Queensland Heavy Vehicle Standards (Special Purpose Vehicle) Exemption Notice 2018 (No. 1)

1. Purpose

The purpose of this notice is to exempt Special Purpose Vehicles (SPV) that are heavy motor vehicles and operate under the Queensland Guideline, from complying with certain requirements of the Heavy Vehicle (Vehicle Standards) National Regulation (the National Regulation).

2.       Authorising Provision

This notice is made under section 61 of the Heavy Vehicle National Law (HVNL) as in force in Queensland.

3.       Commencement

This notice commences on the day that it is published in the Commonwealth Gazette.

4.       Expiry

This notice expires 5 years after commencement or if the Queensland Guideline is repealed earlier, the date that notice is repealed.

5.       Definitions

(1)    Unless otherwise stated, words and expressions used in this notice have the same meanings as those defined in the HVNL and the National Regulation.

(2)    In this notice -

Queensland Guideline means the Guideline for excess dimension - vehicles carrying indivisible articles, special purpose vehicles and vehicles that require a pilot or escort, (Form 4), approved by the Chief Executive of the Department of Transport and Main Roads or their delegate.

6.       Title

This notice may be cited as the Queensland Heavy Vehicle Standards (Special Purpose Vehicle) Exemption Notice 2018 (No. 1).

7.       Application

(1)    This notice applies in Queensland.

(2)    This notice applies to a heavy motor vehicle that is permitted to operate under the Queensland Guideline that is a:

(a)    special purpose vehicle; and

(b)    exceeds regulated dimensions; and

(c)     has a turning ability not exceeding 25 metres  in diameter.

8.       Exemption from Prescribed Vehicle Standards

Where a vehicle mentioned in clause 7(2) of this notice is exempt from complying with a dimension requirement by Section 4 of the Queensland Guideline, that vehicle is also exempt from compliance with Schedule 2 s34(1) of the Heavy Vehicle (Vehicle Standards) National Regulation in relation to that dimension requirement.

9.       Conditions

A vehicle exempted from compliance with certain heavy vehicle standards requirements under section 8 of this Notice must comply with all requirements of the Queensland Guideline.
