SYDNEY AIRPORT DEMAND MANAGEMENT AMENDMENT BILL 2001

OUTLINE

The purpose of the Bill is to give effect to the Government's decision to refine its demand management strategy to address the growth in air traffic at Kingsford Smith Airport (KSA). The provisions contained in the Bill will promote more effective slot management at KSA by ensuring that the regime under Part IIIA of the Trade Practices Act 1974 which allows access to declared services will not be used to override the Slot Management Scheme. The Bill also brings the slot management arrangement at KSA in line with the arrangements under the Airports Act 1996 for core regulated airports.

In conjunction with the amendment of the Sydney Airport Demand Management Act 1997 (the Act), the Slot Management Scheme will be amended to cap regional slots allocated in peak periods at current levels and introduce an aircraft seat limit for allocating new slots and give higher priority to larger aircraft.

NOTES ON CLAUSES

Clause 1: Short Title

1. The Bill, when enacted, will be known as the Sydney Airport Demand Management Amendment Act 2001.

Clause 2: Commencement

2. The Bill will commence on the day it receives Royal Assent.

Clause 3: Schedule

3. The Schedule sets out the amendments to the Sydney Airport Demand Management Act 1997.

SCHEDULE 1 - SYDNEY AIRPORT DEMAND MANAGEMENT ACT 1997

Item 1 - New Section 5A

This item will add a new section 5A to provide that Part IIIA of the Trade Practices Act 1974 has effect subject to the provisions of this Bill.

Item 2 - New Subsection 35(1A)

This item will add a new subsection that will provide that the Slot Management Scheme established under the Act may deal with the allocation of slots for specified categories of aircraft movements, effectively allowing the Slot Manager to allocate and administer slots for specified categories of aircraft movements, for example for movements of aircraft of specified sizes and for specified air service types.
