South Australia Class 3 23m Long Single Deck Vehicle Carrier Exemption Notice 2023 (No.1)
1) This notice grants exemptions from dimension requirements for class 3 heavy vehicles that are vehicle carriers with a single deck and that are no more than 23m long.
2) This notice revokes the South Australia Class 3 23m Long Single Deck Vehicle Carrier Exemption Notice 2020 (No.1).
2. Authorising provision
1) This Notice is made under the following provision of the Heavy Vehicle National Law (HVNL):
a) section 117 – Regulator’s power to exempt category of class 1 or 3 heavy vehicles from compliance with mass or dimension requirement.
b) section 23 of Schedule 1 – Regulator’s power to amend or repeal instrument.
3. Title
This exemption notice may be cited as the South Australia Class 3 23m Long Single Deck Vehicle Carrier Exemption Notice 2023 (No.1).
4. Commencement date
This notice commences on 27 October 2023.
5. Expiry date
This notice expires on 26 October 2028.
6. Definitions
1) Unless otherwise stated, words and expressions used in this notice have the same meanings as those in the HVNL and its regulations.
2) In this Notice:
Vehicle includes an aircraft or boat secured to a trailer.
7. Application
1) This exemption notice applies to a class 3 heavy vehicle that is a vehicle carrier and that is a combination consisting of:
a) a rigid truck with a single steer axle and single drive axle; and
b) a trailer fitted with either a single axle or a tandem axle group.
2) The trailer specified under 1) must be fitted with a single deck, built for the purpose of carrying vehicles.
3) This notice only applies to a vehicle carrier described in 1) and 2) when it:
a) is loaded exclusively with vehicles; or
b) is unladen.
4) This notice applies in South Australia.
5) A heavy vehicle to which this section applies and that complies with the conditions of this notice is an eligible vehicle.
8. Exemption – Prescribed dimension requirements
1) An eligible vehicle is exempt from the following dimension requirements under Schedule 6 of the Heavy Vehicle (Mass Dimension and Loading) National Regulation:
a) section 3 – Length (combination or single vehicle)
b) section 5 – Length (rear overhang)
2) An exemption in 1) only applies to the extent that specific conditional dimension limits are provided in sections 9) and 10) of this notice.
3) If, in relation to a particular vehicle or component, this notice provides for more than one dimension limit that apply in the same circumstances, the lower dimension limit applies, and the other dimension limit must be disregarded.
9. Condition – length
An eligible vehicle must not exceed 23.0m in length.
10. Condition – rear overhang
The rear overhang of the trailer must not exceed 4.9m provided the rear overhang greater than 3.7m consists only of a vehicle that is not a heavy vehicle.
11. Condition – unladen length
An eligible vehicle must be able to be reduced to 19.0m in length when unladen.
12. Condition – no carriage of load above cabin of rigid truck
A load must not be carried above the cabin of the rigid truck.
13. Conditions – Areas and routes
1) An eligible vehicle complying with the conditions of this Notice is authorised to operate on the routes and areas specified in the following network:

2) For the purposes of section 119(1)(a) of the HVNL, an area or route specified in this section is a stated area or route to which this notice applies.
3) An eligible vehicle operating on an area or route specified in this section must comply with the following conditions set for the routes and areas specified in this section:
a) Road conditions pursuant to section 160 of the HVNL; and
b) Travel conditions pursuant to section 161 of the HVNL; and
c) Vehicle conditions pursuant to section 162 of the HVNL.
