An Act to make provision for the Grant of Financial Assistance to the States in connexion with Provision by the States of Milk for School Children, and for other purposes.

BE it enacted by the King’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia, as follows:—
Short title.
1. This Act may be cited as the States Grants (Milk for School Children) Act 1950.
Definitions.
2. In this Act, unless the contrary intention appears—
“school” includes a nursery school, kindergarten, crèche or aboriginal mission;
“the Australian Capital Territory” includes the Territory accepted by the Commonwealth in pursuance of the Jervis Bay Territory Acceptance Act 1915 and described in the agreement in the Schedule to that Act.
Financial assistance to States for supply of milk at schools.
3.—(1.) Subject to this Act, amounts determined in accordance with this section are payable to each State for the purposes of financial assistance.
(2.) The amounts payable to a State under this Act are—
(a) amounts equal to the amounts from time to time expended by the State in the purchase of milk supplied by the State to children attending schools in the State, where the supply is made—
(i) without charge;
(ii) in quantities not exceeding one half-pint for each child on each school day; and
(iii) in accordance with terms, conditions and limitations agreed on between the Commonwealth and the State; and
(b) to the extent, and subject to the conditions, agreed on between the Commonwealth and the State, amounts in respect of—
(i) expenditure of a capital nature by the State for the purposes of the supply of the milk; and
(ii) other incidental expenditure by the State for those purposes.
Power of Minister.
4. The Minister may determine—
(a) the manner in which a claim by a State for a payment under this Act shall be made: and
(b) the times at which such payments shall be made.
Provision of milk at schools in Territories.
5. The Minister may make arrangements for the supply by the Commonwealth to children attending schools in the Australian Capital Territory and the Northern Territory of Australia of milk in quantities not exceeding one half-pint for each child on each school day, and for the provision by the Commonwealth of equipment for the purposes of the supply of the milk.
Finance.
6.—(1.) Payments under or for the purposes of this Act, being payments for or in respect of the purchase of milk, shall be made out of the Trust Account established under the National Welfare Fund Act 1943–1950 and known as the National Welfare Fund.
(2.) All other payments under or for the purposes of this Act shall be made out of moneys from time to time appropriated by the Parliament for the purpose.
