Statute Law Revision Act 1973

AN ACT

For the purposes of Statute Law Revision.

[Assented to 19 December 1973]

BE IT ENACTED by the Queen, the Senate and the House of Representatives of Australia, as follows:—

Short title.

1.  This Act may be cited as the Statute Law Revision Act 1973.

Commencement.

2.  This Act shall come into operation on 31 December 1973.

Amendment of Acts.

3.  The Acts specified in column 1 of Schedule 1 are amended as respectively specified in column 2 of that Schedule.

Citation of amended Acts.

4.  An Act specified in column 1 of Schedule 2, as amended by this Act, may be cited in the manner specified in column 2 of that Schedule opposite to the reference to that Act in column 1.

Repeal of Acts.

5.  The Acts specified in Schedule 3 are repealed.


Repeal of Tax Acts.

6. (1)  Subject to this section, the Acts specified in Schedule 4 are repealed.

(2)   The repeal of an Act by this section does not operate so as to repeal an Act incorporated with the repealed Act.

(3)   An Act incorporated with an Act repealed by this section applies in relation to the tax that was imposed by the repealed Act as if the repealed Act were still in force.

Repeal of certain Acts that amend other Acts.

7. (1)  The Acts specified in Schedule 5 are repealed.

(2)   The repeal of an Act by this section does not affect the operation of—

(a) any amendment of another Act made by the repealed Act; or

(b) any provision for the citation of that other Act as amended by the repealed Act.

Amendment of Statute Law Revision Act 1950–1966.

8. (1)  Section 5 of the Statute Law Revision Act 1950–1966 is repealed.

(2)   The Third Schedule to the Statute Law Revision Act 1950–1966 is repealed.

(3)   An act or thing that, by an Act specified in Part III of the Third Schedule to the Statute Law Revision Act 1950–1966, was made, or was to be deemed to be, lawful, valid or effectual shall, to the extent to which it was so made, or was so to be deemed to be, lawful, valid or effectual, continue to be, or to be deemed to be, lawful, valid or effectual.

(4)   Section 6 of the Statute Law Revision Act 1950–1966 is repealed but an Act incorporated with an Act repealed by that section applies in relation to the tax that was imposed by the repealed Act as if the repealed Act were still in force.

(5)   The Fourth Schedule to the Statute Law Revision Act 1950–1966 is repealed.

(6)   The Statute Law Revision Act 1950–1966, as amended by this section, may be cited as the Statute Law Revision Act 1950–1973.

Saving.

9. (1)  An act or thing that, by an Act or portion of an Act repealed or omitted by this Act, was made, or was to be deemed to be, lawful, valid or effectual shall, to the extent to which it was so made, or was so to be deemed to be, lawful, valid or effectual, continue to be, or to be deemed to be, lawful, valid or effectual.

(2)   Notwithstanding the amendments of the Royal Australian Air Force Veterans Residences Act 1953–1965 effected by this Act the person referred to in sub-section 5(5) of the Royal Australian Air Force


Veterans Residences Act 1953–1965 who held office as a member of the Royal Australian Air Force Veterans’ Residences Trust immediately before the commencement of this Act shall continue to hold that office subject to the Royal Australian Air Force Veterans’ Residences Act 1953–1973 as if he had been appointed under section 5 of the last-mentioned Act.

Operation of Acts Interpretation Act.

10.      Nothing in this Act limits the application of section 8 of the Acts Interpretation Act 1901–1973.

Effect of repeals.

11.      Where this Act provides that an Act is repealed and portion of the second-mentioned Act has previously been repealed, the repeal effected by this Act is of so much of the second-mentioned Act as has not previously been repealed.

(b) any other country declared by the regulations to be a Commonwealth country,

and includes—

(c) a colony, overseas territory or protectorate of a country that is a Commonwealth country by virtue of paragraph (a) or (b); and

(d) a territory for the international relations of which a country that is a Commonwealth country by virtue of paragraph (a) or (b) is responsible;”.
