to this Act to the weight of the pack shall, in relation to any canned fruits, be read as a reference to the weight of the contents of the container in which the canned fruits are enclosed.

Application.

2A. This Act applies to canned fruits being-

(a) canned apricots;

(b) canned peaches;

(c) canned pears;

(d) canned pineapples;

(e) such other canned fruits as are prescribed;

(f) canned mixed fruits having a fruit content not less than fifty-five per centum of which consists of one or more of the fruits referred to in the preceding paragraphs of this section;

(g) canned pineapple juice; or

(h) such other canned fruit juices as are prescribed.

Charge on export of canned fruits.

Sub-section (1) amended by No. 95, 1952, s. 4; and No. 90, 1963, s. 4.
3. (1) A charge is imposed and shall be levied and paid on all canned fruits to which this Act applies and which are exported from the Commonwealth.
Substituted by No. 73, 1966, s. 4.

(2) The rate of the charge in respect of any canned fruits is the rate set out in the Schedule to this Act that applies to the canned fruits or such lower prescribed rate, if any, as applies to the canned fruits.

(3) All moneys payable under this section in respect of any canned fruits shall be paid within thirty days after the expiration of the month of the year in which the canned fruits are exported to such officers in the respective States of the Commonwealth as are prescribed.

Exemption from charges.

Sub-section (1) amended by No. 20, 1938, s. 2; and No. 90, 1963, s. 5.
3A. (1) The Governor-General may, from time to time, by order published in the Gazette, after report to the Minister by the Australian Canned Fruits Board constituted under the Canned Fruits Export Marketing Act 1963, exempt any canned fruits from the charges imposed by this Act.

(2) Any exemption under this section may be unconditional, or may be in respect of such period (if any), and subject to such conditions, as are specified in the order of exemption.

(3) The Governor-General may, by order published in the Gazette, cancel any exemption made under this section of any canned fruits from the charges imposed by this Act, and thereupon those charges shall, from the date fixed by the order, become payable in respect of those canned fruits.

Regulations.

4. The Governor-General may make regulations, not inconsistent with this Act, prescribing all matters which are by this Act required or permitted to be prescribed, or which are necessary or convenient to be prescribed, for carrying out or giving effect to this Act, and, in particular, after report to the Minister by the Australian Canned Fruits Board constituted under the Canned Fruits Export Marketing Act 1963, for prescribing lower rates of the charge imposed on any kind of canned fruits exported from the Commonwealth.

Duration of Act.

SECT

5. This Act shall continue in force until a date to be fixed by Proclamation as the date upon which the Act shall expire.
