A Bill for an Act to amend the Administrative Appeals Tribunal Act 1975, and for related purposes

The Parliament of Australia enacts:

1 Short title

        This Act may be cited as the Administrative Appeals Tribunal Amendment (Review of Decisions) Act 2004.

2 Commencement

        This Act commences on the day on which it receives the Royal Assent.

3 Schedule(s)

        The Administrative Appeals Tribunal Act 1975 is amended as set out in Schedule 1.

Schedule 1--Amendment of the Administrative Appeals Tribunal Act 1975

1 Subsection 27(1)

Repeal the subsection, substitute:

       (1) Where this Act or any other enactment (other than the Australian Security Intelligence Organisation Act 1979) provides that an application may be made to the Tribunal for a review of a decision, the application may be made:

       (a) by or on behalf of any person or persons (including the Commonwealth or an authority of the Commonwealth) whose interests are affected by the decision; or

       (b) by a member of Parliament.

2 After subsection 27(1)

Insert:

       (1A) For the purposes of paragraph (1)(b):

member of Parliament means a member of:

       (a) the Parliament of the Commonwealth: or

       (b) the Parliament of a State; or

       (c) the Legislative Assembly of the Northern Territory; or

       (d) the Legislative Assembly for the Australian Capital Territory.
