Queensland Consolidated National Miscellaneous Class 1 and Class 3 Exemption (Notice) 2015 (No 1)

  1. Purpose

(1)    The purpose of this notice is to consolidate fifteen transitional Queensland mass and dimension authorities, as a single Class 1 & 3 mass and dimension authority under the Heavy Vehicle National Law (the National Law).

2.       Authorising Provision

(1)    This notice is made under section 69(1) of the Heavy Vehicle (General) National Regulation.

3.       Commencement

(1)    This notice commences on 1 July 2015.

4.       Expiry

(1)    This notice expires on 30 June 2016.

5.       Title

(1)    This notice may be cited as the Queensland Consolidated National Miscellaneous Class 1 and Class 3 Exemption (Notice) 2015 (No 1).

(2)    A Notice mentioned in Schedule 1 to 15 may be cited by the title given under that schedule.

6.      Application

(1)    This Notice applies to eligible vehicles in Queensland.

(2)    Each Schedule provides the exemptions, conditions, routes and other provisions required for the operation of the Notice contained in that schedule.

SCHEDULE 1

Queensland Class 3 Heavy Vehicle (Grain Harvest Management Scheme) Mass Exemption (Notice) 2015 (No. 1)

  1. Purpose

(1)    The purpose of this notice is to allow for an efficient grain harvest and to protect the road infrastructure network through eliminating gross overloading by appropriate administrative procedures and compliance activities in accordance with the Queensland Grain Harvest Management Scheme (GHMS).

2.      Title

(1)    This notice may be cited as the Queensland Class 3 Heavy Vehicle (Grain Harvest Management Scheme) Mass Exemption (Notice) 2015.

3.      Definitions

In this notice—

Agforce means AGForce Queensland Industrial Union of Employers, as registered under the Industrial Relations Act 1999 (Qld).

approved GHMS receiver means—

(a)     the closest depot that is accepting the grain being delivered and that is operated by the same entity that is purchasing or has contracted to purchase the grain; or

(b)     another GHMS receiver approved by Queensland Department of Transport and Main Roads (QTMR).

eligible vehicle means a heavy vehicle that is —

(a)     of a recognisable configuration; and

(b)     making deliveries of grain, oil seeds or pulses directly from a farm to the nearest approved GHMS receiver.

Grain Harvest Management Scheme Accreditation Booklet means the booklet published at www.nhvr.gov.au/law-policies/notices-and-permit-based-schemes/state-hvnl-notices and www.agforceqld.org.au.

MDL National Regulation means the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

recognisable configuration means a configuration provided for in the Vehicle Configuration Guide published at www.nhvr.gov.au/law-policies/notices-and-permit-based-schemes/state-hvnl-notices and www.agforceqld.org.au

4.       Application

(1)    This notice applies to eligible vehicles in Queensland.

5.       Areas or routes  to which this notice applies

(1)    This notice applies to all roads in Queensland except to the extent excluded by the Grain Harvest Management Scheme Accreditation Booklet.

6.       Exemption from prescribed mass requirements

(1)    This notice exempts a vehicle to which it applies from the following general mass limits specified in Schedule 1 of the MDL National Regulation —

(a)     Section 2(1)(a)(iv); and

(b)     Section 2(1)(b); and

(c)      Section 4; and

(d)     Section 5(1), (2) and (3).

7.       Condition - maximum permissible mass

(1)    The mass of an eligible vehicle operating under this notice must not be more than—

(a)     7.5% over general mass limit applying to the vehicle combination; and

(b)     10% over general mass limit applying to an axle or axle group mass for the vehicle; and

(c)      notwithstanding (a) and (b), the manufacturer’s rating for the vehicle. 

(2)    An eligible vehicle is not entitled to have the benefit of a mass exemption in the Heavy Vehicle (Mass, Dimension and Loading) National Regulation in addition to the concessional limits provided under this Notice.

(3)    A registered operator for an eligible vehicle must be registered with AgForce for the purposes of this notice.

(4)    An eligible vehicle must be operated in accordance with the requirements of the Grain Harvest Management Scheme Accreditation Booklet.

(5)    A person operating an eligible vehicle under this notice shall indemnify Queensland Department of Transport and Main Roads and the National Heavy Vehicle Regulator and their employees, against any claim, action or process for any damage or injury due to the use of vehicles under this notice.

SCHEDULE 2

Queensland Class 3 Heavy Vehicle (Road Train Trailers Transporting Round Cotton Modules) Dimension Exemption (Notice) 2015 (No 1)

 

  1. Purpose

1)      The purpose of this notice is to allow type 1 road train combinations engaged in transporting round cotton modules between cotton farms and cotton gins to be exempted from  prescribed dimension requirements in Schedule 6, Part 2 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation and requirements in Schedule 3 of the Heavy Vehicle (Vehicle Standards) National Regulation.

Note- this Notice replaces the former Class Permit 126-TH-13am2 issued in Queensland.

2.       Title

1)      This notice may be cited as the Queensland Class 3 Heavy Vehicle (Road Train Trailers Transporting Round Cotton Modules) Dimension Exemption (Notice) 2015.

 

3.       Definitions

1)      Unless otherwise stated, words and expressions used in this notice have the same meanings as those defined in the HVNL.

2)      In this notice:

Round cotton module means a compressed bale of cotton in a cylindrical form;

Type 1 road train means a road train consisting of a prime mover hauling unit towing two trailers when the combination length is no longer than 36.5m.

 

4.       Application

1)      This notice applies to eligible vehicles in Queensland.

2)        This notice applies to a type 1 road train combination transporting no more than six round cotton modules on each trailer that does not exceed any of the following dimensions:

a)      For the first trailer:

  1. the distance from the front articulation point of the first semitrailer to the rear of that trailer must not be more than 12.75m; and
  2. Tow coupling underhang (distance between the vertical axis of the ‘Coupling’ pivot may exceed 0.3m but must be no more than 0.75m forward from the rear-most projection of the trailer.

b)      For the second trailer:

  1. Radius from the centre and forward of the front articulation point may exceed 1.9m but must not exceed 2.45m; and
  2. A diagram showing prescribed dimensions and geometry of a trailer articulation point under this Notice.
    Any extension outside of the regulatory line created by drawing a semi-circle of a 1.9m radius from the centre and forward of the front articulation point must be positioned symmetrically about the longitudinal centreline and must lie within total 1.5m wide.

 

5.       Dimension Exemption

1)      A type 1 road train to which this notice applies is exempted from the requirements in the Schedule 6, Part 2, section 4 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

 

6.       Standards Exemption

1)      A type 1 road train to which this notice applies is exempted from the requirements in Schedule 3, Part 5, section 29 of the Heavy Vehicle (Vehicle Standards) National Regulation.

 

7.       Conditions

1)      The driver of a type 1 road train operating under this notice must keep in the driver’s possession a copy of this notice and must produce the notice to an authorised officer when requested.

2)      Sufficient clearance must exist between the first and second trailer so no part of the load or combination can contact each other under all operating conditions, other than at tow couplings.

3)      Any trailer deck extensions, whether fixed or removable, must be performed by a suitably qualified person to the same standard required by the H5 code of the National Code of Practice for Vehicle Modifications VSB6.

 

8.       Stated Areas and Routes

(1)    An eligible vehicle operating under this notice may only use the type 1 and type 2 road train areas and routes shown on the Multi-combination Routes in Queensland maps found at: http://www.tmr.qld.gov.au/business-industry/Heavy-vehicles/Multi-combination-vehicles/Maps.aspx


SCHEDULE 3

Queensland Class 3 Heavy Vehicles (Transportation of Rectangular Cotton Bales) Dimension Exemption (Notice) 2015 (No. 1)

  1. Purpose

1)      The purpose of this notice is to exempt class 3 heavy vehicles and combinations transporting rectangular cotton bales from stated prescribed dimension requirements in Schedule 1 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

Note- this Notice replaces the former Class Permit 584-TH-12am1 Width Exemption for Transportation of Baled Cotton

2.       Title

1)      This notice may be cited as the Queensland Class 3 Heavy Vehicles (Transportation of Rectangular Cotton Bales) Dimension Exemption (Notice) 2015.

3.       Definitions

1)      Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the HVNL.

4.       Application

1)      This Notice applies in Queensland to class 3 heavy vehicles carrying rectangular cotton bales produced at a cotton gin.

5.       Dimension Exemptions

1)      Vehicles or combinations operating under this notice are exempt from Schedule 6 section 7 of the Heavy Vehicle (Mass Dimension and Loading) National Regulation.

6.       Conditions

 

1)      Vehicles or combinations operating under this Notice must not exceed 2.6m in width when loaded.

2)      Vehicles operating under this notice must display a securely fitted warning sign at the front and back of the vehicle in accordance with the specifications set out in Schedule 8, Part 3, Division 2 sections 41 – 47 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

3)      The driver of the heavy vehicle operating under this exemption must keep in the driver’s possession a copy of this notice and must produce the notice to an authorised officer when requested.

7.       Routes and Areas

1)      A vehicle to which this Notice applies—

a)      is restricted to the routes or areas specified in the Queensland multi-combination routes and zones maps at www.tmr.qld.gov.au/business-industry/Heavy-vehicles/Multi-combination-vehicles/Maps.aspx

 


SCHEDULE 4

Queensland Class 1 Heavy Vehicles (Cotton Harvester) Mass and Dimension Exemption (Notice) 2015 (No. 1)

  1. Purpose

1)      The purpose of this notice is to exempt specified cotton harvesters  from stated prescribed mass  and dimension requirements in  the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

Note— This Notice replaces the former Class Permit 125-TH-13am2 John Deere 7760 Cotton Harvesters Over Size and Over Mass Concession

2.       Title

1)      This notice may be cited as the Queensland Class 1 Heavy Vehicles (Cotton Harvester) Mass and Dimension Exemption (Notice) 2015.

3.       Definitions

1)      Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the HVNL.

2)      In this Notice

Agricultural pilot means a person directly associated with primary production who has held an open or provisional driver’s licence for at least 12 months, or is an accredited pilot vehicle driver or accredited escort vehicle driver appointed by the Chief Executive of the Department of Transport and Main Roads, to carry out pilot duties under the Transport Operations (Road Use Management) Act 1995, section 21.

 

Form 4 Guideline means the Guideline for Excess Dimension: Vehicles Carrying Indivisible Articles; Special Purpose Vehicles and Vehicles that require a Pilot or Escort, in Queensland Form Number 4.

 

Form 14 Guideline means the Guideline for Excess Dimension Agricultural Vehicles and Agricultural Combinations; Vehicle and Drivers Form Number 14.

 

Eligible Harvester means a John Deere 7760 Cotton Harvester that does not exceed the mass and dimension requirements set out in this Notice.

Zone 2 means the area indicated in the Heavy Vehicle Zone Maps which can be accessed using the following link: www.tmr.qld.gov.au/business-industry/Heavy-vehicles/Multi-combination-vehicles/Maps.aspx

Zone 3 means the cotton growing areas adjoining Zone 2 that lie within the local government boundaries of the Balonne Shire Council and the Maranoa Regional Council.

4.       Application

1)      This Notice applies to the movement of eligible harvesters on State controlled roads in Queensland.

Note— An operator seeking to move an eligible harvester on a local road will need to apply to the National Heavy Vehicle Regulator for a mass and dimension exemption permit.

5.       Dimension Exemptions

1)      For routes in Zone 2 eligible harvesters operating under this Notice are exempt from the following prescribed dimension requirements in Schedule 6 of the Heavy Vehicle (Mass Dimension and Loading) National Regulation:

(i)      Section 7(1); and

(ii)    Section 8.

2)      For routes in Zone 3 eligible harvesters operating under this Notice are exempt from the following prescribed dimension requirements in Schedule 6 of the Heavy Vehicle (Mass Dimension and Loading) National Regulation:

(i)      Section 8.

Note— For relevant areas in zone 3 Form 14 width exemptions apply

6.       Mass Exemptions

1)      Eligible harvesters operating under this Notice are exempt from certain prescribed mass requirements in Table 1 Axle Mass Limits Table in Part 2 Schedule 1 of the Heavy Vehicle (Mass Dimension and Loading) National Regulation.

 

7.       Conditions -Dimension

1)      In zones 2 and 3 the height of an eligible harvester must not exceed 5.3m.

2)      In zone 2 the width of an eligible harvester must not exceed 5.5m.

 

Note— In all other instances, eligible harvesters are limited in dimension by the requirements of Form 14.

 

8.       Conditions -Mass

1)      complies with the following mass specifications:

 

(a)    front axle mass not to exceed 18 tonnes;

(b)    rear axle mass not to exceed 13 tonnes; and

(c)     does not exceed the manufactures gross mass rating for the vehicle.

 

9.       Compliance with Form 14 Guideline

1)      While operating under this notice, harvesters must comply with the Form 14 Guideline except for the following sections:

  1. 4.1 General Requirements – Dimensions;
  2. 4.2 Pilot/Escort/Police Conditions - Widths Exceeding General Requirements;
  3. 4.3 Pilot/ Escort/ Police Conditions - Rear Overhang;
  4. 7.10 Letter of No Objection;
  5. 9.2 Escort Vehicle Requirements; and
  6. 13 Traffic Control.

10.   Pilot and Escort requirements by type or road and distance of travel

1)      An eligible harvester which exceeds 5 metres in width but is not more than 5.5m in width may travel on a road in Zone 2 but must comply with the obligations set out in Table 1 Pilot and Escort Requirements of this Notice.

11.   Pilot, Escort and Traffic Control operating requirements

1)      An operator of an eligible harvester must comply with the following requirements contained in the Form 4 Guidelines:

(a)    Pilot/ Escort vehicles and operating requirements - section 13; and

(b)    Traffic Control Recommendations - section 15.

12.   Areas & Routes

1)      This Notice applies to the areas set out in Appendix 1 of this Notice.

 

13.   Structures

1)      Where the height dimension of a harvester is likely to interfere with overhead structures, including cables, or falls within any specified exclusion zone for overhead wires for electrical, communication or rail authorities, approval to operate must be obtained from the relevant authority.

Note— To identify an exclusion zone see the Electrical Safety Regulation 2013, Schedule 2 Parts 2 and 3.

2)      An eligible harvester may only cross state controlled structures such as a bridge or culvert on a road that has been assessed as safe for travel and that is specified in Appendix 1 of this Notice.  

 

3)      An eligible harvester is not permitted to:

(a)    cross a timber bridge; or

(b)    travel on a structure that is shown asno go” as specified in Appendix 2 in this Notice.

Note  Where a structure is shown as a “no go” consideration must be given to another route that can bypass the structure or to floating the harvester across the structure.

4)      When crossing a bridge the driver must:

(c)     wait until the bridge is free of all other vehicles;

(d)    travel along the bridge centre-line; and

(e)    ensure the vehicle does not exceed 10kph.

 

14.   Trip Planning and registers

1)      Prior to travel an operator of an eligible harvester must:

(a)    consider the route including what structures the harvester may have to negotiate while travelling along that route, to ensure that travel along that route will not cause disruption to services or damage to property; and

(b)    obtain information about any “conditions of operation” from the Department of Transport and Main Roads website at www.tmr.qld.gov.au/business-industry/Heavy-vehicles/Excess-mass-and-dimensions/Excess-mass-and-dimension-conditions.aspx

2)      The operator of and eligible harvester vehicles must keep a trip plan and trip register of all movements undertaken under this notice and make these available upon request to an authorised officer.

(a)    A trip plan and register must contain at least the following details:

(i)      start time, date and location;

(ii)    end time, date and location;

(iii)   drivers details;

(iv)   planned route;

(v)    actual route if different from planned route and reason for diversion; and

(vi)   a copy of the Do Not Cross Structure maps relevant to the journey that can be found at http://www.tmr.qld.gov.au/business-industry/Heavy-vehicles/Heavy-vehicle-guidelines-and-class-permits.aspx

 

15.   Temporary road closures or limitations

1)      The operator of an eligible harvester must observe requirements imposed in connection with:

(a)    a temporary road closure; or

(b)    heavy or prolonged rain affecting the road.

 

 

16.   Exclusion of prescribed conditions

1)      The application of Schedule 8 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation to this notice is expressly excluded.

 

 

17.   Conditions -General

1)      The driver of the eligible harvester operating under this exemption must keep in the driver’s possession a copy of this notice and must produce the notice to an authorised officer when requested.

 

2)      If two requirements of this notice, allowing movement, are in conflict, then the operator of an eligible harvester should adopt the requirement that provides the greatest safeguards.

 

3)      An operator operating under this Notice shall indemnify the Queensland Department of Transport and Main Roads and its employees, against any claim, action or process for damage or injury that may be sustained against them due to the use of vehicles as specified.

SCHEDULE 5

Queensland Class 3 Heavy Vehicle Rocky Point Sugar Mill Mass Exemption (Notice) 2015 (No. 1)

  1. Purpose

 

1)      The purpose of this notice is to allow for an efficient sugar cane harvest and to protect the road infrastructure network through appropriate administrative procedures and compliance activities in accordance with the Rocky Point Sugar Mill Self Regulation (Mass Concession) Scheme.

2.       Title

 

1)      This notice may be cited as the Queensland Class 3 Heavy Vehicle Rocky Point Sugar Mill Mass Exemption (Notice) 2015.

 

3.       Definitions

In this notice—

The Rocky Point Sugar Mill Self Regulation (Mass Concession) Scheme is a mass concession scheme registered with Queensland Department of Transport and Main Roads published at www.nhvr.gov.au/law-policies/notices-and-permit-based-schemes/state-hvnl-notices

 

4.       Application

 

1)      This Notice applies to eligible vehicles in Queensland.

 

2)      This Notice applies to nominated Class 3 heavy vehicles registered to operate under the Rocky Point Sugar Mill Self Regulation (Mass Concession) Scheme.

 

Note:- If the Rocky Point Sugar Mill Self Regulation (Mass Concession) Scheme expires or is terminated or otherwise ceases to operate, this notice would cease to have any effect as the condition under clause 7 and 8(1) could no longer be met.

 

5.       Areas & Routes

 

1)      This Notice applies to the areas set out in Rocky Point Sugar Mill Self Regulation (Mass Concession) Scheme.

 

 

 

 

 

 

 

 

6.       Exemption from Prescribed Mass Requirements

 

1)      This Notice exempts a vehicle to which it applies from the following general mass limits specified in Schedule 1 of the Heavy Vehicle (Mass Dimension and Loading) National Regulation:

a)      Section 2; and

b)      Section 4; and

c)       Section 5.

 

7.       Conditions-Maximum Permissible Mass

1)      Vehicles operating under this notice must not exceed:

a)      7.5% over prescribed mass limits; and

b)      10% over regulation axle mass limits; and

c)       Notwithstanding subsections i) and ii) above, the manufacturer’s ratings.

 

8.       General Conditions

1)      A vehicle operating under this Notice must comply with the provisions of the Rocky Point Sugar Mill Self Regulation (Mass Concession) Scheme, in conjunction with the provisions of this Notice.

2)      A copy of this Notice must be carried at all times when operating under the conditions of this Notice and in accordance with the terms of the Rocky Point Sugar Mill Self Regulation (Mass Concession) Scheme.

3)      An operator operating under this Notice shall indemnify the Queensland Department of Transport and Main Roads and its employees, against any claim, action or process for damage or injury that may be sustained against them due to the use of vehicles as specified in this Notice.

 


SCHEDULE 6

Queensland Class 3 Bundaberg Sugar Mill Mass Exemption (Notice) 2015 (No. 1)

  1. Purpose

 

1)      The purpose of this notice is to allow for an efficient sugar cane harvest and to protect the road infrastructure network through appropriate administrative procedures and compliance activities in accordance with the Bundaberg Sugar Mill Self Regulation (Mass Concession) Scheme.

2.       Title

 

1)      This notice may be cited as the Queensland Class 3 Bundaberg Sugar Mill Mass Exemption (Notice) 2015.

 

3.       Definitions

In this notice—

The Bundaberg Mill Self Regulation (Mass Concession) Scheme is a mass concession scheme registered with Queensland Department of Transport and Main Roads published at www.nhvr.gov.au/law-policies/notices-and-permit-based-schemes/state-hvnl-notices.

 

4.       Application

 

1)      This Notice applies to eligible vehicles in Queensland.

 

2)      This Notice applies to nominated Class 3 heavy vehicles registered to operate under the Bundaberg Sugar Mill Self Regulation (Mass Concession) Scheme.

SCHEDULE 8

Queensland Agricultural Machines and Cane Bins Flotation Tyres Mass Exemption (Notice) 2015 (No. 1)

 

  1. Purpose

1)      The purpose of this notice is to allow agricultural machines and cane bin trailers fitted with flotation tyres to operate on roads in certain circumstances and within certain parameters.

Note- this Notice replaces the former Class Permit 102-TH-12 Agricultural Machines and Cane Bin Trailers

 

2.       Title

1)      This notice may be cited as the Queensland Agricultural Machines and Cane Bins Flotation Tyres Mass Exemption (Notice) 2015.

 

3.       Definitions

1)      Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the National Heavy Vehicle Law.

 

4.       Application

1)      This Notice applies to eligible vehicles in Queensland.

2)      This notice applies to agricultural machines and cane bin trailers while used for agricultural purposes.

 

5.       Exemption

1)      A vehicle operating under this notice is exempt from certain limits set out in Table 1 of Schedule 1 Part 2 of the Heavy Vehicle National (Mass Dimension and Loading) National Regulation.

 

6.       Conditions

1)      While operating under this notice the following mass limits must not be exceeded:

a)      11t for a single axle group; or

b)      20t for a tandem axle group; or

c)       28t for a triaxle group.

2)      In addition to the mass limits set out in clause 6.1 above, the vehicle must not exceed the manufacturer’s specified gross trailer mass.

3)      Vehicles operating under this notice with axle groups with a gross trailer mass of 20t or greater or a speed capability greater than 50kph must be fitted with dampened load sharing suspension and air brakes.

4)      Tyre loads must comply with either the limits listed in the following table, or the loads listed in Appendix 1 of this Notice:

SCHEDULE 9

Queensland Class 1 Tandem Drive Axle (Cane Haulout Truck) Flotation Tyres Mass Exemption (Notice) 2015 (No. 1)

  1. Purpose

1)      The purpose of this notice is to exempt Cane Haulout Trucks fitted with flotation tyres in Queensland from certain mass requirements to allow for the efficient harvest of sugar cane.

Note- this Notice replaces the former Class Permit 504-TH-12Am1 Fitment of Flotation Tyres to Tandem Drive Axle Groups on Cane Haulout Trucks class permit

2.       Title

1)      This notice may be cited as the Queensland Class 1 Tandem Drive Axle (Cane Haulout Truck) Flotation Tyres Mass Exemption (Notice) 2015.

 

3.       Definitions

1)      Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the HVNL.

2)      In this notice:

Cane haulout truck means a heavy vehicle that is constructed and used for hauling sugar cane from the field to a mill or transportation point.

Flotation Tyre means Alliance MPT382 flotation tyres, size 600/50R22.5, the specifications of which are set out in Appendix 1 of this Notice.

Non-Cyclic Duty means not restricted to recurring operating cycles of travel and rest.

 

4.       Application

1)      This Notice applies to eligible vehicles in Queensland.

2)      This notice applies to cane haulout trucks fitted with flotation tyres as defined in Clause 3 above, and are:

a)      Transporting sugar cane from the field to a transport facility or mill nominated by the operator or farmer, including unladen return trips, of a radius of not more than 40km; or

b)      Returning to a home base, commencing new operations, travelling for maintenance or repairs, or travelling for inspections or registration, provided that the vehicle is unladen and tyre manufacturer’s recommendations are adhered to.

 

 

 

5.       Exemption

1)      Vehicles operating under this Notice are exempt from certain axle mass limits set out in Table 1 of  Schedule 1 Part 2 under the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

 

6.       Conditions

 

1)      The maximum mass limit for the drive axle group must not exceed 16.5t or the lesser of the vehicle component or tyre ratings.

2)      While operating under this Notice, a cane haulout truck must comply with the mass and speed limit ratings for flotation tyres set out in Appendix 1 of this Notice.

3)      A cane haulout truck operating under this Notice must have a dual drive tandem axle  group fitted with flotation tyres rated as suitable for road use.

4)      The flotation tyres fitted to a cane haulout truck under this notice must comply with United Nations Economic Commission Europe Regulation (UNECER) 54/00. This compliance must be indicated either by markings on the tyre sidewall or by a certificate of compliance issued by the tyre manufacturer. The flotation tyres fitted must be rated by their manufacturer for road use at a minimum of 100kph and as suitable for operating in non-cyclic duty.

5)      Flotation tyre cold inflation pressure, flotation tyre maximum load and the vehicle operating speed must be within the specifications of flotation tyres and as prescribed by the manufacturer.

6)      The operator of a cane haulout truck fitted with flotation tyres and operating under this Notice must operate in accordance with the “2013 Road Safety Operating Manual for Sugarcane Haulage Trucks Using Flotation Tyres” (the Operating Manual) provided by the Cane Growers Association website at http://www.canegrowers.com.au/

7)      The operator of a cane haulout truck fitted with flotation tyres and operating under this Notice must document and manage operation of the vehicle using the Operating Manual, which must show how the following risks are systematically managed:

a)      Tyre inflation pressure; and

b)      Axle mass loading when the vehicle will operate on road; and

c)       Speedometer and speed limiter calibration when flotation tyre diameter differs from the diameter of the tyres for which the vehicle was originally certified.

8)      A copy of Attachment B of the Operating Manual must be carried in the cane haulout truck.

9)      A certificate of compliance issued by the tyre manufacturer and this Notice must be annexed to the operator’s copy of the Operating Manual.

SCHEDULE 10

Queensland Class 1 Comb Trailer Dimension Exemption (Notice) 2015 (No. 1)

  1. Purpose

1)      The purpose of this notice is to exempt comb trailers from stated prescribed dimension  requirements in Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

Note- this Notice replaces the former Class Permit 172-TH-12 Comb Trailers

 

2.       Title

1)      This notice may be cited as the Queensland Class 1 Comb Trailer Dimension Exemption (Notice) 2015.

 

3.       Definitions

1)      Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the HVNL.

2)      In this Notice-

comb trailer means a trailer specifically designed and constructed for transporting the comb (the reaping implement) of a combine harvester and associated equipment.

combine harvester means a machine which simultaneously combines the operations of reaping, threshing and winnowing grain crops.

Form 14 Guideline means the Guideline for Excess Dimension Agricultural Vehicles and Agricultural Combinations; Vehicle and Drivers Form Number 14, Version 4, October 2013.

 

4.       Application

1)      This Notice applies to eligible vehicles in Queensland.

2)      This Notice applies to the movement of loaded and unloaded comb trailers.

 

5.       Dimension Exemption

1)      A heavy vehicle operating under this Notice is exempted from the requirements included in Part 2 of Schedule 6 section 4 of the Heavy Vehicles (Mass, Dimension and Loading) National Regulation.

 

6.       Condition – Identification plate

1)      A comb trailer must be fitted with an Identification Plate issued by the Commonwealth Department of Infrastructure and Regional Development.

 

 

7.       Operating Conditions

1)      While operating under this notice, a comb trailer loaded with a header comb—

a)      must comply with the Form 14 Guideline as it applies to agricultural vehicles, as defined under the Form 14 Guideline, except as otherwise provided by this notice; and

b)      may only be used to carry—

  1. the comb of a combine harvester; and
  2. other items associated with the performance of the comb’s functions; and
  3. and equipment used to repair agricultural vehicles;

and

c)       must not, when being towed by an agricultural machine, exceed the comb trailer’s aggregate trailer mass and the tyre and axle manufacturer’s ratings; and

d)      must not, when being towed by a motor vehicle, exceed any of the following—

  1. the towing vehicle’s towing capacity;
  2. the comb trailer’s aggregate trailer mass;
  3. the comb trailer’s tyre and axle manufacturer’s ratings or towing mass ratios;

and

e)      must not exceed 80km per hour.

 

8.       Exclusion of prescribed conditions

1)      The application of Schedule 8 of the National Regulation to this notice is expressly excluded.

 

9.       Conditions-General

1)      It is a condition of this exemption that the driver of a heavy vehicle operating under this exemption must keep in the driver’s possession a copy of this Notice and must produce the Notice to an authorised officer when requested.

 

10.   Routes and Areas

1)      A heavy vehicle operating under this Notice may operate on any route or in any area it would have been authorised to travel on under the Form 14 Guideline.

 


SCHEDULE 11

Queensland Class 1 Triaxle Low Loader Trailer Mass Exemption (Notice) 2015 (No. 1)

  1. Purpose

 

1)    The purpose of this notice is to allow triaxle low loader trailers to exceed extreme axle dimensions for a conforming axle group.

Note- this Notice replaces the former Class Permit 085-TH-12 Triaxle Low Loader Trailers class permit issued in Queensland

2.       Title

 

1)    This notice may be cited as the Queensland Class 1 Triaxle Low Loader Trailer Mass Exemption (Notice) 2015.

 

3.       Definitions

1)    Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the National Heavy Vehicle Law.

 

4.       Application

 

1)    This Notice applies to eligible vehicles in Queensland.

 

5.       Exemption

 

1)    Vehicles operating under this notice are exempt from the 3.2m maximum horizontal distance between axles set out under the definition of “tri-axle” under the Heavy Vehicle National Law.

 

6.       Condition

 

1)    Triaxle low loaders operating under this Notice may exceed the extreme axle dimensions for a conforming axle group of 3.2m by up to 0.5m.

2)    An axle group subject of this Notice is a conforming axle group.

7.       Routes and Areas

1)    Vehicles operating under this Notice may operate on all roads in Queensland except:

a)      Those roads signed to restrict the use of a low loader combination;

b)      Any road where restricted by a weight restriction or mass permit condition imposed from time to time.


SCHEDULE 12

Queensland Class 3 Heavy Vehicle (Port of Brisbane Mass Management Scheme) Mass Exemption (Notice) 2015 (No. 1)

1        Purpose

(1)    The purpose of this notice is to allow for the operation of eligible vehicles at masses equivalent to the Higher Mass Limits (HML) within the confines of, and on roads under the control of, the Port of Brisbane Pty Ltd.

2        Title

(1)    This notice may be cited as the Queensland Class 3 Heavy Vehicle (Port of Brisbane Mass Management Scheme) Mass Exemption (Notice) 2015.

3        Definitions

1)      In this notice—

eligible vehicle means a—

(a)     Tandem drive rigid truck; or 

(b)     Tandem drive prime mover; or

(c)      Tandem or tri-axle semitrailer; or

(d)     Tandem or tri-axle dolly trailer; or

(e)     B-double.

Note— This notice does not apply to any of the following classes of vehicles —

 

National regulation means the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

 

 

 

4         Application

(1)    This notice applies to an eligible vehicle in Queensland.

5         Areas or routes  to which this notice applies

(1)    This notice applies to all roads, within the confines of and under the control of the Port of Brisbane Pty Ltd, mentioned in Appendix A of this Notice.

6         Exemption from prescribed mass requirements

(1)    This notice exempts a vehicle to which it applies from the following general mass limits specified in Schedule 1 of the National Regulation —

a)      Section 2(1)(a)(iv); and

b)      Section 2(1)(b); and

c)       Section 2(2); and

d)      Section 2(4); and

e)      Section 4; and

f)        Section 5(1),(2) and (3).

 

7         General conditions

(1)    The operator of an eligible vehicle fitted with a tri-axle group must—

a)      hold mass management accreditation and display evidence of accreditation on the towing vehicle carrying higher mass limits; or

b)      be accredited under another mass scheme approved or recognised by Queensland Department of Transport and Main Roads.

(2)    A driver for a vehicle mentioned in Section 7 (1)(a) must produce a NHVAS interception book to an Authorised Officer when requested.

(3)    A person operating an eligible vehicle under this notice shall indemnify Queensland Transport and Main Roads or the National Heavy Vehicle Regulator and their employees, against any claim, action or process for any damage or injury due to the use of vehicles under this notice.

8         Axle mass limits condition

(1)    The additional mass on the axle group for an eligible vehicle operating under this notice must not be more than the following

a)      a 0.5t increase on a tandem axle group fitted with dual (i.e. 8) tyres, to 17t; and

b)      a 2.5t increase on a tri-axle group with dual (i.e.12) tyres, to 22.5t; and

c)       a 1.0t increase on an axle group with single tyres on 1 axle and dual tyres on the other axle (a 6-tyred tandem axle group), to 14t.

Queensland Class 1 Pole Erecting Trucks Dimension Exemption (Notice) 2015 (No. 1)

  1. Purpose

1)      The purpose of this notice is to exempt heavy vehicle combinations used to carry power poles from stated prescribed dimension requirements in Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

Note- this Notice replaces the former Class Permit  No 139-TH-12 Pole Erecting Trucks

 

2.       Title

1)      This notice may be cited as the Queensland Class 1 Pole Erecting Trucks Dimension Exemption (Notice) 2015.

 

3.       Definitions

1)      Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the Heavy Vehicle National Law.

2)      In this Notice-

Electricity authority means a distribution entity under the Electricity Act 1994 (Qld).

Note- a distribution entity is a person who holds a distribution authority (s 36 EA 1994).

Form 4 Guideline means the Guideline for Excess Dimension: Vehicles Carrying Indivisible Articles; Special Purpose Vehicles and Vehicles that require a Pilot or Escort, in Queensland Form Number 4, Version 8, February 2013.

 

Pole Erecting Truck means a truck or a combination that is used for carrying and erecting power poles.

 

4.       Application

1)      This Notice applies to eligible vehicles in Queensland.

2)      This Notice applies to a pole erecting truck operated by an electricity authority or their agent.

 

5.       Dimension Exemptions

1)      Pole erecting trucks operating under this Notice are exempted from the dimension requirements for the length of a vehicle and trailers in section 3 and 5, Part 2 of Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

 

6.       Exclusion of prescribed conditions

1)      The application of Part 1 Division 1 of Schedule 8 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation to this notice is expressly excluded.

7.       Conditions - Dimensions

1)      While operating under this Notice, a heavy vehicle or combination must not exceed the following dimensions:

a)      Pole erecting truck rear overhang not to exceed 3.5m;

b)      The rear overhang of a pole trailer must not exceed 5m while carrying poles; and

c)       A combination must not exceed 25m in length, when loaded with power poles.

 

8.       General Conditions

1)      While operating under this Notice, a combination must comply with the operating conditions of the Form 4 Guideline.

2)      It is a condition of this exemption that the driver must keep in the driver’s possession a copy of this notice and must produce the notice to an authorised officer when requested.

 

9.       Routes and Areas

1)      A heavy vehicle operating under this Notice may use all roads in Queensland.


SCHEDULE 14

Queensland Class 3 Heavy Vehicle (Brisbane City Council CCTV) Dimension Exemption (Notice) 2015 (No 1)

  1. Purpose

(1)    The purpose of this notice is to allow the fitting of CCTV cameras to Brisbane City Council buses

2.       Title

(1)    This notice may be cited as the Queensland Class 3 Heavy Vehicle (Brisbane City Council CCTV) Dimension Exemption (Notice) 2015.

3.       Definitions

(1)    In this Instrument—

eligible vehicle means a Brisbane City Council Bus fitted with—

a)      a Closed-Circuit Television (CCTV) system; and

b)      two cameras (one each side of the bus) installed on the outside of the bus on the cant rail above the window line.

National Regulation means the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

4.       Exemption from prescribed dimension requirements

(1)    An eligible vehicle is exempt from Section 7(1) (Width) of Schedule 6 of the National Regulation.

Note— This notice also exempts an eligible vehicle from a dimension requirement that may otherwise be applied as a vehicle standard under the Heavy Vehicle (Vehicle Standards) National Regulation as a result of the operation of section 34 of that regulation. 

5.       Conditions width

(1)    Buses operating under this notice must not exceed a maximum width of 2.6m.

6.       Areas or Routes to which this Exemption applies

(1)    This notice applies to all roads in Queensland on which an eligible vehicle is authorised to travel.

 


SCHEDULE 15

Queensland Class 1 Unladen Load Platform Trailer Dimension Exemption (Notice) 2015 (No. 1)

  1. Purpose

 

1)    The purpose of this notice is to provide limited exemptions from prescribed mass requirements to allow the efficient operation of unladen load platform trailers under specified conditions.

 Note- this Notice replaces the former Class Permit 084-TH-12 Empty Load Trailer Platform Trailers issued in Queensland  .

 

2.       Title

 

1)    This notice may be cited as the Queensland Class 1 Unladen Load Platform Trailer Dimension Exemption (Notice) 2015.

 

3.       Definitions

 

1)    Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the National Heavy Vehicle Law.

2)    In this Notice-

Load Platform Trailer means a trailer consisting of one or more modules having all of the following features:-

a)      At least five equally spaced rows of axles; and

b)      A minimum of 1.6m longitudinal spacing between axle rows; and

c)       At least eight tyres per axle row; and

d)      All axle rows are steerable.

 

4.       Application

 

1)    This Notice applies to eligible vehicles in Queensland.

 

2)    This Notice applies to load platform trailers that are unladen.

 

5.       Exemptions

1)    Vehicles operating under this Notice are exempted from the dimension requirement under Schedule 6, section 4(2)(b) of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

 

 

6.       Exemptions- Particular Dimensions

1)    Subject to Clause 5 above, vehicles operating under this Notice have the following dimension exemptions:

a)      The distance from the kingpin or towing point to the rear of the trailer may exceed 12.3m ; and

b)      The deck length may exceed 13.7m in length .

 

7.       Routes and Areas

1)    Vehicles operating under this Notice may operate on all roads in Queensland except:

a)      Those roads signed to restrict the use of a low loader combination;

b)      Any road where restricted by a weight restriction or mass permit condition imposed from time to time.

 

8.       Conditions

1)    While operating under this notice, an unladen load platform trailer must

a)      travel in its narrowest configuration; and

b)      must not exceed 3.5m in width.

2)    While operating under this notice, a heavy vehicle combination including an unladen load platform trailer must not exceed 35m in length.

 

3)    While operating under this Notice, a combination must comply with the operating conditions of the Form 4 Guideline.
