New South Wales Class 3 Heavy Vehicle Livestock Tri-Axle Group Mass Limit Exemption Notice 2019 (No. 1)

Purpose

  1. The purpose of this notice is to exempt the stated categories of Class 3 heavy vehicles transporting livestock from the mass limit for a tri-axle group with single tyres with section widths of at least 375mm, or dual tyres, in Table 1 (Axle mass limits table) of Part 2 of Schedule 1 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (the National Regulation) and to specify the conditions of the exemption under this notice.

Authorising Provision

2.       This Notice is issued under section 117 of the Heavy Vehicle National Law (HVNL) as in force in each participating jurisdiction.

 

Citation

3.       This notice may be cited as the New South Wales Class 3 Livestock Tri-axle Group Mass Limit Exemption Notice 2019 (No. 1).

 

Commencement 

4.       This notice commences on 10 February 2019.

 

Expiry

5.       This notice expires on 9 February 2024.

 

Definitions

6.       Unless otherwise stated, words and expressions used in this Notice have the same meaning as the HVNL.

7.       In this notice, road train means a prime mover with a tandem drive axle group, two semi-trailers with tri-axle groups and a converter dolly with a tandem axle or tri-axle group, where the total length of the road train does not exceed 36.5 metres in length.

 

 

 

Application

8.       This Notice applies to the following categories of heavy vehicle when carrying live cattle, sheep, pigs or goats and operating in compliance with the general mass limits set out in Schedule 1 of the National Regulation, or a Class 2 or 3 heavy vehicle authorisation (notice)

(a)    a prime mover with a tandem drive axle group and a semi-trailer with a tri-axle group, with single tyres with section widths of at least 375mm, or dual tyres, or a combination of those tyres, fitted on all axle groups, and a maximum length available for the carriage of animals not exceeding 12.5m;

(b)    a B-double which consists of a prime mover with a tandem drive axle group and two semi-trailers with tri-axle groups, with single tyres with section widths of at least 375mm, or dual tyres, or a combination of those tyres, fitted on all axle groups, and a deck length available for the carriage of animals not exceeding 18.8m;

(c)     a B-triple which consists of a prime mover with a tandem drive axle group and three semi-trailers with tri-axle groups, with single tyres with section widths of at least 375mm, or dual tyres, or a combination of those tyres, fitted on all axle groups, and a combined deck length available for the carriage of animals not exceeding 28.2m;

(d)    a road train which consists of a prime mover with a tandem drive axle group, two semi-trailers with tri-axle groups and a converter dolly with a tandem axle or tri-axle group, with single tyres with section widths of at least 375mm, dual tyres, or a combination of those tyres fitted on all axle groups, and a deck length available for the carriage of animals not exceeding 25.0m.

Conditions

9.       The mass on a tri-axle group of a semi-trailer must not exceed 21.0t.

10.   In the case of a road train, the mass on the tri-axle group of a converter dolly must not exceed

(a)    where the tri-axle group is fitted with certified road friendly suspension - 21.0 t;

(b)    where the tri-axle group is not fitted with certified road friendly suspension - 17.0 t.

11.   The loaded mass of a heavy vehicle must not exceed the applicable mass limit for the heavy vehicle under the general mass limits specified in Schedule 1 of the National Regulation or any lower mass limit for the heavy vehicle specified in a class 2 or 3 heavy vehicle authorisation (notice).

12.   A heavy vehicle to which this Notice applies may operate on all roads in New South Wales that are approved under the HVNL for the operation of that heavy vehicle, except where prohibited by a load limit specified for a road, bridge or causeway by a sign or notice.
