An Act to revise the Statute Law of the Commonwealth.

[Assented to 16th December, 1950.]

BE it enacted by the King’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia, as follows :—

Short title.

1.   This Act may be cited as the Statute Law Revision Act 1950.

Commencement.

2.   This Act shall come into operation on the thirty-first day of December, One thousand nine hundred and fifty.

Amendment of Acts.

3.   The Acts specified in the first column of the First Schedule to this Act are amended as respectively specified in the second column of that Schedule.

Citation of amended Acts.

4.   Each Act specified in the first column of the Second Schedule to this Act, as amended by this Act, may be cited in the manner specified in the second column of that Schedule opposite the reference to that Act in the first column.

Repeal of Acts.

5.   The Acts specified in the Third Schedule to this Act are repealed.

Repeal of Tax Acts.

6.—(1.)     Subject to this section, the Acts specified in the Fourth Schedule to this Act are repealed.

(2.)    The repeal of an Act by this section does not operate so as to repeal an Act incorporated with the repealed Act.

(3.)    An Act incorporated with an Act repealed by this section applies in relation to the tax which was imposed by the repealed Act as if the repealed Act were still in force.


 

Amendment of Customs Tariff.

7.—(1.)     Section three of the Customs Tariff 1933–1949, as amended by the Customs Tariff 1950, by the Customs Tariff (No. 2) 1950 and by the Customs Tariff (No. 3) 1950, is amended by omitting the definitions of “tariff alteration” and “the Tariff”.

(2.)    Sections seven, thirteen, fourteen, fifteen and sixteen of the Customs Tariff 1933–1949, as amended by the Customs Tariff 1950, by the Customs Tariff (No. 2) 1950 and by the Customs Tariff (No. 3) 1950, are repealed.

(3.)    The Customs Tariff 1933–1949, as amended by the Customs Tariff 1950, by the Customs Tariff (No. 2) 1950 and by the Customs Tariff (No. 3) 1950, is amended by omitting from the items, or portions of items, in the Schedule to that Act as so amended which are specified in the first column of the Fifth Schedule to this Act the words respectively set out in the second column of the Fifth Schedule to this Act opposite to those items or portions of items.

(4.)    Section one of the Customs Tariff (No. 3) 1950 is amended by omitting sub-section (4.).

(5.)    The Customs Tariff 1933–1949, as amended by the Customs Tariff 1950, by the Customs Tariff (No. 2) 1950, by the Customs Tariff (No. 3) 1950 and by this section, may be cited as the Customs Tariff 1933–1950.

Amendment of Statute Law Revision Act 1934.

8.—(1.)     Section two of the Statute Law Revision Act 1934 is amended by omitting sub-sections (1.) and (2.).

(2.)    The Second and Third Schedules to the Statute Law Revision Act 1934 are repealed.

(3.)    An act or thing which, by an Act specified in Part III. of the Second Schedule to the Statute Law Revision Act 1934, was made or deemed lawful, valid or effectual, shall, to the extent to which it was so made or deemed lawful, valid or effectual, continue to be or to be deemed lawful, valid or effectual.

(4.)    Section three of the Statute Law Revision Act 1934 is repealed.

(5.)    The Fifth Schedule to the Statute Law Revision Act 1934 is repealed.

(6.)    Where the income tax imposed on income by an Act specified in the Fifth Schedule to the Statute Law Revision Act 1934 has not been paid, the rate of tax imposed by the Act so specified shall continue to apply to that income as if this section had not been enacted.

(7.)    Sections five, six, seven and eight of the Statute Law Revision Act 1934 are repealed.

(8.)    The Statute Law Revision Act 1934, as amended by this Act, may be cited as the Statute Law Revision Act 1934–1950.

9.—(1.)     The Patents Act 1906 is repealed.

(2.)    After section seventeen of the Patents Act 1903–1946 the following section is inserted in Part II.:—

Power to remedy lapse arising from errors in Patent Office.

“18.—(1.) Where owing to an error or omission on the part of an officer of the Patent Office, an application for a patent or a proceeding in relation thereto has lapsed, or an act or step in relation thereto


 

required to be done or taken within a certain time has not been so done or taken, the Commissioner may—

(a) revive the application or proceeding;

(b) extend the time for doing the act or taking the step; and

(c) permit the act to be done or the step to be taken.

“(2.)  The time prescribed for doing an act or taking a step may be extended under this section although the time has expired.

“(3.)  The powers of the Commissioner under this section may be exercised only on an application made to him by an applicant or party within one month after the applicant or party has or might with reasonable diligence have become aware of the error or omission.

“(4.)  A notification of each application under this section shall be published in The Australian Official Journal of Patents, Trade Marls and Designs and any person may, as prescribed, enter opposition against the granting of the application.

“(5.)  An appeal shall lie to the Law Officer from a decision of the Commissioner under this section.

“(6.)  Where an application for a patent has been revived and a patent has been granted on the application, then, if any proceeding is taken in respect of an infringement of the patent, no damages shall be awarded in respect of any such infringement occurring prior to a notification of the revival of the application published in The Australian Official Journal of Patents, Trade Marks and Designs.

“(7.)  An application shall not be revived under this section if the Commissioner, or on appeal from him the Law Officer, is satisfied that the invention is already patented in Australia, or that another application for the same invention has been lodged and will be unfairly prejudiced.”.

(3.)     Sections one hundred and thirteen to one hundred and sixteen (inclusive) of the Patents Act 1903–1946 are repealed.

(4.)     The Patents Act 1903–1946, as amended by this section, may be cited as the Patents Act 1903–1950.

Repeal of Treaties of Peace Acts.

10.—(1.)   The Treaties of Peace (Austria and Bulgaria) Act 1920 and the Treaty of Peace (Hungary) Act 1921 are repealed.

(2.)     Notwithstanding the repeal effected by the last preceding sub-section of the Treaties of Peace (Austria and Bulgaria) Act 1920 and the repeal effected by sub-section (7.) of section eight of this Act—

(a) the Public Trustee Enabling Regulations (being Statutory Rules 1921, No. 10) shall continue in force;

(b) the office of Public Trustee constituted under the Trading with the Enemy Act 1914–1921 shall continue in existence; and

(c) the appointment of a person to that office shall remain unaffected and he shall have the same powers, discretions, rights and duties as if those repeals had not been effected.


Repeal of Loan(Unemployment Relief Works) Acts 1932.

11.—(1.)   The Loan (Unemployment Relief Works) Act 1932 and the Loan (Unemployment Relief Works) Act (No. 2) 1932 are repealed.

(2.)  Any grant made to a State in pursuance of the Loan (Unemployment Relief Works) Acts 1932 shall continue to be subject to the condition that if any part of the amount granted has been or is advanced by the State by way of loan to any person, or to any authority or body of persons constituted or established by or under any law of the Commonwealth or of a State, for expenditure on approved works, any amount of the advance refunded to the State by that person, authority or body of persons shall be repaid by the State to the Commonwealth, together with such amount of interest on the amount advanced as is paid by the person, authority or body of persons to the State.

(3.)  Where any authority or body of persons constituted or established by or under any law of the Commonwealth or of any State specified in section four of the Loan (Unemployment Relief Works) Acts 1932 has borrowed money on terms approved by the Treasurer for the purposes of expenditure on any approved work in that State, the Commonwealth may pay to the State interest, at a rate not exceeding Two pounds per centum per annum, on the amount borrowed by the authority or body of persons.

(4.)  Any payment by the Commonwealth under the last preceding sub-section shall be conditional upon the State providing an equivalent amount of interest on the amount borrowed by the authority or body of persons.

(5.)  Any amount of interest paid by the Commonwealth or provided by the State under this section shall be applied in satisfaction or reduction of the liability of the authority or body of persons in respect of interest on the amount borrowed by it for expenditure on approved works.

(6.)  In this section, “approved works” has the same meaning as it had in the Loan (Unemployment Relief Works) Acts 1932.

Repeal of Financial Emergency and Financial Relief Acts.

12.—(1.)   The following Acts are repealed:—

(2.)    The repeal of an Act by the last preceding sub-section does not affect the operation of—

(a) any amendment made by the repealed Act to another Act; or

(b) any provision for the citation of that other Act as amended by the repealed Act.

(3.)    Section twelve of the Australian Soldiers Repatriation Act 1920–1950 is amended by omitting sub-section (3.).

(4.)    After section thirty-five of the Australian Soldiers Repatriation Act 1920–1950 the following section is inserted:—

Pensions to dependants.

“35a.—(1.)  A pension shall not be granted or continued under this Act to a person who is a dependant, within the meaning of this Part, of a member of the Forces, unless the dependant is, in the opinion of the Commission, without adequate means of support.

“(2.)  The last preceding sub-section shall not apply—

(a) to the widow or wife or a child or ex-nuptial child of a member of the Forces;

(b) to the unmarried mother of a deceased unmarried member of the Forces who was brought up by her;

(c) to the widowed mother of a deceased unmarried member of the Forces if she became a widow either prior to, or within three years after, the death of the member; or

(d) to the widowed mother of a deceased unmarried member of the Forces who was born out of wedlock and brought up by her if she became a widow either prior to, or within three years after, the death of the member.”.

(5.)    Section ninety-nine of the Australian Soldiers’ Repatriation Act 1920–1950 is amended by omitting from sub-section (2.) the words “,or in any Act affecting those Divisions or Schedules,” (wherever occurring).

(6.)    Section one hundred and four of the Australian Soldiers’ Repatriation Act 920–1950 is amended by omitting from sub-section (2.) the words “,or in any Act affecting those Divisions, sections or Schedules,” (wherever occurring).

(7.)    Section one hundred and nine of the Australian Soldiers’ Repatriation Act 1920–1950 is repealed.

(8.)    The Australian Soldiers’ Repatriation Act 1920–1950, as amended by sub-sections (3.), (4.), (5.), (6.) and (7.) of this section, may be cited as the Repatriation Act 1920–1950.


13.—(1.)   Section four of the Australian Imperial Force Canteens Funds Act 1920 is amended by omitting the words “by or”.

(2.)    Section five of the Australian Imperial Force Canteens Funds Act 1920 is repealed and the following section inserted in its stead:—

Trustees of the Fund.

“5.—(1.)   The Governor-General shall appoint the trustees and shall appoint one of them to be Chairman of the trustees.

“(2.)    The number of the trustees shall not exceed seven.

“(3.)    Each appointment of a trustee shall be notified in the Gazette.

“(4.)    Each trustee shall hold office during the pleasure of the Governor-General.

“(5.)    A trustee may resign his office, by writing addressed to the Minister.

“(6.)    A vacancy in the office of trustee shall occur when a trustee—

(a) resigns his office;

(b) except on leave granted by the Minister, is absent from three consecutive meetings of the trustees convened during a period of six months; or

(c) dies.

“(7.)    At any meeting of the trustees, three trustees shall form a quorum and may exercise any of the powers or functions of the trustees.

“(8.)    At any meeting of the trustees at which the Chairman is not present, the trustees present shall appoint one of their number to preside.”.

(3.)     The trustees of the Fund administered under the Australian Imperial Force Canteens Funds Act 1920 holding office at the commencement of this section, and the Chairman of those trustees, shall continue to hold office as trustees, and as Chairman of those trustees, respectively, as if they had been appointed under the Australian Imperial Force Canteens Funds Act 1920, as amended by this section.

(4.)     The Australian Imperial Force Canteens Funds Act 1920, as amended by this section, may be cited as the Australian Imperial Force Canteens Funds Act 1920–1950.

Repeal of War Gratuity Act1920.

14—(1.)    The War Gratuity Act 1920 and the War Gratuity Act (No. 2) 1920 are repealed.

(2.)     Notwithstanding the repeal of the Acts specified in the last preceding sub-section, any trust created under those Acts and existing at the date of the commencement of this Act shall continue in existence and may be varied or determined as if those Acts had not been repealed.

15.—(1.)   After section twelve of the Papua and New Guinea Act 1949 the following section is inserted in Part III.:—

Reference to Administrator, &c, of Papua and New Guinea.

“12a.  For the purposes of any other law of the Commonwealth (whether passed or made before or after the commencement of this section)—

(a) the Administrator of the Territory of Papua and New Guinea shall be deemed to be the Administrator of a Territory of the Commonwealth which does not form part of the Commonwealth;


 

(b) the Supreme Court of the Territory of Papua and New Guinea shall be deemed to be the Supreme Court of such a Territory; and

(c) the Public Service of the Territory of Papua and New Guinea shall be deemed to be the Public Service of such a Territory.”.

(2.)    The Papua and New Guinea Act 1949, as amended by this section, may be cited as the Papua and New Guinea Act 1949–1950.

Saving.

16.   An act or thing which, by an Act or portion of an Act repealed or omitted by this Act, was made or deemed lawful, valid or effectual, shall, to the extent to which it was so made or deemed lawful, valid or effectual, continue to be or to be deemed lawful, valid or effectual.

Operation of Acts Interpretation Act.

17.   Nothing in this Act limits the application of section eight of the Acts Interpretation Act 1901–1950.

Effect of repeals.

18.      Where this Act provides that an Act is repealed and portion of the second-mentioned Act has previously been repealed, the repeal effected by this Act is of so much of the second-mentioned Act as has not previously been repealed.
