Education Services for Overseas Students (Assurance Fund Contributions) Act 2000

An Act to impose the requirement to pay annual contributions and special levies to the ESOS Assurance Fund, and for related purposes

The Parliament of Australia enacts:
This Act may be cited as the Education Services for Overseas Students (Assurance Fund Contributions) Act 2000.
(1) Subject to subsection (2), this Act commences on a day to be fixed by Proclamation.
(2) If this Act does not commence under subsection (1) within the period of 6 months beginning on the day on which it receives the Royal Assent, it commences on the first day after the end of that period.
An expression used in this Act that is also used in the Education Services for Overseas Students Act 2000 has the same meaning as in that Act.
The requirement to pay annual Fund contributions under the Education Services for Overseas Students Act 2000 is imposed by this section.
The requirement to pay special levies under the Education Services for Overseas Students Act 2000 is imposed by this section.
(1) The amount of annual Fund contribution payable by a provider under the Education Services for Overseas Students Act 2000 is as determined by the Fund Manager for that provider under Division 4 of Part 5 of that Act.
(2) The amount of special levy payable by a registered provider under the Education Services for Overseas Students Act 2000 is as determined by the Fund Manager for that provider under section 73 of that Act.
(1) If, apart from this section, this Act would purport to operate in a way that would be invalid because of section 114 of the Constitution, this Act does not have that operation.
(2) For the purposes of this section, assume that, in section 114 of the Constitution, State includes the Australian Capital Territory and the Northern Territory.
