Horticultural Export Charge Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Horticultural Export Charge Act 1987 and the Horticultural Export Charge Collection Act 1987.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Horticultural Export Charge Regulations.

Interpretation

2. Regulation 3 of the Horticultural Export Charge Regulations is amended:

(a) by inserting into subregulation (1) the following definition:

“ ‘prescribed citrus’ means citrus of a kind in respect of which an agreement has been entered into under section 7b of the Charge Collection Act;”;

(b) by adding at the end the following subregulation:

“(4) In these Regulations, a reference to chargeable horticultural products is a reference to products prescribed by regulation 6.”.


Monthly returns

3. Regulation 9 of the Principal Regulations is amended:

(a) by omitting “products shall”, and substituting “products, other than prescribed citrus, must”;

(b) by omitting from paragraph (d) “chargeable horticultural” and substituting “those”.

Annual returns by certain prescribed persons

4. Regulation 9b of the Principal Regulations is amended:

(a) by inserting “from Australia” after “exported” (first occurring);

(b) by omitting “products shall” and substituting “products, other than prescribed citrus, must”;

(c) by omitting from paragraph (d) “chargeable horticultural” and substituting “those”.

Schedule 4

5. Schedule 4 to the Principal Regulations is amended:

(a) by inserting after “purposes” in paragraph (b) “referred to in subsection 12 (1)”;

(b) by inserting “not exceeding 1 month” after “during the period”.
