New South Wales Class 1 and Class 3 Parkes Bypass Notice 2025 (No.1)

 

  1.        Purpose

 

This notice provides access to the Parkes Bypass for eligible vehicles that have a class 1 or class 3 mass or dimension exemption permit (permit) under the Heavy Vehicle National Law (HVNL).

 

Note:  This notice does not apply to all class 1 or class 3 vehicles, but only to those with a permit authorising them to operate on the Old Parkes Bypass.

 

  1.        Authorising Provision

 

  1.       This notice is made under the following sections of the Heavy Vehicle National Law (HVNL):

 

  1.       section 117 – Regulator’s power to exempt category of class 1 or 3 heavy vehicles from compliance with mass or dimension requirement.

 

  1.        Title

 

This notice may be cited as the New South Wales Class 1 and Class 3 Parkes Bypass Notice 2025 (No.1).

 

  1.        Commencement

 

This notice commences on 15 April 2025.

 

  1.        Expiry

 

This notice expires on 15 April 2026.

 

  1.        Definitions

 

  1.       Unless otherwise stated, words and expressions used in this notice have the same meanings as those in the HVNL and its regulations.

 

  1.       In this notice:

 

Parkes Bypass means the Newell Highway between Dubbo and Forbes from Maguire Road to Barkers Road travelling west of the Parkes township.

 

Old Parkes Bypass means the previous Parkes Bypass comprised of either of the following routes:

  1.       Bushman Street, Condobolin Road, Henry Parkes Way, Hartigan Avenue, Billy Mac Place; or

 

  1.       Victoria Street, McGlynn Street, Condobolin Road, Henry Parkes Way, Hartigan Avenue, Billy Mac Place.

 

  1.        Application

 

  1.       This notice applies to a class 1 or class 3 heavy vehicle that meets all the requirements in this section.

 

  1.       This notice applies to a heavy vehicle operating under a current class 1 or class 3 permit issued before 16 April 2025, under section 122 of the HVNL that contains as part of its network conditions a route that includes the Old Parkes Bypass.

 

  1.       This notice applies in New South Wales.

 

  1.       A heavy vehicle to which this section applies and that complies with the conditions of this notice is an eligible vehicle.

 

  1.        Exemption from prescribed mass and dimension requirements

 

An eligible vehicle operating under this notice must comply with the mass and/or dimension requirements specified in the permit issued for the vehicle and referred to in section 7(2) of this notice.

 

  1.        Conditions: Routes

This notice applies to an eligible vehicle travelling under a permit in section 7(2) of this notice and operating on the Parkes Bypass.

 

  1.    Conditions: Parkes Bypass

 

  1.       An eligible vehicle operating under this notice and travelling under a permit in section 7(2) of this notice may travel on the Parkes Bypass.

 

  1.       When operating on the Parkes Bypass the eligible vehicle must comply with any condition:

 

  1.       specified in the permit issued for the vehicle and referred to in section 7(2) of this notice; and
  2.       that apply to the vehicle when operating a route on the Old Parkes Bypass.
