A Bill for an Act to allow State and Territory laws to operate concurrently with the Trade Practices Act 1974

The Parliament of Australia enacts:

1 Short title This Act may be cited as the Trade Practices Amendment (Operation of State and Territory Laws) Act 2001.

2 Commencement This Act commences on the 28th day after the day on which it receives the Royal Assent.

3 Schedule(s) Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1--Amendment of the Trade Practices Act 1974 1 At the end of Part IVA

Add:

51ACAA Concurrent operation of State and Territory laws It is the Parliament's intention that a law of a State or Territory should be able to operate concurrently with this Part unless the law is directly inconsistent with this Part.

2 At the end of Part IVB

Add:

51AEA Concurrent operation of State and Territory laws It is the Parliament's intention that a law of a State or Territory should be able to operate concurrently with this Part unless the law is directly inconsistent with this Part.

3 Application of items 1 and 2

The amendments made by items 1 and 2 apply in relation to a law of a State or Territory made before, on or after the commencement of those items.
