Suspension and Revocation - National Class 3 Supplementary Access (Western Australia Assistance) Exemption Notice 2023 (No.1)

  1. Purpose

 

This notice immediately suspends and then revokes the National Class 3 Supplementary Access (Western Australia Assistance) Exemption Notice 2023 (No.1), made under the Heavy Vehicle National Law (HVNL).

 

2.       Authorising provisions

 

1)      This notice is made under the following provisions of the HVNL:

 

a)      Section 174 – Amendment or cancellation on request by relevant road manager

b)      Section 175 – Immediate suspension

 

3.       Cancellation

 

1)      Pursuant to section 174(2)(b) of the HVNL, and upon request by a Road Manager, the Regulator hereby gives notice of the cancellation of the National Class 3 Supplementary Access (Western Australia Assistance) Exemption Notice 2023 (No.1).

 

2)      Pursuant to section 174(6) of the HVNL, the cancellation under this section takes effect 28 days after the publication of this notice.

 

4.       Immediate suspension

 

1)      Pursuant to section 175 of the HVNL, the Regulator hereby immediately suspends the operation of the National Class 3 Supplementary Access (Western Australia Assistance) Exemption Notice 2023 (No.1).

 

2)      The ground for suspension is that a speed restriction is required for eligible vehicles to operate safely on particular roads under this Notice.

 

Note: the required speed restriction is not imposed by the current National Class 3 Supplementary Access (Western Australia Assistance) Exemption Notice 2023 (No.1).

 

 

 

3)      Suspension under this section takes effect immediately under this Notice and remains in place until the cancellation made under section 3(1) of this Notice takes effect.
