New South Wales Class 3 Cotton Module Chain Bed Semitrailer Combination Dimension Exemption Notice 2019 (No.1)
Purpose
Note – This instrument is an exemption from heavy vehicle height and rear overhang limits for combinations consisting of a prime mover and a semitrailer with a chain bed specifically built for carrying cotton modules. This instrument does NOT exempt these vehicles from other requirements of the Heavy Vehicle National Law including, but not limited to, mass and other dimension requirements.
This Notice replaces the New South Wales Class 3 Cotton Module Chain Bed Semitrailer Combination Dimension Exemption (Notice) 2014 (No.1)
Authorising provision
2. This Notice is made under section 117 of the Heavy Vehicle National Law (HVNL) as in force in each participating jurisdiction.
Title
3. This Notice may be cited as the New South Wales Class 3 Cotton Module Chain Bed Semitrailer Combination Dimension Exemption Notice 2019.
Commencement
4. This Notice commences on 10 February 2019.
Expiry
5. This Notice expires on 9 February 2024.
Definitions
6. Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the HVNL.
7. In this Notice—
‘Cotton module chain bed semitrailer combination’ means a combination consisting of a prime mover and a semitrailer with a chain-bed specifically constructed to transport cotton modules.
Application
8. This Notice applies to cotton module chain bed semitrailer combinations.
9. This Notice applies in New South Wales.
Exemption from prescribed dimension requirement
10. This Notice exempts a cotton module chain bed semitrailer combination from—
(a) The rear overhang limit for a combination that includes a semitrailer in section 5(1)(a) of Schedule 6 of the Regulation; and
(b) The height limit for a heavy vehicle in section 8(d) of the Regulation.
Conditions
11. The loaded height of the combination must not exceed 4.6m.
12. The rear overhang of the combination must not exceed 4.2m.
13. The semitrailer must be loaded in a manner that ensures—
(a) The risk to other road users are minimised; and
(b) The loading does not adversely affect the combination’s stability; and
(c) The restraining of the load complies with the Load Restraint Guide.
14. The combination may use any road in the local government areas list in Appendix 1 to this Notice.
15. The combination may only transport cotton modules on the safest direct route from the farm of origin to the cotton gin nominated by the producer of the cotton.
16. The combination must comply with clause 11 of Schedule 8 of the Regulation.
