REGULATIONS UNDER THE HIGH COMMISSIONER (UNITED KINGDOM) ACT 1909-1966.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the High Commissioner (United Kingdom) Act 1909-1966.

Amendments of the High Commissioner (Staff) Regulations†

Parts.

1.  Regulation 3 of the High Commissioner (Staff) Regulations is amended—

(a) by omitting the word and figures “Regulations 24-27” and inserting in their stead the word and figures “Regulations 24-27a”; and

(b) by omitting the word and figures “Regulations 77-82” and inserting in their stead the word and figures “Regulations 77-81”.

Interpretation.

2   Regulation 4 of the High Commissioner (Staff) Regulations is amended by inserting in sub-regulation (1.), after the definition of “officer”, the following definition:—

“‘salary’, in relation to an officer or employee who is in receipt of the London weighting allowance, includes that allowance;”.

Salaries of officers.

3.  Regulation 24 of the High Commissioner (Staff) Regulations is amended by adding at the end thereof the following sub-regulation:—

“(6.) Where an officer performs the duties of a temporary position, he shall be paid salary at such rate, or in accordance with such scale of rates, as is determined by the High Commissioner for that position, but he shall not suffer any reduction in his salary.”.

4.  After regulation 27 of the High Commissioner (Staff) Regulations the following regulation is inserted in Division 1 of Part III.:—

London weighting allowance.

27a. An officer or employee shall, in respect of any period during which his normal place of duty is within a radius of three miles of Charing Cross in London, be paid an allowance, to be called the London weighting allowance, at the rate of One hundred and twenty-five pounds per annum.”.

5.  Regulation 33 of the High Commissioner (Staff) Regulations is repealed and the following regulation inserted in its stead:—

Proficiency allowance.

“33.—(1.) Where an officer or an employee who is occupying or performing the duties of an office, or a temporary position, of Steno-Secretary to the High

“(2.) “(3.) Where an officer or an employee who is occupying or performing the duties of an office, or a temporary position, of Transcription Typist satifies the Official Secretary of her ability to type at one of the rates specified in column 1 of the table in this sub-regulation (in this sub-regulation referred to as ‘the qualifying rate’) matter played back from a tape recording, the Official Secretary may, by instrument in writing, direct that the officer or employee shall, from and including a date specified in the instrument, be paid an allowance at the rate specified in column 2 of that table opposite to the qualifying rate in column 1.

“(4.) A date specified in an instrument under this regulation as the date from and including which an allowance is to be paid may be a date earlier than the date of the instrument.”.


6.—(1.) Regulation 34 of the High Commissioner (Staff) Regulations is repealed and the following regulation inserted in its stead:—

Shift duty payment.

“34.—(1.) Where an officer or an employee occupying or performing the duties of an office, or a temporary position, of machine operator is rostered to perform duty on shift, the officer or employee shall be paid an allowance of—

(a) an amount of Seven shillings and six pence in respect of each night shift completed; and

(b) an amount of Five shillings in respect of each other shift completed.

“(2). In this regulation, ‘night shift’ means a shift that comprises or includes a period of four and one-half hours commencing after 8 o’clock in the evening and ending before 6 o’clock in the following morning,”.

(2.) This regulation shall be deemed to have come into operation on the twelfth day of June, 1967.

Travelling allowance.

7.    Regulation 35 of the High Commissioner (Staff) Regulations is amended by omitting paragraph (a) and paragraph (b) of sub-regulation (1.) and inserting in their stead the following paragraphs:—

“(a) where the annual salary, or the maximum annual salary, of the office or temporary position the duties of which the officer or employee is performing is not less than the maximum annual salary specified in column 2 of the Fourth Schedule opposite to the office of Clerk 8 in column 1—Five pounds ten shillings per day; or

(b) in any other case—Four pounds five shillings per day.”.

Return of officers over 60 years of age.

8.    Regulation 82 of the High Commissioner (Staff) Regulations is repealed.

Fourth Schedule.

9.    The Fourth Schedule to the High Commissioner (Staff) Regulations is repealed and the Schedule set out in the Schedule to these Regulations inserted in its stead.

Payment of corresponding rate in new scale.

10.    Where, at the commencement of this regulation, a scale of rates of annual salary is specified in column 2 of the Fourth Schedule to the High Commissioner (Staff) Regulations opposite to an office in column 1—

(a) the Official Secretary may, in relation to each officer or employee occupying or performing the duties of that office on the commencement of this regulation, direct that the rate in that scale that, in the opinion of the Official Secretary, corresponds to the rate of salary that was applicable to the officer or employee immediately before the commencement of this regulation shall be the rate applicable to him on the commencement of this regulation; and

(b) for the purpose of calculating the dates when the officer or employee becomes entitled to increments in accordance with that scale, the officer or employee shall be deemed to have been in receipt of the rate specified in the direction from the date from which the corresponding rate became payable to him.

London weighting allowance in respect of period on or after 1 November. 1967.

11.   An officer or employee shall, in respect of any period that commenced on or after the first day of November, 1967, and ended before the commencement of this regulation during which his normal place of duty was within a radius of three miles of Charing Cross in London, be paid an allowance in accordance with the table in this regulation.

Salary of Photoprinter on and after 1 July. 1966.

12.   Where, during any period that commenced on or after the first day of July, 1966, and ended before the commencement of this regulation, an officer or an employee occupied or performed the duties of an office of Photoprinter, the officer or employee shall, by force of this regulation, be paid salary and allowances under the High Commissioner (Staff) Regulations in respect of that period as if each of the amounts specified in column 3 of the table in this sub-regulation had been substituted in the second column of the Fourth Schedule to those Regulations opposite to that office in the first column of that Schedule, for the amount specified in column 1 or column 2, as the case may be, of that table opposite to that first-mentioned amount.

Certain persons to be deemed to be proficient.

13.   Where, at the commencement of this regulation, the Official Secretary is satisfied that an officer or employee has, before the commencement of this regulation, shown herself to possess an ability required for the payment of a proficiency allowance under regulation 33 of the High Commissioner (Staff) Regulations as in force at the commencement of this regulation, the Official Secretary may direct that the officer or employee shall be deemed, for the purposes of that regulation, to have satisfied the Official Secretary that she possesses that ability.


Proficiency allowances in respect of the period before the commencement of this regulation.

14.—(1.) Where the Official Secretary is satisfied that, during any period that commenced on or after the first day of January, 1965, and ended before the first day of January, 1966—

(a) an officer or an employee was occupying or performing the duties of an office, or a temporary position, of Steno-Secretary to the High Commissioner, Steno-Secretary to the Deputy High Commissioner, Stenographer Grade 1, Stenographer Grade 2, Stenographer Grade 3, Supervisor, Typist, Transcription Typist or Clerical Assistant (Typing);

(b) the officer or employee had the ability to type at the rate of forty words per minute; and

(c) a proficiency allowance under the High Commissioner (Staff) Regulations in respect of the ability of the officer or employee to type was not payable to the officer or employee,

the Official Secretary may, by instrument in writing, direct that the officer or employee shall, in respect of that period, be paid an allowance at the rate of Thirty pounds per annum.

(2.) Where the Official Secretary is satisfied that, during any period that commenced on or after the first day of January, 1966, and ended before the commencement of this regulation—

(a) an officer or an employee was occupying or performing the duties of an office, or a temporary position, of Steno-Secretary to the High Commissioner, Steno-Secretary to the Deputy High Commissioner, Stenographer Grade 1, Stenographer Grade 2, Stenographer Grade 3, Supervisor, Typist, Transcription Typist or Clerical Assistant (Typing);

(b) the officer or employee had the ability to type at one of the rates specified in column 1 of the table in this sub-regulation (in this sub-regulation referred to as “the qualifying rate”); and

(c) a proficiency allowance under the High Commissioner (Staff) Regulations in respect of the ability of the officer or employee to type was not payable, or was payable at a rate less than the rate (in this sub-regulation referred to as “the maximum rate”) specified in column 2 of the table in this sub-regulation opposite to the qualifying rate in column 1,

the Official Secretary may, by instrument in writing, direct that the officer or employee shall, in respect of that period, be paid an allowance at the maximum rate less the rate (if any) of the proficiency allowance referred to in paragraph (c) of this sub-regulation.

(3.) Where the Official Secretary is satisfied that, during any period that commenced on or after the first day of January, 1966, and ended before the commencement of this regulation—

(a) an officer or an employee was occupying or performing the duties of an office, or a temporary position, of Steno-Secretary to the High Commissioner, Steno-Secretary to the Deputy High Commissioner, Stenographer Grade 1, Stenographer Grade 2, Stenographer Grade 3 or Supervisor;


(b) the officer or employee had the ability to write shorthand at one of the rates specified in column 1 of the table in this sub-regulation (in this sub-regulation referred to as “the qualifying rate”); and

(c) a proficiency allowance under the High Commissioner (Staff) Regulations in respect of the ability of the officer or employee to write shorthand was not payable or was payable at a rate less than the rate (in this sub-regulation referred to as “the maximum rate”) specified in column 2 of the table in this sub-regulation opposite to the qualifying rate in column 1,

the Official Secretary may, by instrument in writing, direct that the officer or employee shall, in respect of that period, be paid an allowance at the maximum rate less the rate (if any) of the proficiency allowance referred to in paragraph (c) of this sub-regulation.

(4.) For the purposes of the last preceding sub-regulation, an allowance at the rate of Ten pounds per annum payable to a person in respect of a period under regulation 4 of Statutory Rules 1967, No. 79 shall be deemed to be a proficiency allowance under the High Commissioner (Staff) Regulations in respect of the ability of the person to write shorthand payable during that period.

(5.) Where the Official Secretary is satisfied that, during any period that commenced on or after the first day of January, 1966, and ended before the commencement of this regulation—

(a) an officer or an employee was occupying or performing the duties of an office, or a temporary position, of Typist or Transcription Typist;

(b) the officer or employee was, at all times when on duty, engaged full-time in typing matter played back from a tape recording;

(c) the officer or employee had the ability to type such matter at one of the rates specified in column 1 of the table in this sub-regulation (in this sub-regulation referred to as “the qualifying rate”); and

(d) a proficiency allowance under the High Commissioner (Staff) Regulations in respect of the ability of the officer or employee to type such matter was not payable or was payable at a rate less than the rate (in this sub-regulation referred to as “the maximum rate”) specified in column 2 of the table in this sub-regulation opposite to the qualifying rate in column 1,

the Official Secretary may, by instrument in writing, direct that the officer or employee shall, in respect of that period, be paid an allowance at the maximum rate less the rate (if any) of the proficiency allowance referred to in paragraph (d) of this sub-regulation.

(6.) For the purposes of the last preceding sub-regulation, an allowance at the rate of Forty-four pounds per annum payable to a person in respect of a period under regulation 4 of Statutory Rules 1967, No. 79 shall be deemed to be a proficiency allowance under the High Commissioner (Staff) Regulations in respect of the ability of the person to type matter played back from a tape recording payable during that period.

(7.) A reference in this regulation to an amount of money shall be read as a reference to that amount in sterling.

(8.) In this regulation, “employee”, “officer” and “the Official Secretary” have the same respective meanings as they have in the High Commissioner (Staff) Regulations.
