REGULATIONS UNDER THE QUARANTINE ACT 1908-1947.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Quarantine Act 1908-1947.

Quarantine (Air Navigation) Regulations.

Citation.

1. These Regulations may be cited as the Quarantine (Air Navigation) Regulations 1948.

Commencement.

2. These Regulations shall come into operation on the first day of August, 1948.

Repeal.

3. The Quarantine (Air Navigation) Regulations (being Statutory Rules 1934, No. 91, as amended by Statutory Rules 1936, No. 82; 1937, No. 49; and 1947, No. 19) are repealed.

Liability under other Quarantine Regulations and proclamations not affected.

4. Nothing in these Regulations shall be deemed to affect the liability of any person to comply with any Regulations or proclamations made under the Quarantine Act 1908-1947, insofar as those Regulations or proclamations are applicable to that person.

Definitions.

5.—(1.) In these Regulations, unless the contrary intention appears—

“airport of entry” means an airport which has been declared a first port of entry for oversea vessels under section thirteen of the Act;

“aircraft” means any vessel used in navigation by air;

“oversea aircraft” means any aircraft entering Australia from any place outside Australia;

“the Act” means the Quarantine Act 1908-1947;

“the Director” means the Director of Quarantine.

(2.) In these Regulations, any reference to a Form shall be read as a reference to a Form contained in the Schedule to these Regulations.

Arrival message to be sent.

6.—(1.) The master of an oversea aircraft shall not suffer that aircraft to enter or arrive at an airport of entry in Australia unless he has sent a message, by telegraph or wireless telegraph, to the Quarantine Officer at the airport of entry where it is intended that the aircraft shall land stating—

(a) the registered marking of the aircraft and the date and time at which he expects to alight at the airport of entry in Australia;

(b) the name of the last port or place outside Australia at which the aircraft called or touched;

(c) whether any case of illness exists on board the aircraft; and

(d) whether there are any animals or birds on board the aircraft.

(2.) The message shall be sent from such place and at such time that it will, in the ordinary course of events, be received at the place to which it is addressed at least three hours before the arrival of the aircraft at the airport of entry in Australia.

Master to take measures for the destruction of insects.

7.—(1.) The master of an oversea aircraft shall cause all compartments of the aircraft which are capable of harbouring insects or disease vectors to be treated, by a method approved by the Director, in such a manner as to ensure the complete destruction of all insects and disease vectors which may be in the compartments.

(2.) Where the compartments are not accessible during flight they shall be treated immediately before the departure of the aircraft from the last airport outside Australia and all doors and openings in the compartment shall be closed immediately after the compartments have been treated and shall not be opened before the arrival of the aircraft at the first airport of entry in Australia.

(3.) Where the compartments are accessible during flight—

(a) they shall be treated during flight and not later than thirty minutes before the aircraft is due to arrive at the first airport of entry in Australia; and

(b) the ventilators of the aircraft shall be closed immediately before, and shall be kept closed for a period of ten minutes after, the compartments are treated.

Quarantine officer may require aircraft to be fumigated.

8. The master of an aircraft shall, when required by a Quarantine Officer, submit the aircraft to fumigation, spraying or such other treatment as the Quarantine Officer requires, by such methods as are approved by the Director.

Master to produce general Declaration and Passenger Manifest.

9. The master of an oversea aircraft shall, on arrival at the first airport of entry in Australia, furnish to the Quarantine Officer at that airport—

(a) a General Declaration in accordance with Form A, properly filled in and signed by the master; and

(b) a Passenger Manifest, in accordance with Form B, containing the names of all passengers on board the aircraft and the full address in Australia of each passenger.

Passengers to produce personal Declaration.

10. Every passenger on an oversea aircraft shall, on arrival at the first airport of entry in Australia, furnish to the Quarantine Officer at that airport a Personal Declaration in accordance with Form C, properly filled in and signed by that passenger.


 

Crew and passengers to produce certificates as to vaccination against small-pox.

11.—(1.) Each person on board an oversea aircraft shall, on arrival at the first airport of entry in Australia, produce to the Quarantine Officer at that airport a certificate in accordance with Form D, stating that he has been successfully vaccinated against small-pox within three years prior to embarkation on the aircraft, or that he has suffered from small-pox.

(2.) A person who fails to produce a certificate in accordance with the provisions of the last preceding sub-regulation shall submit to being vaccinated and shall be vaccinated against small-pox at the first airport of entry in Australia.

Persons from proclaimed places to be inoculated against cholera.

12. Where a place has been proclaimed under section twelve of the Act as a place infected with the quarantinable disease cholera, and while the Proclamation remains in force, every person entering Australia from that place shall produce to the Quarantine Officer at the first airport of entry in Australia a certificate in accordance with Form E stating that he has been inoculated against cholera not less than six days or more than six months before the date of his arrival in Australia.

Persons from proclaimed places to be inoculated against yellow fever.

13. Where a place has been proclaimed under section twelve of the Act as a place infected with the quarantinable disease yellow fever, and while the Proclamation remains in force, every person entering Australia from that place shall produce to the Quarantine Officer at the first airport of entry in Australia—

(a) a certificate in accordance with Form F stating that he has been inoculated against yellow fever not less than ten days nor more than four years before the date of his arrival in Australia; or

(b) a certificate in accordance with Form G stating that he is immune to yellow fever.

Vaccination and inoculation certificates.

14. Certificates of vaccination or inoculation in accordance with Forms D, E, F and G shall be—

(a) signed or endorsed by a Medical Officer of a Health Department or corresponding authority of the country in which the certificate is given and shall specify the office held by the person signing or endorsing the certificate; or

(b) signed by a medical practitioner approved by the Director.

Persons entering Australia.

15. For the purposes of these Regulations, a person shall be deemed to enter Australia from a place outside Australia if he has been in that place within fourteen days before his arrival in Australia.

Aircraft to land at prescribed landing place.

16.—(1.) The master of every oversea aircraft shall, on arrival at the first airport of entry in Australia, and at each landing place subsequently called at for which pratique is not held, cause his aircraft to come to a stop as near as practicable to a spot on the airport or landing place marked by a quarantine signal and shall remain there until pratique has been granted.

(2.) The signal referred to in the last preceding sub-regulation shall be—

(a) from sunrise to sunset, a yellow flag at least twenty-seven inches in breadth; and


 

(b) from sunset to sunrise, three lights (two red and one white) of such a character as to be visible on a clear night from a distance of one hundred yards, and placed at distances of two feet apart in the form of an equilateral triangle.

Persons not to approach signals.

17. An unauthorized person shall not approach within thirty yards of any signal referred to in the last preceding regulation.

Declaration verifying questions.

18. Where a Quarantine Officer has required a person who has been asked questions in pursuance of section seventy-three of the Act, to verify, by statutory declaration, the answers given to those questions, the declaration shall be in accordance with Form H and shall be handed to the Quarantine Officer.

Exemption from regulations.

19. The Director may exempt any oversea aircraft or any person on board an oversea aircraft from any of the requirements of these Regulations, if he is satisfied that in the circumstances adequate safeguards have been taken against the risk of the introduction of infection by that aircraft or that person.

Offences

20. Any person who contravenes, or fails to comply with, any of the provisions of these Regulations shall be guilty of an offence, and shall, on conviction, be liable to a penalty not exceeding Fifty pounds.

Forms.

21. Strict compliance with the Forms in the Schedule shall not be required and substantial compliance shall be sufficient.
