REGULATIONS UNDER THE DEFENCE ACT 1903-1941.*
I, THE GOVERNOR-GENRRAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1941.

Amendments of the War Financial (Military Forces) Regulations. †
Commencement.
1.—(1.) The amendments effected by these Regulations (except those effected by paragraphs (b), (f) and (g) of sub-regulation (1.) of regulation 2 and by regulations 3 and 18) shall, unless otherwise provided, be deemed to have come into operation on and from the sixth day of October, 1939.
(2.) The amendment effected by paragraph (g) of sub-regulation (1.) of regulation 2 of these Regulations shall be deemed to have come into operation on the twenty-second day of March, 1943.
(3.) The several Parts of the First, Third and Fourth Schedules to these Regulations shall be deemed to operate and to have operated in respect of the periods respectively specified therein.
Definitions.
2.—(1.) Regulation 4 of the War Financial (Military Forces) Regulations is amended—
(a) by inserting in sub-regulation (1.), after the definition of “child”, the following definition:—
“‘date of embarkation’ means in relation to a member—
(a) the date upon which the member embarked on a ship or aircraft for service outside Australia, but shall not be deemed to refer to the embarkation of a member who, subsequently, disembarked in Australia from that ship or aircraft and did not proceed forthwith in the same or another ship or aircraft for service outside Australia; or

(b) the date of appointment, enlistment, transfer or secondment of a member who at the time of his appointment, enlistment, transfer or secondment, was not in Australia;”;
(b) by omitting from sub-regulation (1.) the definition of “de facto wife” and inserting in its stead the following definitions:—
“‘dependent female’ means, in relation to any member, any woman who, for a period of not less than six months immediately prior to the member’s enlistment or appointment, lived with him as his wife, though not legally married to him;
‘formation, &c.’ means the whole of the officers and soldiers belonging or attached to an army, corps, division, armoured division, Lines of Communication Area, Lines of Communication Sub-Area, or to such other portions of the Military Forces as shall from time to time be appointed a formation, &c., by the Military Board;
‘formation, &c., commander’ means the commander of a formation, &c., not below the rank of Colonel, and includes the Commandant of the Royal Military College of Australia;”;
(c) by omitting from sub-regulation (1.) the definition of “member” and inserting in its stead the following definition:—
“‘member’ means—
(a) any person, other than a member of a women’s Service, appointed or transferred to, enlisted in, or seconded for service with, the Australian Imperial Force on or after the sixth day of October, 1939; or
(b) any member of the Permanent Military Forces other than the Australian Imperial Force, the Corps of Staff Cadets or a Women’s Service:
Provided that any such member appointed or enlisted prior to the sixth day of October, 1939, shall not be deemed to have been a member for the purposes of these Regulations prior to the twenty-seventh day of March, 1942; or
(c) any member of the Citizen Military Forces called up for continuous full-time war service; or
(d) any person appointed to or enlisted in a Women’s Service for continuous full-time war service or any person referred to in sub-regulation (2.) of this regulation”;
(d) by inserting in sub-regulation (1.), after the definition of “member”, the following definition:—
“‘minor’, when used in connexion with a Women’s Service, means a member of any of the Women’s Services holding the rank of private who, being under the age of twenty-one years, has not completed twelve months’ service in the Forces;”;
(e) by inserting in sub-regulation (1.) in the definition of “pay allowances”, after the words “command allowance”, the words “responsibility allowance,”;
(f) by omitting from sub-regulation (1.) the definition of “prescribed authority” and inserting the following definition in its stead:—
“‘prescribed authority’ means the Minister or any person appointed by him in writing to be a prescribed authority for the purposes of these Regulations;”
(g) by omitting from sub-regulation (1.) the definition of “standard rate” and inserting in its stead the following definition:—
“‘standard rate’ means, as on and from the twenty-second day of March, 1943, in relation to an allotment or allotments from the pay of—
(a) a member of a Women’s Service—
(i) in the case of an officer above the rank of Captain—a total rate of Five shillings and four pence per day;
(ii) in the case of any other member, not being a minor, holding a rank higher than that of private, Group III.—a total rate of Three shillings and fourpence per day; and
(iii) in the case of a member holding a rank not higher than that of private, Group III., and all minors—a total rate of Two shillings and fourpence per day;
(b) any other member—
(i) in the case of an officer—a total rate of Five shillings and sixpence per day; and
(ii) in the case of a soldier—a total rate of Three shillings and sixpence per day;”;
(h) by inserting the following definition in sub-regulation (1.), after the definition of “the Act”—
“‘Women’s Service’ means any of the following Services established under the Military Forces (Women’s Services) Regulations—
The Australian Army Nursing Service;
The Australian Women’s Army Service; and
The Australian Army Medical Women’s Service;”; and
(i) by omitting sub-regulation (2.) and inserting in its stead the following sub-regulations:—
“(2.) For the purposes of these Regulations, other than the First, Third and Fourth Schedules—
(a) any member of the Australian Army Nursing Service established under the Australian Military Regulations, including a Staff Masseuse, Group I., and a Staff Masseuse, Group II.; and
(b) any member of a Voluntary Aid Detachment, employed on continuous full time war service, shall be deemed to be, and at all times to have been, subject to the provisions of these Regulations relating to members of the Women’s Service known as the Australian Army Nursing Service or the Australian Army Medical Women’s Service, as the case may be.
“(3.) For the purposes of the First, Third and Fourth Schedules to these Regulations, a member referred to in sub-regulation (2.) of this regulation shall, until she becomes a member of a Women’s Service, be entitled to, and shall be deemed at all times to have been entitled to, the rates specified in those Schedules, according to her classification, or appointment, under the heading ‘Nurses and V.A.D.s.’.
“(4.) For the purposes of these Regulations any woman appointed, transferred or seconded to, or enlisted in, the Australian Imperial Force or the Citizen Military Forces, other than a legally qualified medical practitioner, shall be deemed to be a member of a Women’s Service.”.
3. After regulation 6 of the War Financial (Military Forces) Regulations the following regulation is inserted:—
Power of Minister to authorize expenditure.
“6a. The Minister may, with the concurrence of the Treasurer, authorize any expenditure, not covered by these Regulations, provided that the necessary funds have been made available by parliamentary appropriation or by the Treasurer in anticipation of parliamentary appropriation.”.
4. Regulation 7 of the War Financial (Military Forces) Regulations is repealed and the following regulation inserted in its stead:—
Pay.
“7.—(1.) The daily rate of pay of a member in respect of his service up to and. including the day immediately preceding the date on which he becomes entitled to deferred pay in accordance with the provisions of regulation 8 of these Regulations shall be the rate specified
in respect of the relevant period in Column 2 of the First Schedule to these Regulations opposite to the designation of his rank, appointment or classification in Column 1 of that Schedule.
“(2.) The daily rate of active pay of a member in respect of his service on and after the date on which he becomes entitled to deferred pay in accordance with the provisions of regulation 8 of these Regulations, shall be the rate specified in respect of the relevant period in Column 3 of the First Schedule to these Regulations opposite to the designation of his rank, appointment or classification in Column 1 of that Schedule:
Provided that where the rate of active pay specified in Column 3 of the First Schedule is less than the rate specified in Column 2 of that Schedule for the rank, appointment or classification of the member, he shall—
(a) in the case of a member of a Women’s Service other than a member who had embarked for service outside Australia, and its Territories—be paid in respect of any period prior to the twenty-sixth day of March, 1943, at the rate specified in Column 2; and
(b) in the case of any other member, except a member of the Australian Imperial Force—be paid in respect of any period prior to the twenty-seventh day of March, 1942, at the rate specified in Column 2:
Provided further that where a member becomes entitled to deferred pay by reason of his embarkation for service in the territory of Papua or New Guinea, and in consequence thereof his rate of active pay specified in Column 3 of the First Schedule is less than the rate specified in Column 2 of that Schedule for the rank, appointment or classification of the member, he shall, in respect of any period commencing on and from the date of such embarkation (but not earlier in the case of a member of a Women’s Service than the twenty-sixth day of March, 1943, and in the case of any other member not earlier than the twenty-seventh day of March, 1942) and ending on—
(c) the day on which he completed six mouths’ full time war service; or
(d) the twentieth day of May, 1943,
whichever is the earlier, be paid at the rate specified in Column 2 of the First Schedule.
“(3.) For the purposes of this regulation, the Minister shall determine the Group within which any particular member, tradesman or specialist or class of tradesmen or specialists shall be classified.”.
5. Regulation 8 of the War Financial (Military Forces) Regulations is repealed and the following regulation inserted in its stead:—
Deferred pay.
“8.—(1.) For the purposes of this regulation, any reference to the date of embarkation of a member shall be read as—
(a) in the case of a member who embarked prior to the seventh day of December, 1941—the date of embarkation as defined in regulation 4 of these Regulations;
(b) in the case of a member who embarked subsequent to the sixth day of December, 1941—the date of embarkation as defined in regulation 4 of these Regulations, provided
that embarkation for service in the Territory of Papua or New Guinea shall be deemed to be embarkation for service outside Australia; or
(c) in the case of a member who was, on the seventh day of December, 1941, serving in the territory of Papua or New Guinea—the seventh day of December, 1941.
“(2.) Subject to these Regulations, deferred pay shall be credited to the account of each member—
(a) in respect of his service as a member of the Australian Imperial Force, on and after—
(i) the date of his embarkation; or
(ii) the date upon which he commenced duty at an Operational Station, where such duty was commenced prior to the twenty-seventh day of March, 1942; or
(iii) the date upon which he completed a period of six months’ continuous service with the Australian Imperial Force,
whichever first occurs, at the rate specified in respect of the relevant period in Column 4 of the First Schedule to these Regulations opposite to the designation of his rank, appointment or classification in Column 1 of that Schedule;
(b) in respect of his service as a member of the Permanent Military Forces (other than the Australian Imperial Force or a Women’s Service) where he was appointed or enlisted prior to the sixth day of October, 1939—on and from the twenty-seventh day of March, 1942, at the rate specified in respect of the relevant period in Column 4 of the First Schedule to these Regulations opposite to the designation of his rank, appointment or classification in Column 1 of that Schedule;
(c) in respect of his service as a member of the Permanent Military Forces appointed or enlisted on or after the sixth day of October, 1939, or as a member of the Citizen Military Forces or a Women’s Service, called up, appointed or enlisted, as the case may be, for continuous full-time war service, on and after—
(i) the date of embarkation; or
(ii) the seventh day of December, 1941, where he had completed six months’ continuous full-time war service at that date, or the date subsequent to the seventh day of December, 1941, and immediately following the day upon which the member had completed six months’ continuous full-time war service,
whichever first occurs, at the rate specified in respect of the relevant period in Column 4 of the First Schedule to these Regulations opposite to the designation of his rank, appointment or classification in Column 1 of that Schedule.
“(3.) Where a member of the Permanent Military Forces appointed or enlisted on or after the sixth day of October, 1939, or a member of the Citizen Military Forces called up for continuous full-time war service—
(a) served at an Operational Station after the sixth day of November, 1941, and such service commenced prior to the twenty-seventh day of March, 1942; and
(b) is not entitled to receive deferred pay in respect of that service under paragraph (c) of sub-regulation (2.) of this regulation,
he shall be entitled to receive deferred pay in respect of that service at the rate of One shilling per day.
“(4.) Where, by the operation of sub-paragraph (a) or (b) of the proviso to sub-regulation (2.) of regulation 7 of these Regulations, a member was in receipt of pay at the rate prescribed in Column 2 of the First Schedule, in respect of the period between the date from which deferred pay is credited to his account under this regulation, and—
(a) in the case of a member of a Women’s Service—the twenty-sixth day of March, 1943; and
(b) in the case of any other member—the twenty-seventh day of March, 1942,
he shall be credited with deferred pay in respect of that period at the rate of One shilling per day in lieu of the rate specified in Column 4 of the First Schedule:
Provided that where a member becomes entitled to deferred pay by reason of his embarkation for service in the territory of Papua or New Guinea and in pursuance of the second proviso to sub-regulation (2.) of regulation 7 of these Regulations is entitled to pay at the rate prescribed in Column 2 of the First Schedule, that member shall, in respect of any period commencing on and from the date of such embarkation (but not earlier in the case of a member of a Women’s Service than the twenty-sixth day of March, 1943, and in the case of any other member not earlier than the twenty-seventh day of March, 1942) and ending on—
(c) the day on which he completed six months’ continuous full-time war service; or
(d) the twentieth day of May, 1943,
whichever is the earlier, be credited with deferred pay at the rate of One shilling per day in lieu of the rate specified in Column 4 of the First Schedule.
“(5.) For the purpose of determining the date of completion of the six months’ continuous service referred to in sub-paragraph (iii) of paragraph (a) of sub-regulation (2.) of this regulation, and the six months’ continuous full-time war service referred to in sub-paragraph (ii) of paragraph (c) of sub-regulation (2.) of this regulation, any full-time war service rendered by the member with—
(a) the Royal Australian Navy or the Australian Imperial Force; or
(b) the Royal Australian Air Force, if the member was in receipt of deferred pay at the time of his discharge, or if the member was not in receipt of deferred pay, any such service on and after the seventh day of June, 1941; or
(c) the Citizen Military Forces or the Permanent Military-Forces (including the Corps of Staff Cadets) on and after the seventh day of June, 1941, but not including any such service rendered in a periodical military training camp unless that service was followed immediately by a period of continuous full-time war service,
shall be taken into account:
Provided that for the purposes of sub-paragraph (b) of this sub-regulation, deferred pay shall not be deemed to include deferred pay granted in respect of service at an Operational Station in pursuance of sub-regulation (3.) of this regulation.
“(6.) Deferred pay shall not be payable in respect of any day for which a member is granted leave without pay.
“(7.) Deferred pay shall be forfeited for any day for which a member’s active pay is forfeited, except in the case of a forfeiture under regulation 25 of these Regulations, in which case one-third of his daily rate of deferred pay shall be forfeited for each day of the period of that forfeiture.
“(8.) Interest at the prescribed rate shall be credited to the account of the member at the end of the second and each subsequent year of his service after the date from which he first became entitled under this regulation to deferred pay, and shall be calculated on the amount of deferred pay accumulated to his credit at the end of the previous year of that service. Interest credited to a member’s deferred pay account shall be considered as part of his accumulated deferred pay and shall bear interest accordingly.
“(9.) When deferred pay becomes payable in accordance with the next succeeding sub-regulation, interest on the amount of accumulated deferred pay of the member at the end of the last completed year of his service after the date from which he first became entitled to deferred pay shall be allowed for the period from the end of that year to the date upon which his pay ceased in accordance with these Regulations.
“(10.) The deferred pay accumulated to a member’s credit, including interest thereon, shall become payable upon the termination of his service, but shall be subject to a deduction of any amount standing to his debit in his pay account:
Provided that in the case of a member whose service is terminated to enable him to enlist in or be appointed to another part of the Defence Force, the deferred pay which would otherwise be payable to him, together with any accrued interest, shall be transferred to and accounted for in that part of the Defence Force in which he is then enlisted or appointed, and interest accruing thereafter shall be credited at the rates and under the conditions specified for deferred pay of a member of that part of the Defence Force:
Provided further that the discharge of a soldier for the purpose of appointing him to commissioned rank shall not be deemed to be termination of service for the purposes of this regulation.
“(11.) The prescribed rate of interest for the purposes of this regulation shall be—
(a) for the period prior to the first day of January, 1941, three and one-half per centum per annum;
(b) for the period from and including the first day of January, 1941, to and including the thirty-first day of December, 1941, three per centum per annum; and
(c) for any period after the thirty-first day of December, 1941, such rate as is from time to time fixed by the Treasurer by notice in the Gazette.
“(12.) The Minister may, in writing, declare any place to be or to have been an Operational Station for the purposes of this regulation, and shall specify therein a date as from which the station shall be deemed to be or to have been an Operational Station for the purposes of this regulation.”.
6. Regulation 9 of the War Financial (Military Forces) Regulations is repealed and the following regulation inserted in its stead:—
Member of Permanent Military Forces appointed to or seconded for service with Australian Imperial Force.
“9.—(1.) For the purposes of this regulation—
‘member’ means any member of the Permanent Military Forces appointed or enlisted prior to the sixth day of October, 1939, and includes any such member who has been appointed or transferred to, or seconded for service with, the Australian Imperial Force;
‘permanent force rate’ means—
(a) in relation to a member other than a member serving with the Australian Imperial Force—the total amount of the daily rate of pay payable to him under the Military Financial Regulations on the twenty-sixth day of March, 1942, less—
(i) in the case of a member other than a married member—the rate of two shillings and five pence per day; and
(ii) after the twenty-fifth day of June, 1943, in the case of any member—the daily rate of contributions payable in respect of that member under the Superannuation Act 1922-1943; and
(b) in relation to a member serving with the Australian Imperial Force—the total amount of the daily rate of pay payable to him under the Military Financial Regulations at the date immediately prior to the date on which he was appointed or transferred to, or seconded for service with, the Australian Imperial Force, subject to the following variations:—
(i) in the case of a member other than a married member, a deduction at the rate of two shillings and five pence; and
(ii) a deduction of an amount equal to the daily rate of the contributions payable in respect of him under the Superannuation Act 1922-1943;
(iii) an addition of a daily payment at the rate of £12 per annum in the case of any member appointed to, transferred to, or seconded for service with, the Australian Imperial Force prior to the thirtieth day of October, 1941, such addition to be taken into account on and after that date;
(iv) in respect of any period prior to the thirtieth day of October, 1941, an addition of an amount equal to the daily rate of Child Endowment (if any) which would have been payable to him under the Military Financial Regulations, if he had not been appointed to, transferred to, or seconded for service with, the Australian Imperial Force;
(v) an addition of a daily payment at the rate which would have been payable to him in accordance with regulation 27 of the Military Financial Regulations prior to the twenty-seventh day of March, 1942, in the case of any member appointed to, transferred to or seconded for service with, the Australian Imperial Force before that date;
‘W.F.R. rate’ means, in relation to a member to whom this regulation applies, the total amount of—
(a) his daily rate of pay under these Regulations;
(b) the daily rate of command allowance (if any), responsibility allowance (if any) and of special allowances (if any) payable to him under these Regulations; and
(c) the daily rate of dependants allowance (if any) payable under these Regulations in respect of the member.
“(2.) Subject to this regulation, a member’s pay and allowances shall be at the rates specified in these Regulations, but, if his permanent force rate exceeds his W.F.B. rate, he may be paid in addition an allowance of an amount equal to the difference.
“(3.) If at any time a member’s W.F.R. rate of pay is equal to or exceeds his permanent force rate he shall from that time, subject to sub-regulation (4.) of this regulation, cease to be eligible for any allowance payable under sub-regulation (2.) of this regulation.
“(4.) If at any time a member’s W.F.R, rate of pay is reduced—
(a) by a reversion in rank of the member for reasons other than disciplinary reasons; or
(b) by a reduction in the total amount of dependants allowance payable in respect of the member under these Regulations,
to such an extent that his permanent force rate exceeds his W.F.R. rate, he may be paid an allowance of an amount equal to the difference.
“(5.) During any period for which, in accordance with the provisions of regulation 22 of these Regulations, exchange allowance is payable to any member he shall be paid an additional exchange allowance at the rate of twenty-five per centum on two-fifths of the amount of any allowance payable to him under sub-regulation (2.) of this regulation.”.
Repeal or Regulation 16.
7. Regulation 16 of the War Financial (Military Forces) Regulations is repealed.
Field Allowance in Australia.
8.—(1.) Regulation 18 of the War Financial (Military Forces; Regulations is amended—
(a) by omitting sub-regulations (1.) and (2.) and inserting the following sub-regulations in their stead:—
“(1.) Subject to such conditions as are approved by the Minister, field allowance may be paid to the following officers and warrant officers in respect of service in Australia—
(a) in the case of an officer of a Women’s Service, when in camp or bivouac or when travelling with other members as a party, in respect of any period commencing on or after the fifteenth day of May, 1941, and ending prior to the nineteenth day of June, 1942—at the rate of One shilling and six pence per day;
(b) in the case of officers and warrant officers, Class I., not being members of a Women’s Service, when in camp or bivouac, or when travelling with troops, in respect of any period commencing on or after the twelfth day of June, 1940, and ending prior to the nineteenth day of June, 1942—at the rate of Three shillings per day to an officer and One shilling per day to a warrant officer, Class I.;
(c) in the case of officers and warrant officers, Class I., when such officer or warrant officer is provided with rations and quarters, in respect of any period commencing on or after the nineteenth day of June, 1942, at the rate of—
(i) One shilling and sixpence per day to an officer of a Women’s Service;
(ii) Three shillings per day to any other officer;
(iii) One shilling per day to a warrant officer, Class I., not being a member of a Women’s Service.
“(2.) Field allowance under this regulation shall not be payable in respect of any day—
(a) when travelling allowance is payable; or
(b) after the expiration of a continuous period of fourteen days during which the member is billeted:
Provided that such allowance may be paid to officers and warrant officers of the Australian Imperial Force
who returned to Australia from overseas service subsequent to the twenty-eighth day of February, 1942, during any period between the first day of March, 1942, and the second day of June, 1942, in which they were billeted.”.
(2.) The amendments effected by this regulation shall be deemed to have come into operation—
(a) so far as they relate to members of a Women’s Service—on the fifteenth day of May, 1941; and
(b). so far as they relate to any other member—on the twelfth day of June, 1940.
9—(1.) Regulations 19 and 20 of the War Financial (Military Forces) Regulations are repealed and the following regulations inserted in their stead:—
Field Allowance after embarkation.
“19.—(1.) On and after the date of embarkation, and up to and including the date of disembarkation in Australia upon his return thereto, field allowance shall be paid—
(a) to an officer of a Women’s Service—at the rate of One shilling and sixpence per day;
(b) to an officer other than an officer of a Women’s Service—at the rate of Three shillings per day;
(c) to a warrant officer, Class I., not being a member of a Women’s Service—at the rate of One shilling per day.
“(2.) Field allowance under this regulation shall be payable in addition to responsibility allowance, but shall not be payable for any period in respect of which command allowance is paid.
Command and Responsibility Allowances.
“20.—(1.) For the period on and after the date of his disembarkation overseas for service and up to and including the date of his embarkation for return to Australia, or the thirtieth day of June, 1943, whichever date is the earlier, command allowance shall be paid to an officer holding a rank or appointment specified in the following table at the rate appearing in that table opposite the designation of his rank or appointment:—

“(2.) In the case of a Major-General who is not commanding a Division, or a Brigadier who is not commanding a Brigade, the Minister may authorize payment of command allowance during any period included in the period specified in the last preceding sub-regulation at such rate as he considers reasonable, having regard to the nature of the appointment and the expenses incidental thereto, but no such allowance shall exceed that prescribed for a Major-General commanding a Division or a Brigadier commanding a Brigade, as the case may be.
“(3.) An officer not in receipt of command allowance under sub-regulation (1.) of this regulation, who holds an appointment specified in the following table shall, on and from the date of such appointment, but not prior to the twenty-seventh day of March, 1942, be paid responsibility allowance at the rate appearing in that table opposite to the designation of his appointment:—

“(4.) The Minister may authorize the payment of responsibility allowance at the rate of £150 per annum (in Australian currency) to a Major-General not commanding a Division, where, in his opinion, the payment of the allowance is justified by the responsibilities of the appointment.”.
(2.) The portion of this regulation which provides for the repeal of regulation 19 of the War Financial (Military Forces) Regulations and the insertion of a new regulation in its stead shall be deemed to have come into operation—
(a) so far as it relates to members of a Women’s Service—on the fifteenth day of May, 1941; and
(b) so far as it relates to any other member—on the twelfth day of June, 1940.
Special Allowances.
10. Regulation 21 of the War Financial (Military Forces) Regulations is amended—
(a) by inserting after the word “appointment” (first occurring) the words “, or where other special circumstances exist,”; and
(b) by inserting after the word “appointment” (second occurring) the words “or to such special circumstances,”.
Remission of forfeiture in event of death.
11.—(1.) Regulation 24 of the War Financial (Military Forces) Regulations is amended by omitting the words “after the date of his embarkation”.
(2.) This regulation shall be deemed to have come into operation on the seventh day of December, 1941.
Venereal Disease.
12. Regulation 25 of the War Financial (Military Forces) Regulations is amended—
(a) by inserting after the word “from” (second occurring) the word “acquired”; and
(b) by adding at the end thereof the following proviso:—
“Provided that the provisions of this regulation shall not apply where, the member, while acting in the course of his duty, has contracted the disease as a result of giving medical care and attention to some other person.”.
False answers on attestation.
13.—(1.) Regulation 26 of the War Financial (Military Forces) Regulations is amended by adding at the end of sub-regulation (2.) the words “or to any member whom the Minister has exempted from the operation of this regulation”.
(2.) This regulation shall be deemed to have come into operation on and from the seventh day of December, 1941.
Pay during Detention as Prisoner of War.
14. Regulation 29 of the War Financial (Military Forces) Regulations is amended by inserting after the words “command allowance” the words “responsibility allowance”.
Cessation of pay.
15. Regulation 30 of the War Financial (Military Forces) Regulations is amended—
(a) by omitting paragraph (a) of sub-regulation (1.) and inserting in its stead the following paragraph:—
“(a) as from the day of the termination of his service, but the discharge of a soldier for the purpose of appointing him to commissioned rank shall not be deemed to be termination of his service for the purpose of this regulation;”;
(b) by inserting in sub-regulation (1.) after the words “Australian Soldiers’ Repatriation Act 1920-1940” the words “or the Superannuation Act 1922-1943”; and
(c) by inserting in sub-regulation (2.) after the words “Repatriation Commission” the words “or to the Commonwealth Superannuation Board, as the case may be”.
16.—(1.) Regulation 34 of the War Financial (Military Forces) Regulations is repealed and the following regulation inserted in its stead:—
Dependants Allowance.
“34. Subject to these Regulations, where a member has one or more persons wholly or partly dependent upon him, dependants allowance may be paid at such rate as a prescribed authority directs, but not exceeding—
(a) where the member has one dependant only—Four shillings and sixpence per day;
(b) where the member has two dependants only—Seven shillings and sixpence per day;
(c) where the member has three dependants only—Nine shillings and sixpence per day;
(d) where the member has more than three dependants—Nine shillings and sixpence per day and One shilling and sixpence per day for each dependant in excess of three.”.
(2.) The provisions of sub-regulation (1.) of this regulation shall be deemed to have come into operation on the fourteenth day of August, 1942.
Allowance conditional upon allotment.
17. Regulation 35 of the War Financial (Military Forces) Regulations is amended—
(a) by inserting after the word “provided”, the words “in sub-regulations (2.) and (3.) of this regulation and”; and
(b) by adding at the end thereof the following sub-regulations:—
“(2.) Where a claim is made for dependants allowance by or on behalf of a dependant of a member who has not made an allotment equal to or in excess of the standard rate and an allotment at not less than the standard rate is
subsequently made, dependants allowance may be paid in respect of such period prior to the date of the making of the allotment as the prescribed authority considers justified in the circumstances of the case:
Provided that the period shall not commence prior to the date upon which the claim for dependants allowance was made to the prescribed authority and shall not, in any event, exceed three months.
“(3.) Where a member marries and makes an allotment at not less than the standard rate commencing from a date subsequent to the date of his marriage, dependants allowance may be paid for such period prior to the date of the commencement of the allotment as the prescribed authority considers justified in the circumstances of the case:
Provided that the period shall not commence prior to the date of the member’s marriage and shall not, in any event, exceed twenty-eight days.”.
Persons to whom dependants allowance payable and apportionment of allowance.
18. Regulation 36 of the War Financial (Military Forces) Regulations is amended by omitting from sub-regulations (6.) and (7.) the words “his de facto wife” and inserting in their stead the words “a dependent female”.
