DECLARATION OF AN APPROVED WILDLIFE TRADE OPERATION

I, NATHAN HANNA, A/g Assistant Secretary, Wildlife Trade and Biosecurity Branch, as Delegate of the Minister for the Environment, having satisfied myself on the matters set out in section 303FN of the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act), declare the operation that is specified in column 1 of Table 1, to be an approved wildlife trade operation under subsection 303FN (2) of the EPBC Act, but only to the extent the operation relates to the class of specimens specified in column 2 of Table 1.

Queensland Coral Fishery, as defined under the Queensland Fisheries Regulations 2008 and the Queensland Fisheries Act 1994.

Specimens that are, or are derived from, fish or invertebrates, other than:

a) specimens that belong to species listed under Part 13 of the EPBC Act, and

b) specimens that belong to taxa listed under section 303CA of the EPBC Act (Part 13A), except for specimens that belong to taxa listed in Schedule 2.

Unless amended or revoked, this declaration:

a) is valid until 22 June 2018 and;

b) is subject to the conditions applied under section 303FT specified in the Schedule 1.

A person whose interests are affected by this declaration may, within 28 days, make an application in writing to the Department of the Environment for the reasons for the decision.

An application for independent review of the decision (under section 303GJ(1) of the Environment Protection and Biodiversity Conservation Act 1999) may be made to the Administrative Appeals Tribunal (AAT), on payment of the relevant fee (currently $861 or reduced fee where applicable due to financial hardship) by the applicant, either within 28 days of receipt of the reasons for the decision, or within 28 days of this declaration if reasons for the decision are not sought. Declaration of the Harvest Operations of the Queensland Coral Fishery as an approved wildlife trade operation, June 2015

ADDITIONAL PROVISIONS (section 303FT)

Relating to the harvesting of fish specimens that are, or are derived from, fish or invertebrates, other than specimens of species listed under Part 13 of the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act), taken in the Queensland Coral Fishery:

Operation of the fishery will be carried out in accordance with the management regime under the Queensland Fisheries Act 1994 and the Queensland Fisheries Regulation 2008.
The Queensland Department of Agriculture and Fisheries to inform the Department of the Environment of any intended material changes to the Queensland Coral Fishery management arrangements that may affect the assessment against which Environment Protection and Biodiversity Conservation Act 1999 decisions are made.

3. The Queensland Department of Agriculture and Fisheries to produce and present reports to the Department of the Environment annually as per Appendix B of the Guidelines for the Ecologically Sustainable Management of Fisheries - 2nd Edition.

4. The Queensland Department of Agriculture and Fisheries, in consultation with the Department of the Environment, to finalise the review and update of the performance measurement system for the Queensland Coral Fishery.

5. The Queensland Department of Agriculture and Fisheries to continue annual reviews of the harvest of CITES listed taxa in the Queensland Coral Fishery and to report the results of the review to the Department of the Environment during the following fishing season. The report should include:

analysis of harvest and harvest trends by species/species group
spatial analysis of harvest by species/species group
updated risk assessments for species/ groups as they become available, and
any changes to management arrangements for CITES listed species.

6. The Queensland Department of Agriculture and Fisheries to strengthen management measures in the Mackay region through:

a) separating catch data from the Mackay region for reporting purposes

b) evaluating the eligibility of the Mackay region as a distinct Coral Collection Area, and

c) providing updates to the Department of the Environment on (a) and (b) in the annual review described under Condition 5.
