REGULATIONS UNDER THE AUSTRALIAN MEAT AND LIVE-STOCK CORPORATION ACT 1977*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Australian Meat and Live-stock Corporation Act 1977.

MEAT AND LIVE-STOCK EXPORTERS AND ABATTOIR OPERATORS CONSULTATIVE GROUP REGULATIONS

Citation

1. These Regulations may be cited as the Meat and Live-stock Exporters and Abattoir Operators Consultative Group Regulations.

Interpretation

2. In these Regulations, unless the contrary intention appears—

“ Chairman ” means the Chairman of the Group;

“ Group ” means the Meat and Live-stock Exporters and Abattoir Operators Consultative Group established by section 41 of the Act;

“ member ” means a member of the Group;

“ the Act ” means the Australian Meat and Live-stock Corporation Act 1977.

Powers

3. The Group shall have power to do anything, not inconsistent with the Act or these Regulations, necessary or convenient for the purpose of exercising any power or performing any duty or function conferred or imposed on it by the Act or by these Regulations.

Members

4. (1) For the purposes of sub-section 43 (2) of the Act, the prescribed number of members shall be 9.

(2) The members shall be appointed by the Minister in accordance with this regulation.

(3) For the purposes of sub-regulation (2)—

(a) 5 members shall have been nominated by the Australian Meat Exporters’ Federal Council;

(b) one member shall have been nominated by the Australian Meatworks’ Federal Council;

(c) one member shall have been nominated by the Council of Australian Public Abattoir Authorities;

(d) one member shall have been nominated by the Meat and Allied Trades’ Federation of Australia; and

(e) one member shall be appointed for the purpose of representing Australian exporters of cattle and of sheep.

(4) Nominations for the purposes of these Regulations shall be made in writing to the Minister.

(5) A person appointed to be a member holds office until he ceases to be a member.

(6) A person appointed to be a member shall cease to be a member—

(a) on resigning his office by notice in writing given to the Minister;

(b) on being appointed to be a member of the Corporation; or

(c) on termination of the appointment of the member by the Minister.

(7) The Minister shall terminate the appointment of a member referred to in paragraph 4 (3) (a), (b), (c) or (d) if the organization which nominated the member for appointment requests the Minister, in writing, to terminate that appointment.

(8) The Minister shall, as soon as practicable after the appointment of a person to be a member or the termination of the appointment of a member, cause notice of that fact to be given in the Gazette.

Chairman

5. (1) Subject to sub-regulation (2), the Group may, from time to time, elect a member to be Chairman of the Group.


 

(2) Where a member is the Chairman of the Australian Meat Exporters’ Federal Council that member shall be Chairman of the Group.

(3) Subject to sub-regulation (2), the Chairman shall hold office until—

(a) he resigns by notice in writing given to a meeting of the Group;

(b) another member is elected to be the Chairman of the Group; or

(c) he ceases to be a member.

Meetings

6. (1) The Group shall hold such meetings as are necessary for the performance of its functions.

(2) The Chairman may, a any time, convene a meeting of the Group.

(3) The Chairman shall convene a meeting of the Group at such time and place as the Group decides or, where more than one member of the Group, one of whom shall have been appointed on the nomination of one of the organizations referred to in paragraphs 4 (3) (a), (b), (c) and (d) and another of whom shall have been appointed on the nomination of another one of those organizations, requests the Chairman in writing that a meeting of the Group be convened at another time, at such time before the expiration of 14 days after receipt of the request, and at such place, as the Chairman directs.

(4) At a meeting of the Group—

(a) 6 members form a quorum;

(b) all questions shall be decided by a majority of votes of the members present and voting;

(c) subject to sub-regulation (8), each member has a deliberative vote; and

(d) the member presiding has, in the event of an equality of votes on any matter, a casting vote.

(5) The Chairman shall preside at all meetings of the Group at which he is present.

(6) If the Chairman is absent from a meeting of the Group or if the office of Chairman is vacant, the members of the Group present and voting may elect one of their number to preside at the meeting and the member so elected shall preside accordingly.

(7) During a vacancy in the office of Chairman or during the absence of the Chairman, the functions of the Chairman under this regulation may be performed by a member elected by the Group to perform those functions during that vacancy or absence or, where a member has not been so elected, by a member directed by the Minister to perform those functions.

(8) A member who will be absent—

(a) from a meeting of the Group; or

(b) during the voting of the Group in respect of matters at a meeting of the Group,

may nominate another member to vote on his behalf in respect of—

(c) where the first-mentioned member will be absent from a meeting—all matters to be voted upon during that meeting; and

(d) where the first-mentioned member will be absent during the voting in respect of matters at a meeting—those matters,

and, in respect of the matters referred to in paragraph (c) or (d), as the case requires, the second-mentioned member shall, during the absence of the first-mentioned member from that meeting, have a deliberative vote on behalf of the first-mentioned member in addition to his own deliberative vote in respect of those matters.

(9) A nomination for the purposes of sub-regulation (8)—

(a) shall be made by giving notice in writing to the Chairman; and

(b) may relate to more than one meeting.

(10) The Group may invite a person to attend a meeting of the Group for the purpose of advising or informing the Group on any matter.

(11) The exercise of a power or the performance of a function by the Group is not invalidated by reason only of there being a vacancy in the membership of the Group.

(12) Subject to this regulation, the procedure to be followed at a meeting of the Group shall be determined by the Group.
