A Bill for an Act to amend the Customs Act 1901 to prohibit the importation of radioactive substances for storage in Australia
The Parliament of Australia enacts:
This Act may be cited as the
Customs Amendment (Anti-Radioactive Waste Storage Dump) Act 1999.
This Act commences on the day on which it receives the Royal Assent.
Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.
1 At the end of section 50
Add:
(5) The regulations may not provide for the importation of any radioactive substance under any circumstances, or subject to any condition, restriction, licence or permission, if the primary purpose for importing the substance is to store it at a nuclear waste disposal facility in Australia.
(6) Subsection (5) does not apply to a radioactive substance that originated from a nuclear activity undertaken in Australia.
(7) In subsection (5):
radioactive substance means any radioactive material or substance, including radium, any radioactive isotope or any article containing any radioactive material or substance.
