REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1943.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1943.

Amendments of the National Security (Dairy Produce Acquisition) Regulations.†

1. After regulation 1 of the National Security (Dairy Produce Acquisition) Regulations the following regulation is inserted:—

Administration.

“1a. These Regulations shall be administered by the Minister of State for Commerce and Agriculture”.

Definitions.

2. Regulation 2 of the National Security (Dairy Produce Acquisition) Regulations is amended—

(a) by omitting the definition of “the Minister”; and

(b) by adding at the end thereof the following definition:—

“‘the Controller of Dairy Products’ means the Controller of Dairy Products appointed under the National Security (Food Control) Regulations”.

Dairy Produce Control Committee.

3. Regulation 3 of the National Security (Dairy Produce Acquisition) Regulations is amended by omitting sub-regulation (2.) and inserting in its stead the following sub-regulations:—

“(2.) The Committee shall consist of the Controller of Dairy Products and five other members.

“(2a.) The members of the Committee (other than the Controller of Dairy Products) shall be appointed by, and shall hold office during the pleasure of, the Minister”.

Meetings of the Committee.

4. Regulation 6 of the National Security (Dairy Produce Acquisition) Regulations is amended—

(a) by omitting from sub-regulation (2.) the word “four” and inserting in its stead the word “three”;

(b) by omitting from sub-regulation (3.) the word “seven” and inserting in its stead the word “four”; and

(c) by inserting after sub-regulation (5.) the following sub-regulation:—

“(5a.) Where, at any meeting at which the Chairman is not present, the voting on any question is equal, the question shall be postponed until the next meeting at which the Chairman is present”.

5. Regulations 8 and 8a of the National Security (Dairy Produce Acquisition) Regulations are repealed and the following regulations inserted in their stead:—

Fees and expenses.

“8. There shall be payable to the members of the Dairy Produce Control Committee or of a State Dairying Industry Advisory Committee such salaries, fees and expenses, and at such rates, as the Governor-General determines.

State Dairying Industry Advisory Committees.

“8a.—(1.) For the purposes of these Regulations there shall be such Committees, to be known as State Dairying Industry Advisory Committees, as the Minister determines.

“(2.) Each State Dairying Industry Advisory Committee shall consist of such number of persons as the Minister determines which number shall include an officer of the Department of Agriculture for the State concerned.

“(3.) The members of a State Dairying Industry Advisory Committee shall be appointed by the Minister and shall hold office during his pleasure.

“(4.) The Minister may appoint one of the members of a State Dairying Industry Advisory Committee to be the chairman thereof and another of the members to be the deputy chairman.

“(5.) A State Dairying Industry Advisory Committee shall advise the Minister, the Controller of Dairy Products or the Dairy Produce Control Committee on such matters relating to the dairying industry as the Minister, the Controller of Dairy Products or the Dairy Produce Control Committee refers to it”.

Powers of Committee.

6. Regulation 18 of the National Security (Dairy Produce Acquisition) Regulations is amended by omitting paragraph (bd) and inserting in its stead the following paragraph:—

“(bd) lend money to any person for any of the purposes specified in the last preceding paragraph”.

7. After regulation 20 of the National Security (Dairy Produce Acquisition) Regulations the following regulation is added:—

Guarantees by Minister.

“21. The Minister may, for and on behalf of the Commonwealth, guarantee the repayment to the Commonwealth Bank of Australia of any loan (including interest thereon) made (whether before or after the commencement of this regulation) by that bank to any person for any of the purposes specified in paragraph (bc) of regulation 18 of these Regulations”.
