DEFENCE FORCES RETIREMENT

BENEFITS.

 

No. 19 of 1955.

An Act to amend the Defence Forces Retirement Benefits Act 1948–1954.

[Assented to 10th June, 1955.]

BE it enacted by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia, as follows:—

Short title and citation.

1.—(1.)  This Act may be cited as the Defence Forces Retirement Benefits Act 1955.

(2.)  The Defence Forces Retirement Benefits Act 1948–1954 is in this Act referred to as the Principal Act.

(3.)  The Principal Act, as amended by this Act. may be cited as the Defence Forces Retirement Benefits Act 1948–1955.

Commencement.

2.—(1.)  Subject to this section, this Act shall come into operation on the day on which it receives the Royal Assent.

(2.)  Sections thirteen and fifteen of this Act shall be deemed to have come into operation on the fourteenth day of October, One thousand nine hundred and fifty-three.

(3.)  Sections six, eight, nine, ten, twelve, fourteen, eighteen, nineteen, twenty, twenty-one and twenty-three of this Act shall be deemed to have come into operation on the ninth day of December, One thousand nine hundred and fifty-four.

Interpretation.

3.    Section four of the Principal Act is amended

(a) by omitting from sub-section (1.) the definition of “service for pension” and inserting in its stead the following definition:—

“ ‘service for pension’ means full-time continuous service as a member after attaining the age of twenty years other than—

(a) in the case of a member other than an officer—service not served under engagement for a definite term; or


 

(b) subject to sub-section (3.) of this section, service in respect of which a member is not permitted or required to contribute to the Fund;”;

(b) by inserting in sub-section (1.), after the definition of “Service Regulations “,the following definition:—

“ ‘the appointed date’ means the date of commencement of this Act;”; and

(c) by omitting sub-section (2.) and inserting in its stead the following sub-sections:—

“(2.) For the purposes of this Act, a period during which a member is—

(a) absent with leave, either with or without pay;

(b) absent without leave;

(c) awaiting or undergoing trial on a charge in respect of an offence; or

(d) undergoing field punishment, detention or imprisonment,

shall be deemed to be a period of service.

“(3.) In section forty, section forty-two, sub-sections (5.) and (6.) of section forty-eight, paragraph (c) of sub-section (3.) of section fifty-two, section seventy-two and section seventy-two a of this Act, ‘service for pension’ includes service in respect of which, by virtue of section thirty-six of this Act, a member is not permitted or required to contribute to the Fund.

“(4.) In determining the service for pension of a member for the purposes of a provision of this Act (other than section forty, section forty-two, sub-sections (5.) and (6.) of section forty-eight and paragraph (c) of sub-section (3.) of section fifty-two of this Act), service of the member immediately before a period in respect of which the member was not permitted or required to contribute to the Fund by virtue of section thirty-six of this Act and service of the member immediately after that period shall be deemed to be continuous.

“(5.) In this Act, a reference to a Schedule shall be read as a reference to a Schedule to this Act.”.

General Account and Pensions Account.

4.    Section seventeen of the Principal Act is amended by inserting in sub-section (3.), after the word “Act”, the words “, and payments by pensioners under sub-section (1b.) of section sixty-nine of this Act,”.


 

Commencement and cessation of contributions.

5.    Section twenty-three of the Principal Act is amended by omitting from sub-section (1.) the words “(in this Act referred to as ‘the appointed date’)”.

6.—(1.)  Sections twenty-eight and twenty-nine of the Principal Act are repealed and the following sections inserted in their stead:—

Scale of units.

“28.—(1.)    Contributions by a member shall be in respect of units.

“(2.)     Subject to this Act, the number of units in respect of which a member shall contribute shall be the number set out in column four of the First Schedule opposite to the description set out in column one, two or three of that Schedule which is applicable to the member.

“(3.)    For the purposes of the First Schedule, a member who is entitled to pay at the rate applicable, under the Service Regulations, to a member who has completed a period of service in the rank of that member shall be deemed to have completed that period of service in that rank.

Change in contributions.

“29.—(1.)  If, by reason of a change in rank or for any other reason, the number of units in respect of which, under the last preceding section, a member is required to contribute becomes greater or less than the number of units for which he is contributing, he shall, subject to the next succeeding sub-section, contribute in respect of the greater or lesser number of units as from the date on which that last-mentioned number of units became applicable in relation to him or, if that date is not a pay-day, as from the pay-day next following that date.

“(2.)  The number of units in respect of which a member is contributing under the last preceding section shall not be reduced by reason only of a promotion of the member.”.

(2.)  Contributions by a member in accordance with the Principal Act as amended by this section shall be made—

(a) in the case of a member of the Permanent Air Force—as from the date of commencement of this section; and

(b) in the case of a member of the Permanent Naval Forces or the Permanent Military Forces—as from the day next following that date.

7.    Section thirty-six of the Principal Act is repealed and the following section inserted in its stead:—

Absences without leave for more than twenty-one days.

“36.   A member is not permitted, and shall not be required, to contribute to the Fund in respect of any continuous period of more than twenty-one days during which, after the commencement of this section, he is absent without leave.”.


 

Pension on retirement after twenty years’ service for pension—officers.

8.    Section thirty-eight of the Principal Act is amended by omitting sub-section (2.) and inserting in its stead the following sub-section:—

“(2.)    Subject to section fifty of this Act, the pension payable to an officer under this section is—

(a) in the case of an officer who retired before the tenth day of December, One thousand nine hundred and fifty-four—a pension at the rate set out in column five of Part I. of the First Schedule opposite to the description set out in column one, two or three of that Part which was applicable to the officer at the date of his retirement; and

(b) in any other case—a pension at the rate set out in column six of Part I. of the First Schedule opposite to the description set out in column one, two or three of that Part which is applicable to the officer at the date of his retirement.”.

Pension on retirement after fifteen years’ service for pension—officers.

9.    Section thirty-nine of the Principal Act is amended by omitting sub-sections (2.) and (3.) and inserting in their stead the following sub-sections:—

“(2.)    Subject to section fifty of this Act, the pension payable to an officer under this section is the pension which, if, at the date of his retirement, he had completed twenty years’ service for pension, would have been payable to him under the last preceding section less a deduction in respect of each year or part of a year by which his service for pension is less than twenty years.

“(3.)    The deduction under the last preceding sub-section shall be—

(a) in the case of an officer who retired before the tenth day of December, One thousand nine hundred and fifty-four—in accordance with Part I. of the Third Schedule; and

(b) in any other case—in accordance with Part II. of the Third Schedule.”.

Pension where officer not contributing for full number of units.

10.  Section thirty-nine a of the Principal Act is repealed.

Benefits after less than fifteen years’ service for pension—officers.

11.  Section forty of the Principal Act is amended by omitting from paragraph (a) the words “if he has, at the date of retirement, completed ten years’ service for pension but has not completed fifteen years’ service for pension” and inserting in their stead the words “if he is not entitled to pension under either of the last two preceding sections but. at the date of his retirement, has completed ten years’ service for pension”.


 

Pensions after twenty years—other ranks.

12.  Section forty-one of the Principal Act is amended by omitting sub-sections (2.) and (2a.) and inserting in their stead the following sub-section:—

“(2.)     Subject to section fifty of this Act, the pension payable to a member under this section is—

(a) in the case of a member who retired before the tenth day of December, One thousand nine hundred and fifty-four—a pension at the rate set out in column five of Part II. of the First Schedule opposite to the description set out in column one, two or three of that Part which was applicable to the member at the date of his retirement; and

(b) in any other case—a pension at the rate set out in column six of Part II. of the First Schedule opposite to the description set out in column one, two or three of that Part which is applicable to the member at the date of his retirement,

and, in the case of a member who has completed more than twenty years’ service for pension before attaining the retiring age for the rank held by him, additional pension, if any, in accordance with the Fourth Schedule for each completed year of service for pension in excess of twenty years.”.

Gratuity where not pensionable—other ranks.

13.  Section forty-two of the Principal Act is amended by omitting sub-section (4.) and inserting in its stead the following sub-section:—

“(4.)     For the purposes of this section, ‘service for pension’—

(a) includes service after the thirtieth day of June, One thousand nine hundred and forty-seven, before attaining the age of twenty years under the engagement or successive and continuous engagements referred to in sub-section (1.) of this section, but does not include any period of such service under an initial engagement of less than six years; and

(b) in the case of a member who, immediately before the commencement of this Act, was an employee within the meaning of section sixty a of the Superannuation Act 1922–1947 and a contributor under that Act—includes service before attaining the age of twenty years and after attaining the age of eighteen years under the engagement or successive and continuous engagements referred to in sub-section (1.) of this section, but does not include any period of such service under an initial engagement of less than five years.”.

Retirement before reaching retiring age—officers.

14.  Section forty-eight of the Principal Act is amended—

(a) by omitting sub-section (2.) and inserting in its stead the following sub-sections:—

“(2.)   Subject to section fifty of this Act and to sub-sections (3.) and (4.) of this section, if, at the date of retirement of the officer, he has completed twenty years’


 

service for pension, he is entitled on retirement to the pension to which, if he had attained the retiring age for the rank held by him, he would have been entitled under section thirty-eight of this Act less a deduction in respect of each year or part of a year by which his age is less than the retiring age for the rank held by him.

“(2a.) The deduction under the last preceding sub-section shall be—

(a) in the case of an officer who retires or retired before the sixteenth day of March, One thousand nine hundred and fifty-five—in accordance with Part I. of the Third Schedule; and

(b) in any other case—in accordance with Part II. of the Third Schedule.”;

(b) by omitting paragraph (a) of sub-section (3.) and inserting in its stead the following paragraph:—

“(a) if the date of retirement is within two years of the date of his attaining the retiring age for the rank held by him—he is entitled on retirement to the pension to which he would have been entitled under section thirty-eight of this Act if, at the date of his retirement, he had attained the retiring age for the rank held by him; or”;

(c) by omitting sub-sections (4.) and (4a.) and inserting in their stead the following sub-section:—

“(4.) Pension payable to an officer under sub-section (2.) of this section or the last preceding sub-section shall not be reduced by deductions to a pension less than that to which he would have been entitled if, at the date of his retirement, he had been an officer of the next lower rank and had retired at the same age.”; and

(d) by omitting from sub-section (5.) the words” If, at the date of his retirement the officer has not completed twenty years’ service for pension, but has completed twelve years’ service for pension,” and inserting in their stead the words “If the officer is not entitled to pension under the preceding provisions of this section but, at the date of his retirement, he has completed twelve years’ service for pension,”.

Pension payable on incapacity.

15.  Section fifty-two of the Principal Act is amended—

(a) by omitting from paragraph (c) of sub-section (3.) the words “if he is a member who has not completed twenty years’ service for pension” and inserting in their stead the words “if he is not entitled to pension under this sub-section”; and


 

(b) by adding, at the end thereof the following sub-section:—

“(5.)   In paragraph (c) of sub-section (3.) of this section, ‘service for pension’ includes any service before attaining the age of twenty years and after attaining the age of eighteen years under the engagement, or under an engagement included in successive and continuous engagements, under which the member had served up to the date of his retirement, but does not include—

(a) in the case of a member who, immediately before the commencement of this Act, was an employee within the meaning of section sixty A of the Superannuation Act 1922–1947 and a contributor under that Act—any period of such service under an initial engagement of less than five years; and

(b) in any other case—any period, of such service under an initial engagement of less than six years.”.

Re-employment of pensioners.

16.  Section sixty-nine of the Principal Act is amended—

(a) by omitting sub-section (1.) and inserting in its stead the following sub-section:—

“(1.)   Subject to the next succeeding sub-section, where—

(a) a pensioner is in receipt of a pension at a rate which exceeds Three hundred and. sixty-four pounds per annum or, being a pensioner who has commuted portion of his pension under section seventy-four of this Act, would be in receipt of a pension at such a rate but for the commutation; and

(b) the pensioner is employed by the Commonwealth or by a prescribed authority of the Commonwealth,

the pension payable to the pensioner during any period in respect of which he is paid salary or wages in respect of that employment is, in lieu of the pension which, but for this sub-section, would have been payable under this Act, a pension at the rate of—

(c) three hundred and sixty-four pounds per annum; or

(d) one-half of the rate of pension which, but for this section, would have been payable under this Act, or, in the case of a. pensioner who has commuted portion of his pension, one-half


 

of the rate of pension which,, but for this sub-section, would, have been, payable if he had. not commuted portion of his pension,

whichever is the greater, less, in the case of a pensioner who has commuted portion of his pension, the portion of the pension so commuted.”; and

(b) by inserting after sub-section (1a.) the following sub-section:—

“(1b.) A pensioner who has commuted a portion of his pension under section seventy-four of this Act shall pay to the Fund in respect of any period during which a part of his pension is cancelled under the last preceding sub-section an amount equal to the amount which, if he had not commuted that portion of the pension, would have been payable by the Commonwealth, to the Fund during that period in respect: of that portion of the pension.”.

17.  After section seventy-two of the Principal Act the following section is” inserted:—

Reductions of gratuity by reason of non-effective service.

“72a.—(1.)    In this section—

‘period, of engagement’,. in; relation, to a. member, means, the period of. service for pension of the member less, in the case of a. member other than an officer who retires before completing, the engagement under, which he was serving immediately before his retirement,, the period, for which he served under that engagement;

‘period of non-effective service’, in relation to a member, means any continuous period of more than twenty-one days included in the period of engagement of the member during which the member was—

(a) on leave of absence without pay;

(b) absent without leave;

(c) awaiting or undergoing trial on a charge in respect of an offence of which he was later convicted; or

(d) undergoing field punishment; detention or imprisonment.

“(2.)    Where in this Act provision is made for the payment to a member of a gratuity and the gratuity is calculated by reference to an amount for each completed year of service for pension by the member, the amount of any gratuity so calculated in respect of a member shall be reduced by an amount equal to the amount which bears to the amount of the gratuity so calculated the same proportion as the period of non-effective service of the member bears to his period of engagement.”.

Commutation of pension.

18.  Section seventy-four of the Principal Act is amended by omitting from sub-section (1.) the words “the Defence Forces Retirement Benefits Act 1952 and the Defence-Forces Retirement Benefits Act 1954” and inserting in their stead the words “or any subsequent Act,”.


 

Transfers from Superannuation Act 1922–1947 to this act

19.—(1.)   Section seventy-seven of the Principal Act is amended—

(a) by omitting from sub-section (2.) the words “if those contributions are in respect of the number of units appropriate under this Act to his pay group” and inserting in their stead the words “if the contributions of such a member are in respect of the number of units applicable to him”;

(b) by omitting sub-sections (4.), (4a.) and (4b.) and inserting in their stead the following sub-section:—

“(4.) When, by reason of a change in rank or for any other reason, the number of units applicable to a serving member to whom this section applies becomes greater, the member shall, as from the date on which the increased number of units become applicable to him or, if that date is not a pay-day, as from the pay-day next following that date, pay additional contributions in respect of a number of units equal to the difference between the number of units applicable to him immediately before the increase and the number of units applicable to him immediately after the increase.”; and

(c) by adding at the end thereof the following sub-section:—

“(8.)   A reference in this section to the number of units applicable to a member shall be read as a reference to the number of units in respect of which, but for this section, the member would be required to contribute under Division 2 of Part IV.”.

(2.)  In the case of a member who, immediately before the commencement of this section, was a member to whom section seventy-seven of the Principal Act applied—

(a) the amendments effected by the last preceding sub-section shall not be construed as permitting the member, after the commencement of this section, to contribute in respect of a lesser number of units than the number of units in respect of which he was contributing immediately before the commencement of this section; and

(b) if, immediately before the commencement of this section, the number of units appropriate under the Principal Act to the pay group of the member was less than the number of units in respect of which, but for section seventy-seven of the Principal Act as amended by this section, the member would, immediately after the commencement of this section, have been required to contribute under Division 2 of Part IV. of the Principal Act as amended by this Act, the member shall pay additional contributions in respect of a number of units equal to the difference—

(i) in the case of a member of the Permanent Air Force—as from the date of commencement of this section; and


 

(ii) in the case of a member of the Permanent Military Forces—as from the day next following that date.

Elections by members entitled to deferred pay.

20.  Section seventy-eight of the Principal Act is amended—

(a) by omitting from paragraph (b) of sub-section (4.) the words “the units appropriate to his pay group as set out in the First Schedule” and inserting in their stead the words “the number of units in respect of which, but for this sub-section, he would be required to contribute under Division 2 of Part IV.”; and

(b) by omitting from paragraph (b) of sub-section (5.) the words “the units appropriate to his pay group as set out in the First Schedule” and inserting in their stead the words “the number of units in respect of which, but for this sub-section, he would be required to contribute under Division 2 of Part IV.”.

Air Force officers contributing under Superannuation Act.

21.—(1.)    Section seventy-nine of the Principal Act is amended by omitting paragraph (d) and inserting in its stead the following paragraph:—

(d) where, by reason of a change in rank or for any other reason, the number of units in respect of which, if he were a contributor for full benefits, a serving member referred to in the last preceding paragraph would be required to contribute under Division 2 of Part IV. becomes greater, the member shall pay additional contributions as prescribed.”.

(2.)  In the case of a member who, immediately before the commencement of this section, was a member referred to in paragraph (c) of section seventy-nine of the Principal Act—

(a) the amendment effected by the last preceding sub-section shall not be construed as permitting the member, after the commencement of this section, to contribute in respect of a lesser number of units than the number of units in respect of which he was contributing immediately before the commencement of this section; and

(b) if, immediately before the commencement of this section, the number of units appropriate under the Principal Act to the pay group of the member was less than the number of units in respect of which, but for section seventy-nine of the Principal Act as amended by this section, the member would, immediately after the commencement of this section, have been required to contribute under Division 2 of Part IV. of the Principal Act as amended by this Act, the member shall pay additional contributions in respect of a number of units equal to the difference as from the date of commencement of this section.


 

22.  After section eighty of the Principal Act the following section is inserted:—

Revocation of election not to contribute under this Act.

“80a.—(1.)    A member who elected under the last preceding section not to become a contributor under this Act may, by notice in writing given to the Board within four months after the commencement of this section, revoke that election and elect to become a contributor under this Act—

(a) as from the date of commencement of this Act; or

(b) if, on the date of the notice to the Board, the member has completed six years’ service under an initial engagement of not less than six years under which he was serving at the commencement of this Act and does not wish to become a contributor as from the commencement of this Act—as from the date immediately following the date on which he completed six years’ service under that engagement.

“(2.)     An election made by a member by virtue of this section is of no effect unless and until the medical fitness of the member has been established to the satisfaction of the Board and the Board has notified the member accordingly.

“(3.)       A member who makes an election by virtue of this section shall pay to the Fund an amount equal to the amount of contributions which, if he had been a contributor on and from the date as from which he elects to become a contributor, he would have been required to make under this Act, but, subject to section twenty-six of this Act, he is not permitted, and shall not be required, to contribute to the Fund in respect of any period before that date.

“(4.)    A pension or benefit under this Act is not payable in relation to a member who has made an election by virtue of this section unless and until all amounts payable by the member under this Act to the Fund have been paid.

“(5.)    Where—

(a) a member has made an election by virtue of this section to become a contributor under this Act as from the date immediately following the date on which he completed six years’ service under an initial engagement; and

(b) on the retirement of the member he is entitled under this Act to a refund of his contributions and a gratuity only,

the gratuity to which he is so entitled shall be increased by an amount equal to the amount, if any, by which the gratuity that he would have received otherwise than under this Act if he had not made the election exceeds the sum of the gratuity to which, but for this sub-section, he would be entitled under this Act and the gratuity paid to him otherwise than under this Act.”.

Schedules.

23.  The First, Second, Third, Fourth and Fifth Schedules to the Principal Act are repealed and the following Schedules inserted in their stead:—
