1915. No. 76.

 

PROVISIONAL REGULATIONS RELATING TO JOINT ELECTORAL ROLLS IN THE STATE OF TASMANIA.

WHEREAS pursuant to the Commonwealth Electoral Act and the Electoral Acts of the State of Tasmania, the Governor-General of the Commonwealth of Australia has entered into an arrangement with the Governor of the said State for the preparation, alteration, and revision jointly of Commonwealth and House of Assembly Electoral Rolls in the said State:

And whereas the Governor-General and the Governor of the said State have respectively made Regulations under the said Acts for the purpose of carrying the said arrangement into effect, and whereas it is desirable to amend the said Regulations:

Now, therefore, I, the Governor-General, acting with the advice of the Federal Executive Council, do hereby make the following Regulations under the Commonwealth Electoral Act 1902–11 amending the Regulations dated the 20th day of March, 1912, made under the said Act, to the intent that these Regulations as so amended shall have force as from the eighteenth day of May, 1915, in relation to the joint Rolls prepared and kept in the State of Tasmania in pursuance of the said recited arrangement:

And, further, I certify that, on account of urgency, the said Regulations should come into operation forthwith as Provisional Regulations:

And I, the Governor of the State of Tasmania, acting with the advice of the State Executive Council, do hereby make the following Regulations under the Electoral Acts 1907 and 1911 of the said State amending the Regulations dated the fourth day of March, 1912, made under the said Acts, to the intent that those Regulations as so amended shall have full force as from the eighteenth day of May, 1915, in relation to the joint Rolls prepared and kept in the State of Tasmania in pursuance of the said recited arrangement.

The Electoral Regulations relating to Joint Electoral Rolls in the State of Tasmania (Statutory Rules 1912, No. 67) are amended by omitting Regulations 11 and 14 and by inserting in their stead the following Regulations:—

Notification of Transfer or Change of Enrolment for the Commonwealth and the House of Assembly, or either.

11. A notification by a Registrar to another Registrar of the transfer or change of the enrolment of an elector from one Subdivision (Subdistrict) to another Subdivision (Subdistrict), whether in the same or any other Electoral Division (District) may be in accordance with such of the following forms as is appropriate:—

(To be used where a Registrar notifies another Registrar of the removal of more than one name.)

You are hereby notified that the electors specified hereunder in Column (1) who were formerly enrolled on the Roll for the Subdivision (Subdistrict) specified in Column (4) opposite their respective names, having complied with the requirements of the law, have been enrolled as electors for the Commonwealth and House of Assembly for the Subdivision (Subdistrict) specified in Column (3) opposite their respective names.

You are requested to remove such names from the Roll for the Subdivision (Subdistrict) kept by you and specified in Column (4) opposite their respective names, and to notify the persons concerned in accordance with Regulation 14.

(2) Where notifications of transfers or changes of enrolment in this form are required to be sent to another Registrar relating to electors, some of whom are enrolled as Commonwealth electors and State electors, and others as Commonwealth electors only, or State electors only, separate forms of notification, each dealing with one description of elector only, should be used.

Notification to Elector of Removal of Name from Roll by Direction of the Commonwealth Electoral Officer and the State Chief Electoral Officer, or either, or upon Receipt of a Notification under Regulation 11 from a Registrar for another Subdivision (Subdistrict).

14. When an Electoral Registrar is directed by the Commonwealth Electoral Officer for the State and the State Chief Electoral Officer, or either (in such form as may be authorized by the Chief Electoral Officer for the Commonwealth and the State Chief Electoral Officer, or either), or is required pursuant to a notification under the provisions of Regulation 11 received from a Registrar for another Subdivision (Subdistrict), to remove the name of an elector from the Subdivision (Subdistrict) Roll kept by him on the ground that the elector has ceased to be qualified for enrolment on that Roll and has secured enrolment on the Roll for another Subdivision (Subdistrict), the Registrar shall, immediately upon removing such name, send


by post to the elector (at the address appearing on the Roll kept by him) a notification of such removal, in accordance with the following form:—

The Electoral Regulations relating to Joint Electoral Rolls in the State of Tasmania (Statutory Rules 1912 No. 67) are amended by omitting Regulation 17 and inserting in its stead the following Regulations 17, 17a, and 17b.

17. The notice to be forwarded by the Returning Officer to a person whose name has been objected to as that of an elector for the Commonwealth and the House of Assembly, or either, upon the ground of non-residence, may be in accordance with the following form:—

Notice is hereby given that an objection has been lodged with me by (here insert the name and description of the objector) objecting to your name being retained on the Electoral Roll for the Electoral Division (District) of (here insert name of Electoral Division (District), as an elector for the Commonwealth and House of Assembly, on the ground that you do not live in the Division (District) and have not so lived for a period of at least one month.

You are entitled at any time within twenty days from the posting of this notice to answer the objection either orally or in writing.

If you intend to answer the objection orally you should attend at my Office at (here insert address of office) between the hours of 9 a.m. and 4.30 p.m. on any day other than a Saturday or between the hours of 9 a.m. and 12 noon on a Saturday before the expiration of twenty days from the posting of this notice.

If you claim that your place of living is still in the Division (District) and you do not desire to attend at my office for the purpose of answering this objection orally, you should with the least delay, but before the expiration of twenty days from the posting of this notice—

(a) complete, personally sign, and date, the reply at the foot hereof in the presence of a witness; and

(b) fold the notice so that the address “Returning Officer for the Electoral Division (District) of        ” shall be visible, and post the notice to me with reply attached.

Notice of Decision on an Objection.

 

17b. (1) Where the form of notice of objection specified in Regulation 17 or 17a has been used, the Returning Officer need only send notice of his decision, under Regulation 20, to the following persons :—

(a).... To a person who has answered an objection in the prescribed manner ; and

(b).... To an objector who is not an Electoral Registrar.

(2) Where an objector is an Electoral Registrar, notice of the decision on the objection may be sent to him in such form as the Returning Officer thinks fit to use, subject to any authorized direction, and such notice may contain a direction for the removal of an elector's name from the Roll for the Commonwealth and the House of Assembly, or either, as the case requires, when an objection has been sustained.

 

Notwithstanding anything contained in these Regulations, any form repealed by these Regulations may continue to be used for a period not exceeding three months from the date of the coming into operation of these Regulations.
